Time is ticking yes, but we are looking at last payment in feb 2009 with default in may 2009, so feb-may 2015 for this to all go away is another 3 and a half years! I really need to get my life and finances in order..

 

I've re-read shadows post #35 and even there he mentions at least claiming the charges back. dx100 in another thread of mine has mentioned that the reclaiming of charges does not effect the time barred clock, as you put it. So no harm to give it a go?

So I've received a letter today from them (exactly 14 days from my original letter) saying my signature does not match the one they have on record and that I need to send a passport copy showing my new certified signature.

 

I will send back the the letter before action saying their 14 days are up but add a paragraph to say you dont need to see any of these docs and I can sign as I wish, but enclose a copy of my passport as proof of ID. Is that ok?

 

Also, are the 14 days, working days or normal days.

 

Finally, do I need to update SOC 2 weeis on (with new date, as interest will bring total up) or leave as is?

your choice, for now if your letters are being forwarded by the Post Office leave it for now, if not and you are going ahead let them know, as eventaully you would no doubt have to inform a court, if it went that far, but it is up to you, others may comment as well

Can I ask when you took the Credit Card out?

 

I guess that the 14 days you gave them are up by now, have you issued a claim? If you haven't then issue one. Capital One will pay up within two weeks of receiving your claim.

i wouldn't say any of the info is conflicting.

cobs is just new to us all.

 

sb is from the last payment date

or the last time you wrote a letter

stating 'this debt is mine' and signed it.

I sent 2 F&F offers (from CAG template) to Lowell on behalf of my wife (in her name but just initialled not signed) does that retart the 6 year clock on sb?

alangee- I think I took the card out in 2007..And yes, the 14 days have passed, I had a lot going on and time has just flown by..

 

dx, they have offered a discount, but not a refund of charges. And that was through DCA not through them directly.

 

So to be clear when I send out final letter, do I update SOC or do I stick with the original one from the letter (because the change of date will increase the interest charged). So in future with every letter I send an updated SOC to reflect the new interest charges?

it matters not who is offering the discount - it means no court ever.

 

update your SOC yes.

 

interest charges should not be included on your SOC anyhow

you cant reclaim those, where did you get that from?
