Hi there,

 

I was given my full deposit back by my previous landlord via a cheque dated 29th July 2009. I've just discovered the cheque in a drawer! The tenancy ended in the middle of June 09.

 

I've been to my bank who have (understandably) said that they won't pay it into my account if it's over 6 months old.

 

My next step is to try and contact my old landlord to get a new cheque from him - however I'd like to know my legal standpoint with him in case it gets difficult.

As far as I am aware, a cheque shows legally that you acknowledge a debt.

 

Simply contact the landlord and ask him to re-send a cheque.

 

Should you have to go to court, I would expect the cheque itself to make it a relatively easy case.

 

I assume you have kept it?
