    • worthy to not forget Just to let you know this bunch Kensington have been fined £1.225m by the financial regulator for treating borrowers who were in arrears unfairly. Claim those charges back plus the interest and tell them not to add any more to the account.     • Hi All. I went to visit a family friend in Rochdale on a new housing estate opposite a old row of houses. The location is Royle Road, Postcode OL11 3PE. I was originally parked in parking bays outside the old houses, then moved the car, when I noticed my tyre was flat, so parked on what looked like double yellows to use his air pump to check and inflate the tyres before we left the house.   In the time i went inside to sort the pump and power supply i got a PCN.  The tyre then got changed (has a puncture) and we left. PCN Number:         RE######## Date:             04/05/2024 Time:             20:36 Observation:         20:34 to 20:36 Reported location:     Royle Park Road Reason:        Parked in a restricted street during prescribed hours (Code: 01) I believe this PCN is not correct and has grounds to appeal: 1. My friend who moved into the property around 6 months ago, swears that even though it has old double yellows marked, they are not current or council marked.   He said the property development company had said they had marked them for ease of access during development. 2. The road i was parked on was Royle Road.  The PCN was issued for Royle Park Road, which is about 400 yards up the road. 3. There are no sign posts or marking showing parking  restriction hours in the entire area (there maybe on Royle park Road). I have attached a map of the Location where i parked as a red dot. I have 2 questions: a.  Is there a way to check where double yellow lines are marked on some register to check if they are current? b. Can my grounds of appeal simply be, wrong location, wrong offence? Thanks in advance. Map_20240505.pdf
    • you made it very confusing, though i doubt any of it was ever read by the delivery franchise for DPD. your saving grace might well be you didn't select your own address (though if you are all the same postcode..??) and neither mentioned a safe space other than another neighbour. but with the actual delivery address on the parcel, it appears the driver had a choice of 3 addresses, all under the same post code with differing house numbers. so chose the label one but left it on your doorstep. play it carefully and along with the photo and the retailers requirement you should be ok.   dx

As a private residential site does the public have a right of access? This particular Act has so many caveats that even many Councils do not understand it and that includes me. Though I do understand it better than many council planning departments.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I got bad words this morning.....my hospital dermotology dept wrote to tell me that seeing that I missed an aptment on 1st of Nov they will NOT see me again....something really stinks with the GP's and the two hospitals here where i get seen 'yeah that was a joke'.......I have called PALS and they are on answermachines and also I called the hosp back and they just huffed and puffed....called my surgery and they told me no one was available to talk to me till late today I called the smaller hosp to ask WHY the letter was sent telling me I would NOT be seen at all seeing that I did call back the day after I missed the apptment and so I re-requested at my surgery as an URGENT case and then this letter came................who do I compain to now.......its partly due to the monster headaches I get now as to why I missed the bluddy aptmnt on nov 1st it's partly their fault this is all happening ......last contact was from an ignorant tw-tt with a posh voice trying to hush me up and saying I wont get seen till after xmas.....I WONT GET SEEN AT ALL from what this letter says

Came home today and our little daughter came and gave me a hug...she's not even two yet...ahhh:-)

 

fantastic mate.....I remember my eldest son when he was about 14 months old and we lived in another house that had a low window....I used to hate going to work due to he would watch me reverse my truck back and he'd be crying that I was going to work ....she'll be into her teens sooner than you think and giving you lip so make the REAL most of it ....wish I could turn back time....happy xmas and new year she'll appreciate this xmas more than last :-) as will you all in your house

thinking back that on this day 5 years ago there were 60 of us builders,painters,roofers.groundworkers etc hired a small local golf course for that day so that we could all play golf dressed up as santa. £50.00 per player plus a big xmas dinner plus the proceeds of the raffle all going to charity.....60 santas playing golf between the main line london to norwich line and the A12 to Ipswich to the other side about 300 yards away and there we were down in the huge dip all dressed as santas getting beeped by the trains that were to one side and the cars and lorrys on the A12 to the other all blowing their horns......it was freezing cold but on the upside we had an ex doorman on the golf buggy driving round with beers and spirits on the deck of the buggy and his elder brother was in our foursome so we had more than our fair share of the refreshments hohoho....funny a great day despite my worry about the stents in my heart every time I whacked a ball eeeeeeeeeek

