      As above so it is essential you don't appeal and accidentally reveal who was driving. Stay quiet to Met and their pet DCA unless you get a letter before claim.

      Hello, welcome to CAG. Thank you for the information. To answer your question, we don't recommend appealing at all. It will be a waste of your time and you could end up outing the driver. Ask any questions that you have but basically you keep an eye on this, keep the correspondence and if MET ever they send a Letter Before Claim/Action. If you get to that stage, we'll suggest being proactive. Best, HB EDIT: Could we see the other side of the PCN please? Sometimes there is information that they've left off.

      Hi All, Can ii get advice on this PCN received at the services near stansted airport. Picked someone up at night and went to grab coffee and snack in mc Ds, and didnt realise there was zones in this car park, it was late dark and pouring with rain so obvious u see the large 60mins parking free and dont stand around reading everything. My son and his mother were in the back of car still as he was sleeping. Ticket appears to be from CCTV camera   should i appeal, then see what they say (assume it will be rejected) then go to POPLA,   Thanks in advance     1 Date of the infringement 28/4/24 2 Date of issue  30/4/24 (says 14 days from date of letter) 3 Date received 4/5/23 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] N 5 Is there any photographic evidence of the event? pic car and n0 plate 6 Have you appealed? [Y/N?] post up your appeal] Not yet Have you had a response?       If you are confident that citizens advice are going to give you the help you need, then you should stick with them. No point in trying to ride two horses at the same time. It will only lead to confusion and conflicting advice. Also, the people at citizens advice get paid. Everybody on this forum works completely free of charge – no payment – no strings. I hope you get your money back, but for the moment I'm going to close this thread

      Hello,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

      We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A friend of my Dad's didn't get any post for a few weeks, but not being a chap in popular demand he only chased it up when he didn't receive his usual bank statement or his wifes new passport. The passport office assured him it had been sent out a week earlier and it should have been received.

 

He then followed it up with Royal Mail and they told him it had been re-directed as requested by him for all of his mail! The man had not asked for any mail to be re-directed but RM gave him a copy of a form that was signed by someone else and instructed his mail to be sent to an address in Manchester.

 

Despite arguing that he hadn't signed the form or moved address RM didn't want to know and said they couldn't do anything to help. So the next stop was to the police and they said the same thing. Something isn't quite right if the law is allowing such easy theft/fraud and leaving a person in Manchester free to use all the documents they have obtained, including a passport.

Hi Crapstone,

 

This sounds very odd, when i last did my redirection with the P.O. i had to take proof of residence for my current address to allow it to go ahead. Have you checked what the correct procedure is now and see if the P.O. have breached their own protocol. It seems strange that the police are not willing to get involved perhaps you could ring the manchester police and ask them to check out the address who knows what it might uncover. There are so many passport scams that we read about.

When I did a re-direction two letters where sent by RM - one to the new address and one to the old address (with a label stating NOT TO BE REDIRECTED). These letters confirm that the re-direction is to start soon and allows for cancellation.

according to Royal Mail's website, two specific forms of ID are required to enable redirection to take effect.

 

There's also this interesting paragraph -

 

Your personal details could be acquired by someone stealing your mail, particularly if others have access to your post. Fraudsters may also seek to redirect your mail without your permission. If you suspect your mail is being stolen, or whether a mail redirection application has been made in your name without your knowledge, contact Royal Mail Customer Care on 08457 740 740.

 

That's where I would start.

but you don't you need to supply card details for payment? This will be used for a background check for authenticity along with your telephone number.

 

The important thing is that they have a process in place for cases like this.

I'm not personally involved in this but it's very strange and not ideal. I have no reason not to believe my Dad's friend and he seems to have tried all the right channels. Other than stopping the redirection they have offered nothing.

 

It could all be a mistake but if someone has received a passport in Manchester (innocent party or not) and hasn't returned it then you'd think the police would be looking into it.

 

I know from experience that it's fairly easily to redirect mail without a person knowing. My OH had all our joint mail and my own mail redirected to a factory unit in a bid to stop me knowing how much debt he had got us into.

I set up my re-direction on the Royal Mail website & didn't need to send any ID, it was that easy.

 

Are you sure? You can renew re-direction on the website, but to set it up it must be done in person at a post office

Hi, i noticed last nite when searching the web there is another site for redirection of mail. You just click on the companies that you want to receive your mail from. Ooh no DCA ticked then lol I will try and find it again it was late and i forgot to bookmark it.
