  1. Well the money will be in the bank within hours (had a confirmation call from Barclays) This is a copy of the letter i sent to the local court... Dear sir,madam, I wish to stop my claim against Barclay Bank PLC for unfair bank charges. I have received a full and final settlement letter from the Bank and the monies disputed will be paid back to me shortly in full plus all costs. Please find attached a copy of the settlement letter from Barclays Bank. (Attached PDF document). May I take this opportunity to say that the service I have received from the county court over this matter has not been the best. We both know that thousands of claims just like this have, are and will go though the county court system. You and I both know that not once has a bank set foot into a courtroom to defend this action. I believe that the county courts should be pushing to get this ridiculous situation resolved, either by forcing the banks into a court date faster (knowing that it will not take up a court room) and/or forcing the OFT to fight customers corner on this matter. I’m a strong believer in the civil system working with criminal law myself but the process I have found is slow and complicated and is geared toward the big company (the defendant in most cases), not the average man on the street. Due to this complex system I can now see why many people give up on their claim, a claim for money that is rightly theirs- taken from them unlawfully by banks acting outside the law now for many years. Overall I believe that the UK high street banks are using the county courts as a crude obstruction to be used against their customers. They know that by making the process long and drawn out they will quit and the county courts are doing nothing to stop this. Staying claims is common practice by the courts and in my opinion total useless- the end result is always the same? It only serves to aid the banks. I believe that the county courts have lost sight of there role- to uphold the law. The only people losing here is the average citizen. Yours sincerely... So I got that off my chest.
  2. Don't worry. Get the AQ right (read how to do this first, it is here somewhere i just don't know where), pay the fee's and sit back.
  3. No you don't. It sounds like it is in the hands of your local court now? At the point when you start to use MCOL they would have let Barclays know the claim number. There is a section on this site writen by jonnie 2 bad i think about what to put in the AQ. Good luck.
  4. 1) I have sent back the settelment letter with the 'shut up of else' part crossed out. 2) Thay did threaten to close my account, they did cancel ALL of my DD's and standing orders but the account (and i didn't known this at the time) was still open. 3) TAGGIL- ring them, if you have a court date they will settle... make sure you have all the sums infront of you ready and don't settle for anything less than THAT days total. The guy seems human so no demands or shouting, he is just doing his job. This is the number to call... anthony lomeardi, 020 7116 4523.
  5. I WON!!! £2864 ON IT'S WAY TO ME... RANG ANTHONY LOMEARDI, THEY DID TRY AND GET AWAY WITH PAYING LESS INTEREST BUT I HAD ALL THE FIGURES READY TO FIGHT MY CORNER. THEY SETTLED IN FULL. I JUST NEED TO SIGN THE SETTLEMENT FORM AND SEND IT BACK, HE SAID THEY WILL THEN PUT THE MONEY INTO MY ACCOUNT. THANKS TO EVERYONE THAT HELPED ME ALONG THE WAY. I WILL BE MAKING A DONATION WHEN I GET THE HARD CASH!
  6. Well i called Barclays again today with my fingers crossed... Spoke with anthonti, nice guy but seems very busy at the moment (well thats their fault- Not mine!!!) Said he still has not looked at the file as some weeks to go until court date (2nd feb). He said that he will be looking at the file next week and will give me a call back on my land line so we can look to settle. As long as i get the money before that date i'll be happy. Will keep you all posted.

  8. Just to confirm i don't have to submit my court bundel for an allocation hearing do I ??? The letter i received is on my post number #70.

Anthony Lomeardi said that this is just the process that they go though, they (meaning the him and his department) can't give the money back until the person claiming the money back has a court date so in other words only the most persistant of us will get anything. I still can't see why it takes so long to 'varify' the charges on my account and when i do get that call from them and they screw me about they can think again.
  10. Just rang anthony lomeardi and he said that now I have a court date he will 'varify' that all the charges are correct on my account and he will ring back some time in jan 2007.

I would write (and this is no lie!)... last time i did talk to one of the 12yr olds there they said that beacuse of 'all these people and there banks' we can't even open new post for 13 days- thats just to get round to opening it!!! I'm in no rush, i stopped getting stressed about all this a long time ago, we try and laugh about it now
  12. I would ring the court but there's a problem with that... they don't seem to have a clue what they are doing! The phone rings for 10 minutes.... After getting though to a 12yr old you ask a simple question and she keeps you on hold for ten minutes again and then answers "i've asked the girls and we think that we don't know maybe errrrrr yes thats right i'm sure we don't.. thanks, can we help you with anything else sir?" Anyway, I will ring back and closer to the time i might ring that man from barclays to see if he will play ball.
  13. Yes i didn't get that last bit either? So, do nothing and just wait until that court date then, barclays wont turn up- will they? and again, should I ring them and try and force them to settle? All my prperwork has been ready for ages now, it's been sitting near the window side so long now the paper has gone yellow
  14. Letter from the court: :o The court has set an allocation hearing for the 2nd Feburary 2006. It says that the court will either... stay the claim pending a test case involving the defendant. give directions for this case to be made a test case and if nessessary allocating the claim to the multi track for that perpose. It also says... not less than 14 days before the hearing the defendant must file with the court and serve upon the defendant details of any test cases, the decision of which will determine the issues in this claim or draft directions for this case to go ahead as a test case. the claimant can make any representations to the court not less than 5 days before the court date. Thats good right? What do i do now, should i ring Barclays and see if they will pay at last, make representations? If so what representations? What is an allocation hearing anyway? A bit confused now.
  15. I did try and chance my arm with antony lomeardi at Barclays to see if they would settle, well it worked for Welshman? :-| Didn't work for me . He was a nice guy and said as soon as I have a court date then give him a call back and then they might look to settle once all the changes have been comfirmed on my account. Just need the court to pull there fingers out now, why why why wont the courts do the right thing, they know that none have got that far so why why why don't they just issue court dates, that way it's off their books? i'm still so shocked at just how un-friendly this county court system is on the little guy. Still not happy.

  17. Good news: Well I got the stay lifted at last! Bad news: I wish I hadn’t has I have to wait even longer than before, the lady at the court said the case has been listed with all the other bank charge cases! What sort of date am I looking at I said, end of Feb 2007 she said. Gutted. Just when i’m on holiday. This is just getting stupid. Yes I am in a very bad mood today, just didn't expect that all this would be such a long process.
  18. I have posted another letter to the court with a list of all the other cases this year (bar a few) that have been settled out of court. I’m at work at the moment and the court is just round the corner so they will have two letters from me in the morning waiting for them. Again- anyone had a stay removed?
  19. As well as the above question- how do I get one of those nice little pictures by my name? I feel left out.
  20. Written a letter to the judge asking for the stay to be lifted using jonni2bads link, very helpful. I attached a list of cases (with case numbers from the litigation concluded forum) that have all been settled in full before they ever got to court. There are 474 at the last count, I couldn’t cut and past every last case number so I just made a list of the first 76 (this month and last) and explained that I can, if the court so wish, provide the claim numbers of the other 398. I hope this works because I don’t want to wait until next year to get my money back. Thinking about all this- it’s a joke…The county court system is supposed to be easy and user friendly- it’s not. Has anyone out there had a stay lifted?
