      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

lol mothercare and the little clothes used to get me when my late wife wa expecting our first baby and even now if I see the little tiny shoes or trainers etc they make me smile and think back to those lovely days past...loved it too when we used to holiday in the states and buy the voight light trainers the ones with the little lights in the edge of the soles that used to flash and light up when the boys walked along....ahhhhhhhhhhhh....I'll come out of it in a mo back to realitty

Different mum, different dad, different sides of the family and different sides of the country, but 12 hours between them. Both got lovely healthy little boys.

good luck to them both Caro I cant imagine how chuffed you feel and shell when we used to go on holiday and get those shoes we always bought a pair each for the boys about two sizes up just in case we didnt get back at spme fututre time and I recon the last time we had bought the last pairs would have been 1997 and years laterabout 2003 when I was clearing out a cupboard I found them and they still worked so they went into a clothing bag and I imagined a little african boy or girl having them next and being the envy of all thier little friends lol Voight Lite thats what they were called ....now my boys are 6'3'' and 6'1'' and if I check back with them about back then I get grunts so I'm glad to have MY memories to share here and with myself...let me know if i'm waffling lol

my daughter in laws new babies pram arrived in a big box and she was opening it up when it was put together she was wheeling it round the lounge squeeling we were all laughing at her, just waiting for the baby to arrive soon, but the look on her face when the box was opened made me smile

The huge grin on my OH's face when he thought he was going to miss the Merseyside derby, then realised I'd ordred ESPN for him!!! So he sat and watched his team win on his 50" Christmas present lol! Now he's singing "we're gonna win the cup" :lol:

I am currently going through old mail from when I left the UK - it went to a mail box.

 

I had charges from my bank after things had badly broke down between us, and I lumped everything into a credit card that was debt they created and told them I had no intention of paying it.

 

I just found a card hand delivered to my mail box requesting when I will be home for their next "home visit"!!!! They sent a collector to do a home visit on a mail box! :-)))))))))

 

OK - it's Saturday, and a little Sambuca is helping the evening along - but the thought of a couple of big lads leaning forward and threateningly stating "we know you're in there" is making me smile.

Oh I know, but don't beat yourself up over - it's always happened! My OH picked 4th, Cappa Bleu, we did a fiver each way! But when I've sat and thought about it, if we'd done a forecast we'd have got them all! I never usually bet on horses, I'll pick them out for a laugh - and they usually come in more often than not, maybe I should start having a little flutter lmao! My Granddad, Uncle and my Dad used to race dogs, and were also avid race horse lovers, I think I take after them lol!

:lol: I had to grin when I saw these posts ,,, they are so funny ,,, :lol: As normal, I smiled when I went to mums for her lovely sunday lunch, the lads down the pub always try and tempt me to stay for another one but I wont miss my mums sunday roast!

dont blame you malb, i love my sunday roast one of my sons whos moved out comes round for his roast every week with his partner she loves my roast dinner even though she can cook a good roast herself as i taught her lol but she still loves my potatoes the best lol
