    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi sorry to ask a question that has probably been asked 100s of times. Today I received a parking charge from the above (this is their website www.carparkmanagement.uk.com). I can't find any info about them on here so wondered if their parking charge was a proper one and should I pay it.

 

I parked in a free carpark on a retail site, didn't use the shop and hadn't realised that they had started issuing tickets. I've done this before and sometimes pop in the shop and sometimes don't, there are always plenty of spaces so I didn't think I was harming anyone.

 

I asked the man who issued the tickets and he said they started last Thursday and there were in fact some signs to inform me of the new charges. When I looked high enough up there were some signs on the lamposts which stated that you could park for 2.5 hours if you were using the premises and that a £75 charge would be issued if you didn't - can't remember the exact words. I don't know if they photographed me or what - I assume they did. If I pay before 14 days I only have to pay £60.

 

Has anyone had any dealings with them, should I just ignore it.

their website is in violation of e-trading regulations. enter any old ticket number and select an amount and it proceeds to payment without validation. also violates The Companies (Trading Disclosures) Regulations 2008 No. 495 cowboys. also check out http://www.consumeractiongroup.co.uk/forum/parking-traffic-offences/164651-problems-ppcs-face.html?highlight=problems+ppc+face

I also received a ticket from these cowboys on 1/10 when I went to the auction,but had to park off site.It was issued on a street with no parking restrictions other than their own sign.Since then I have been to the same street on four occasions at around the time the ticket was issued and have not seen a single attendant.It seems that they only patrol this area on the days that the auction is being held,as they know that the car park gets full and people park outside.As lamma has stated,any number you put in takes you to the payment page,regardless of how many digits you use,surely if they were legit an incorrect ticket number would be followed by an error message.They just seem to be a bunch of chancers with hand held printers,don't pay.

Hi, I got a ticket off this company the other month and now i have got a letter from a debt collecting company, what should i do? the cost has gone up, how did they find out my address? I did park there and i was the driver, can someone help?

hi, yes the company is called TNC Group, i contacted the actual Car Park Management today and they have agreed that i pay it back weekly so i am going to do that, they had pictures and i did overstay. Its just bad luck, i did not know they could get my details from the DVLA though, thats just nor right! whats the point of data protection if they can just get the details!

Why are you paying them, what was the charge for?

 

For instance if you parked in a pay and display and it cost £5 and you never paid then you owe them £5! If they used DVLA to get your details you may owe them £2.50 fee plus a reasonable amount for admin maybe £5/£10.

At best you owe them £12.50/£17.50. Anything more then that is a penalty which they are not entitled too.

 

I would have simply ignored them, I suggest you do the same.

I'll bet they agreed you could pay it! How very nice of them! But what do you mean by "pay it back"? You don't owe them anything in the first place. There's nothing to pay "back". Also, you shouldn't look at this as "bad luck" - it's an organised system to get their hands on your hard-earned money. It's a trick!!! They are trying to extract your money from your bank account with your co-operation.

 

You owe nothing.

You don't have to pay.

You are in danger of being the victim of a con if you pay them.

You don't have to contact them.

You don't have to answer their letters.

You don't have to speak to them.

You can and should entirely ignore them.

Don't pay them one penny!!!!

Agree 100%. Do not pay them anything. Do not enter into any further correspondence with them or their agents (e.g. any so-called Debt Collectors or Roxburghe/Graham White solicitors), all of whom are part of the same sordid business, and all of whom have no powers whatsoever to demand/collect money off you.

dave2011, you legally owe them the charges for the overstay. Nothing more (except as some have said some minor expenses they may have incurred in tracking you down and writing to you).

 

Photos are meaningless, what do they prove??

 

Please don't pay them!!

No. You morally owe them (arguably). Legally you don't unless they sue you for them and win, which would be a waste of everyone's time.

 

 

Technically they would be construed as liquidated damages, so under contract law, one party would have legal recourse to sue you for those elements of their losses. Semantics, really.

 

 

The point I am makng is that if they came after you for 25p or whatever then fair enough, but as they invariably choose to come after people for upwards of £100 then they should indeed be completely ignored. On that we agree I suspect!

Hi, on the 02/11/2012 Myself and my mum went to a firework display and parked in a retail car park, we were in the car for around 45 minutes waiting for my sister to meet us and we left at around 7:05PM, we were around 2 hours and when we got back we noticed a car parking notice from this company and the ticket was given at 20:15 and the reasoning they gave "Walking outside" when we looked at the car park sign it said no authorized car parking but does not mention any times, there also is a 24/7 burger king on the premises also not everyone received the tickets....only around 20 cars around us received them.....my sister did not, but almost everyone who parked in the same car park went to the same event. i apologize for my awful grammar and spelling and i hope you can help!
