TM legal? why didn't ovo do this themselves as they do but chose to sell the debt on for 10p=£1? funny debt you state you reived a letter of claim, why did you not reply too it.? also is there is no indication of the date this bill comes from on the claimform? how do you know its from 2022? what other previous paperwork have you received? please scan page 1 of the claimform and bothsides of ALL previous letters upto one mass pdf read upload carefully. .................. pop up on the bulk court website detailed on the claimform. [if it is not working return after the w/end or the next day if week time] . When you select ‘Register’, you will be taken to a screen titled ‘Sign in using Government Gateway’. Choose ‘Create sign in details’ to register for the first time. You will be asked to provide your name, email address, set a password and a memorable recovery word. You will be emailed your Government Gateway 12-digit User ID.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I am a new poster on this forum and found it by googl`ing "excel parking charges".

 

I am in the HM forces and yesterday recieved a letter at my work place saying that I owed £100 in parking charges dated over 2 months ago. It states I was parked longer than the permitted time in Park Tawe Swansea car park. On the day i had no notice on my car to say I had overstayed, so that is why I was so surprised when reading this letter yesterday. I had recieved no such first letter of the offence, but received this second one which was why the charge was at £100. I would like any advise on what to do as I dont feel inclined to pay , but would they take me to court or have the baliffs around my base trying to get on to see me lol ?

Excel is a just a [problem] private parking company from whom any "invoices" can be safely disregarded and the money put to better use by the recipient.

Ignore them, they will never get past the front gate anyhow:D

Or is this what our country has now come to? The brave men and women who risk their lives are rewarded by the government allowing cowboy car park operators to make these kind of threats?

 

I read somewhere that the parasite running Excel is making £450,000 a year from that sleazy outfit, which is approximately 20 times what someone in the armed services gets.

Thanks for the advise guys, and that was one thought in the back of my head about threatening to contact my CO, but in the end I am not giving out £100 quid for something I didnt do and the fact they haven t given me any details from the time I parked and the time they allegedly got me down as leaving just boosts my position in not paying up.

Normaly CO's won't entertain DCA's or phone calls from random agencies saying that one of their soldiers owes money, so try not to let the thought of them doing that intimidate you into paying money you don't owe.

 

It's not an offence to be in debt or to owe someone money, well not in civvie street:D

 

If they do make contact with your unit, then you should lodge a formal complaint to the BPA, and get Watchdog involved as they love parking companies...

 

Now make sure your kit is pressed for parade in the morning..;)

If that is the case, I am sure newspapers like 'The Sun' , etc that like to support the troops would love to take this story and run with it, can you imagine the backlash????

Have you heard anymore from them??

 

I have had a third letter saying last chance to pay before they commence court proceeding's, but I haven't paid or reply`d to them hoping the bad smell will just eventually fade away.

They won't entertain taking you to court, it is just empty threats, you'd think they would grow up and speak to people like adults. Just ensure you file everything properly, and make a note of dates you RX the letters and any calls they make to you.

 

They're trying it on in time for Crimbo, and want to boost their Slush fund.....losers..
