Hi

 

I have been on holiday for a week, so thanks to everyone for your support and comments, also apologies for not getting back to you. :D I rang the Bailiffs on the 28th Sept and the guy dealing with my case was on Holiday untill last monday,(I was told that a letter had gone out to Barclays, and was expecting some kind of communication from them when I returned from my holiday, but there was nothing), so I am no further on at the min. I did call them back this morning but it was after 10.30am and they were all out collecting debts - as thay do!, so I will post again in the morning after I have called the Bailiffs.

After consulting wuth collegues about Barclays now applying to the court for the stay here is the opinion;

A request for a stay can always be contested, and in this case it is very likely that the judge would seriously consider a refusal.

 

In cases where the bank has missed deadlines, it is often worth including a comment on the AQ that you respectfully ask the judge to decline any request for a stay due to the conduct of the defendant, and in particular their continual attempts to delay and frustrate your claim.

 

If nothing else, it puts a picture into the mind of the judge which may help your case at a later stage.

 

 

It might also be an idea to put together a list of all the cases which they've settled (from the Barclays successes forum), to show the judge that they probably have no intention of defending it anyway.

Thanks Martin for your excellent advice, support and speedy responses.

 

I have not as yet had any corrispondence from Barclays or the court. Should I ring the court or do I just wait for the AQ to come and fill it in with all of the info you have given me in your last post?.

 

Also since I started my MCOL I have since incurred a further £150 worth of bank charges, do I start the proceedure again from scratch?:-x

Hi Alison.

 

I would go ahead and start the second claim BUT, if Barclays were to make contact and a settlement was on the table regarding your current action, I would refer to your second claim and ask them to add this amount to the amount in the judgement in return for you halting the action you've just started. Another £150 is not going to make that much difference to them at this stage.

I think the following thread will be of interest to you.

It appears Madam Ra had the same issue with incurring charges after the original claim and managed to get them added onto the final settlement figure without having to start a whole new process.

Lba sent 30th August.

Rejection letter sent 9th Sept.

Barclays reply 13th Sept.

Mcol submitted 15/09/2006.

AQ received 21/10/2006.

AQ returned 23 /10/2006.

Court Date:25/01/07 10.30am

Phoned Barclays 08/01/07 Said they would contact me shortly.

15/01/07 Received letter offering a full settlement however figure was short.

22/01/07 Received telephone call from Barclays asking for a settlement figure.

CLAIM SETTLED IN FULL!!!!!!!!!

Hi and thanks very much for your posts welshman and Argyle, I have looked at Madam ra's thread and when I get the phonecall / Letter I too will chance my arm and ask for the extra £150 back. :)

 

When I got home from work today I had some corrispondance from Bow County Court, but I'm not too sure what it is or what I need to do about it? The form reads:

 

To the Claimant

 

n244 appln rtnd no fee enclosed

 

Then it has my name and address on the left hand side and Please reply To: then the address of the Court Manager at Bow County Court in the right hand corner.

 

The very last line of text is:

 

EX77-Interim Return on a Warrent of EXECUTION

 

Has anyone had one of these or can you point me in the direction of a thread that has recieved somthing like this, or simply advise me on what, if anything I should do about it.

 

As always any advice appreciated, I feel like I am playing the game of Sooo close but no cigar!?

The n244 is an application.......presumably for the warrant ?

 

I think this may have come as a result of Barclays application.....hence the court at their end in which they have applied to ?

 

The warrant looks to have been stood down pending the stay.Have no knowledge of ex66 ? could this be the form for reclaiming the fee paid for the order ?

 

The n244 would have been the original order.

 

I would call St.Helens tomorrow......hoe did you pay for the baliff ?

Or if you havnt paid then that would explain things.

Cheers Martin, I will call St helens Court now. I had to pay for the Bailiff as and when I applied for judgement by default and the £55 is on my statement, so I have paid as far as I am concerned!

 

I will let you know what the court says

After a bit of ringing round to various courts, I have just recieved the best news in months - Barclays have sent a cheque for £977.08 to Bow County Court In London. I won and never had to speak to Barclays once, I never even had to sign a confidentiality agreement form. I am well chuffed.

 

I would also like to say a big thank you to MARTIN3030 who gave me lots of help and support.

 

I will be donating as soon as I get my cheque from the court.

I hadn't requested the £150, I was going to see if Barclays contacted me and then I was gonna ask if they would add it to my claim. I will be starting a new claim as soon as my cheque arrives and clears though, cos I know that i will win! ;)

Ali if u got any more claims get them in.Called St.Helens Court today and the manager said they are fairly quiet now.....only a week to 10 days behind normal !

 

though I am still awaiting on 3 claims upstairs there !:rolleyes:
