    • yes they mostly would be enforceable, but that wasnt the point. even if they get a CCJ the very worst they could have done is get a restriction k which is useless to them. doesnt hurt anything. the CCJ would remain on file for 6yrs yes, but then gone same as a DN. the rest k charge does not show at all. and even so, the idea was to get your debts issued a default notice ASAP, them RESUME payments.. the advise is NOT conflicting, just you don't read things properly or understand.  oh well. dx
    • This is the dilemma I had then and still have it. The bit that stopped me was the post 2015 comments about them being enforceable now in most instances which I feel hasn’t been answered unless I am missing something. the bonus I guess is not all credit agreements now will be chasing me so less people chasing me down so to speak. this is the problem as there is conflicting messaging out there it is hard to plan a strategic way forward 
    • In 2017 my wife was given PIP and I finally, officially, became her carer. In 2019 she was reviewed and we were told it would be done by phone to make it easier for her as she has mobility issues and anxiety. The review was very simple, Has anything changed? No, ok, we'll stay as you are then. In 2022 a second review, this time by phone again but with an awkward given at the end for 5 years. Today, we got a new review letter (I know wait lists are bad, but I dont think the wait will take til 2027 for a decision). We're a bit confused because it's a letter, not a phone call as before. The form is just questions that ask "has anything changed" Now, since 2017, nothing has changed except we had our home adapted via disability grant. This was noted in the phone calls. So we should really write that nothing has changed in the last 2 years. The adaptations have been mentioned in both previous phone reviews, but not in writing so I guess we should bring it up. But we feel that they want us to explain everything as if it were a new claim again... And are worried if we miss something in the original claim or the phone calls she will risk losing part of the award (a 2 point swing could be really bad) It does just say "has anything changed?" But in dealing with ESA prior to getting PIP, answering the question asked "has your condition worsened or improved" at a review process with a simple "no, I'm still the same" somehow led to ESA ending and needing appeal. So just want a bit of guidance. How much detail is needed? Is minimal ok? Or should we be blunt with the fact nothing has changed, and bullet point the things she struggles with in each section?   I know the obvious thing is to just explain it all,but over 10 years the sheer amount of times the poor woman has had ESA or PIP stopped/refused just because something was missed out in their report, or they felt it meant a new claim should be made, or that they judged her healthy because we missed a tiny thing in our forms. During COVID it finally seemed like it was all just going to be smooth, especially with the phone reviews and the 5 year reward, but here we are. We just want to make sure we have the least chance to trip ourselves up, but making sure we have what is expected if you get me? I wish I still had a copy of the forms from 2017, because I could just verbatim copy them and add in about the adaptation, but (ironically) we lost our photocopies we kept of them when the house was being adapted
    • might of been better to have got them all defaulted 2yrs ago as we carefully explained before then you'd already be 1/3rd there and your current issue would not be one.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am a single working parent and i have my monthly wages paid into my Barclays account. I have a Barclaycard with a ballance outstanding that is under dispute as they have not supplied me with my aggreement after numerous requests to do so.

Today i find that barclaycard have taken half my wages from my current account leaving me with approximately £100 to live on for the month!:mad:

I know that barclaycard are allowed to do this but is there anything that i can do as i am now left with no money for me and my 2 children to live on?

Nightmare surfboy, your right thay are allowed to do this, bit late now but you must open a new account elsewhere or they will continue to use the rule of 'offset' whilst you have more than one account with them.

 

I'm not sure what if anything you can do.

I have already opend another account with nat west, i need to get my wages paid into the new account and alter my direct debits.

I just wonder if there is any way i can get my money back as barclaycard have not responded to my s78 request and i also know for a fact that i have not signed any credit agreement with barclaycard.

Hi,

 

I am sure I have read on here that you can try claiming it back under 'Hardship' rules.

 

Try searching under 'offsetting', something may come up.

 

Oh, this may only apply if the money going into your account is a benefit of some kind, not a wage.

Hi Surfboy,

 

They cannot take the money and not leave you enough to live on. They are allowed to offset, but you must be allowed to pay priority debts/commitments first. These are mortgage/rent, council tax, tv licence, utility bills, etc., and of course you are allowed to eat, money for fares to get to work and so on.