the bin men woke me this morning and due to we dont have wheelie bins but plastic bags 'we are clever' we have black ones for household waste and clear ones for plastic and or paper....well a while back one of my front brick piers was dislodged at the top and due to all the rain then frost I decided not to get a mate round to rebuild it so I covered it with one of the clear bags and tied a small rope around it "remember " it's been like it for about 6 weeks and then today I was about to put my bag out ready for collection and just looked out the landing window to watch a dickbrain trying to take the pier away for recycling and I was about to shout out the landing window that the BIG BAG tied over the pier was just to keep the rain etc off it then the penny dropped and he realised ha ha ha it's true .....you could NOT make this up and to be honest I watched him for at least 30 seconds and thought he was just someone standing outside my house txting hohoho.....

getting a Christmas card and note from my late nephews wife and two little som's poor Vincent died in the summer and left a wife and 12 and 8 year old son's she appreciates my words in a letter that i wrote and gave to her at his funeral and part of the letter could be addressed to almost everyone in here and that section of letter is....we have mountains to climb in our lives and some have mountains made of shale that let us slip back down BUT we never slip back down to where we started the climb from.

She told me in the card that I will always be welcome at their home due to I was Vincents favourite uncle and her little lads liked me eventhough I didnt see much of them really.....I have that sort of face lol

 

RIP Vincent and his 24 year old younger brother who died in 07

I smiled at getting three really lovely beuquets of flowers for my wifes grave due to I went against the normal type I get her they being a dozen bright red and a dozen white roses and instead got her three lovely Christmassy beuquets type this year and even if I had no money at all I'd rather get her flowers than the turkey crown or anything for us three but as it is I managed to do it so I'm happy with that xx for Sue xx

I smiled again when I got out of Saisburys earlied when a bloke in the car park asked me "how animal was in there due to ques " so i told him it wanst so much how animal it was but there were plenty of muppets:lol:

How lovely. A few years ago I dropped my card wallet, which had a top up card with my mobile number in. Walking home and got a phone call. Man says I've found your card wallet and we've taken it home. You can pick it up tomorrow if you want. Got a taxi the next day and said something to the driver. The driver says he'll charge me to get there; but not to get back into town. :)

you're right mr b...in fact, I dare say that the majority are kind, decent people. it's just that the one's that aren't are so bloody loud they drown them out. Anyhoo...whoever they are, they've made my christmas. anything else is a bonus now. :)

I remember once handing in a wallet that had been left in a phone box (it was a long time ago)!

 

The person that had lost it, very kindly sent me a voucher for £5 but it could only be used at a store in Birmingham and the train fare was £5!

 

I also handed a purse in at a till in BHS, the lady that was served ahead of me had left it. I was Christmas so I guess she was a little stressed!

 

So LaughingGirl, there are still a few of us around, as burlyb says! :-)

You're right Dotty, good folk are out there. I've just been reminded by my OH that a few years ago, I walked a mile out of my way in the pouring rain to hand in a lost purse at the Police station (not enough ID in it to get hold of the lady myself), so I'm going to take this as a little bit of evidence that there might be such a thing as karma. :-)

 

Either way, all the buffet food for tomorrow is cooked (well, nearly!), all the pressies are wrapped, and I'm about to settle down with a little glass of something warming. All is right with the world as far as I'm concerned!

Just back from the annual Christmas Eve carols the village silver band play. Some fun with little ones jingling bells and bouncing around, as well as some emotional memories. Christmas has officially started for me now so must start wrapping presents. :-o

In that really frosty cold winter in 87 we were building some town houses in Dedham and one saturday I'd gone in to load out some blocks for the following week and I looked across the street to the little quaint post office a thought of how long it had stood there due to that high street has some really old houses in it....I noticed a rectangular tan packet on the path so I went over to check what it was and it turned out to be a wallet so I took a guess that it belonged to someone who was either in the post office or had lost it going in or out of it so took it into the P/O and handed it to a lady behind the screen and left.

About ten minutes later an old geezer came up the pavement looking left and right on the floor so i called out to ask if he had lost the wallet and he said yes and I asked him to discribe it so he was spot on with the description so I told him i'd handed it in at the P/O so he went in and then a couple of minutes later he came out and looked across to me and said...............................nothing f/a nitto...............Dedham is a very posh place and due to I was just a lowley brickie I suppose he thought..............serf so as he walked down the path on the other side of the road I began thinking some nasty thoughts about this old bastid in his camel hair overcoat and wing commander type mustache.
