    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Bought a car last year and was advised to buy extended warrenty (which i stupidly did). Anyway car started making funny noises so phoned customer protect for help and advise they advised me to take car into garage for investigation. The garage then found problem was a fly wheel or something to do with the clutch which shouldn't break.

Customer protect sent out a specialist engineer who checked out my car he sent them a report saying that it did'nt happen suddenly and that it was wear and tear.

 

What!!!!!! i've spoken to the main dealer who said that the particular part shouldn't go. The noise did happen suddenly as one day it wasn't there the next it was !!!!

 

I'm pretty naffed off as i was told this gold policy covered almost everything to do with the car.

 

Any advise would be great

Sounds like the dual mass flywheel type that seems to be too weak and fail prematurely. So what do you expect, their assesor is giving reason for them not to honour the claim. Get the indendent mechanic to write an engineers report and Google the problem where you should be able to collate enough evidence that the part is inherently weak and can self-destruct with little to no notice. You could also try contacting Consumer Direct who are the first step towards Trading Standards being involved. The claim will be honoured if you're tenacious but expect them to try every trick in the book not to pay out. This my personal opinion and should not be treated as formal advice or anything but a layman's interpretation/suggestion.

Thanks for your advise mr MT.Customer protect hired an independent engineer to check out the problem which he honoured, it was Customer protect who denied the claim. I'm asking for the reports off them. As they would only pay pitance per hour for labour i couldn't take the car to the dealer, however honda have told me to take the part to them to check out once the work has been done, as supposedly it should go with the amount of miles my car has done.

Yes, I think it's imperative that you keep the faulty parts as evidence and don't let anyone take them away from you. If Honda want them, let them examine them under your supervision. It may seem overly paranoid but greedy companies have only brought on themselves.

 

I'm wondering though, is your Customer Protect covered by any sort of Ombudsman or other Regulatory Service you can contact for how best to proceed? If so, it'll be worth asking their advice - good or bad, it's all useful ammo. Good luck.

Suposedly i have to contact the dealer who sold me the car, Which i have done!

The guy received my letter and phoned (i didn't give him my number) saying that the company went into administration in march, he had taken over from him and didn't know anything about it. I received the letter back from him in the post this morning.

 

I'm 99.9% sure its the same guy i bought my car off, so i've sent him another letter asking him to send me all stuff on my car and evidence for the warrenty company they went in to administration. Also if he had no info how did he get my number !!!!! :confused:

 

we'll see how this ones goes

 

received a letter off auto protect this morning also saying they will look into my complaint and get back to me within 21days.

Keep them under pressure but try to remain aloof - difficult I know but being somewhat aggressive usually forces the other side to spend all their energy on defending themselves and closes their minds to finding an amiable solution.

 

It's always a waiting game and they use this to their advantage as you probably need your car for everyday life. It might help move them on by letting them know that you're incurring extra expense (like taxis/hire car or even another runaround!) while they're "looking into it" and that you'll be looking to them for compensation at the end.

 

However, if you want more accurate and expert advise you could try alerting the admins and ask if anyone specialises in the field that could take an interest in your posts. Check the Hazard Triangle Icon bottom left. Also CAB and Customer Direct (Trading Standards) should be able to give you further advice.

Received their response this morning. We're sorry but we can't free up the report you'll have to contact your dealer to free up this information.

 

I've tried on numerous occasions to contact this bloke. He claims the companies gone into administration, and he uses the premises for his new business. I've checked companies house and there is no record of this so called company (which i bought my car from)going into administration or even the company.

On phoning this guy(as he just returns my letters)he told me to contact the administrators, which he didn't know who they were, but that he saw the guy shopping and if he took my number he could pass it on when he saw him next.

 

It all seems very dodgy to me and i don't know what my next move would be

Hello,

 

Was it consumer protect or the car dealer that went into liquidation?

 

Somone was trying to sell me a car warenty/insurance from that company today.

 

The only details on their litreture was their address, only noticed this after I got home , seemed very odd not to have a telephone number or web address to look at.

p.s. guess that doubles the no I don't think so on getting it.

Hi

I am still fighting with Customer Protect. I bought a Subaru Impreza from Devon Motor Company - One owner, full Service History, etc. etc. I took out a warranty as advised by them with Customer Protect (VERY STUPID). My husband drove my car from Devon to pick up his mother from Staffs. On the way back on the motorway the water pump failed. It was instant failure. The car has been properly maintained etc. Customer Protect sent out an engineer who said it was Possibly wear and tear and there was Possibly engine noise prior to it failing and it would have overheated. The enine shows no signs of overheating and bascially what their "independant" (!) engineer said was a load of twaddle. Various other engineers have looked at it and basically the report is utter rubbish.

 

Water pump failure on a Subaru is almost unheard of. I spoke to Subaru Technical Team and they said if it was a water pump failure it would have been instant. I spoke to their customer services who did not want to be drawn in - basically weren't interested in helping either.

 

The car has only done 50,000 Miles so should not be a timing belt issue - another possiblity from Customer protect engineer.

 

Basically they are worms and try and wriggle out of any situation. They are latching onto the ambiguous statements from their not so Independant engineer from Automotive Consulting. They are getting paid by Customer Protect after all!

 

My advise to anyone is do not use under any circumstance.

 

I would however be interested to hear if anyone has ever managed to get any money back from them.

and take the car back to the seller and get it repaired under SOGA rules.