 

Call the Financial Ombudsman Service first thing in the morning and tell them what has happened. They will note your complaint and put you through to a direct line to Barclays Complaints Department (without you going through the call centre).

 

They did this to me three times last year and reimbursed it on the same day as soon as I called FOS.

 

Make sure you tell FOS you are a single parent with two children. They took my child benefit on the day it came into the account, and that was not appreciated by FOS.

 

Also, Barclays will argue that they cannot tell if you have priority debts/commitments unless they are paid by Direct Debit or Standing Orders. This is complete rubbish and FOS will confirm that you do not have to pay your bills by these methods in order to make it easier for Barclays to offset.

Read through the threads and then make a formal complaint to Barclays London HQ by Rec'd Del'y letter.

 

Although you say the BC a/c is in dispute because they have not sent your credit agreement, they may have fulfilled their obligations by sending you their T&C's.

 

However, pursue the matter vigorously on the basis that they have not left you sufficient money to pay your priority bills.

Barclycard have not even sent me any terms and conditions in response to my CCA request ! All they sent me was a letter stating that my agreement would be sent in further correspondence. I waited for a few months then i sent them a CCA reminder letter , then i got a further letter saying that i would be sent the agreement in further correspondence! this has been going on for over 2 years........ they havent even sent me a reconstructed copy!!!!!! they have sent me a big fat zilch!!!

I have not contacted FOS yet , I have spent the day changing over my direct debits and getting my child tax credits paid into my nat west account.

DCAs have tried to collect on the barclycard but i have easily sent them packing when i informed them of the dispute and lack of response to my CCA request

Hi SB,

 

By sending you their T&C's BC may have fulfilled their obligations imposed by s.78 CCA 1974 so the a/c is not necessarily formally In Dispute.

 

However, as BC said that they will send you further documentation and failed to do so, I think you should use this angle to argue with BC that they had no right to take unilateral set-off action.

 

Add to this that the money they have taken is required for priority bills and to see you through the month.

 

You can offer to send BC a Budget Planner to demonstrate how much money you require through the month and how much, or little, you can offer to pay them towards the a/c until the dispute is resolved.

 

Or enclose the Budget Planner with your complaint.

 

But you must get this off quickly as, the longer you delay making a formal complaint in writing, the less likely you are to get your money back.

Sorry, I thought they HAD sent you T&C's.

 

So you can use the fact that they've not even sent T&C's to contend that they are in default of your CCA request.

 

Accordingly they had no right to take ANY collection action and your complaint to Barclays will be stronger as a result.

 

Send it quickly and perhaps email a copy of your letter before posting a hard copy to the CEO's office.

I have now closed my account with Barclays and i will not be paying another peny to Barclycard unless i am orderd to do so in a court of law.

No , not yet , as i have been stuck at work doing 24hour duties because of the bad weather.(Hard to do when you are a single parent.) I think that i will be on the phone tomorrow complaining .

Just got off the phone to FOS, had an interesting conversation.

Telephone opperative has told me that they have just had a note through advising them that banks are now allowed to enforce agreements even if they do not have / have lost/ credit agreement!

I asked him where he got this info from, he said it was a high court ruling last week!

I asked if he had any more details of this ruling, court details, case number, anything?

He said that all he got was a note saying that the high court had ruled that they could enforce without an agreement!

This is what the FOS are now advising customers !

funny you should say that, but i was told today by the FOS it was regarding the CCA's, as the request we sent DOES allow them to send you a CCA but WITHOUT the signatures, i gues to force our hands into- do or dont we want to take them to court incase they do have the signitures........... i have the horrid feeling i am being b@ggered by statutes that are there to protect us.

 

ive just got back from the police station trying to report barclaycard for theft, they have no contract signed by me and opened a platinum credit card account without me signing a cca.....and the barclays bank account the 'off set' against was opened by my old bank the woolich......... so ive never signed anything with the bank, so ive not agreed to there terms and conditions etc............ so i see it as theft........ the police just said they are a big organisation and have bought the debt so they can do what they like.... i told both the sargent and the woman pc i am reporttying both of them for neglecting there duties:mad:
