    • Thanks for your prompt reply. I have some questions, please: When you say nothing will happen, my 80 year-old mother is worried about potential DCA doorsteppers if/when the debts are sold on - she is a very sweet, quite vulnerable lady and she is worried she may be bullied and harrassed.  If they do come knocking, what should she say?  I told her to say she knows nothing about any of it and they have no right to come knocking on her door and to warn them police will be informed if they come back.  Problem is, I don't think she would be strong enough and can easily be bullied into saying more than she intended once the door has been answered. Next questions: 1)  Should I inform all my lenders that I have moved abroad before defaulting (to avoid the quirky English law loophole thingy that could end up in a CCJ or worse once a DCA gets hold of it)?  2)  Can/should I provide an alternative UK correspondence address to my lenders instead of my mother's home address e.g. my virtual office address for my business - would the lenders accept this as I live abroad now and don't live at my mother's address?  Can I just write and tell them, without any further ado and not get into any further questions about it and cease further correspondence with them and default?  And would this stop DCAs coming to my mother's house as it would not be my current residential address on the lenders files when passed to the DCA?  Do they doorstep previous addresses? 3)  If I don't provide a UK correspondence address will I be at risk of not being aware of any Letters of Claim etc and legal proceedings notices etc not reaching me (there's no reliable postal system in the developing country I've moved to).  Worried this would mean I could end up being taken to court without being aware of it and could end up in a worse situation. 2) What exactly will go on my credit file once I've defaulted, assuming no legal action is taken against me?    4) Should I contact any of my lenders and inform them I have zero assets.  TSB & Sainsburys already have I&E info from me which shows my income  @ £1200/mth is below the combined total of my debt repayments @ £1300/mth and that my income only just covers essential costs of living @ £1200/mth.  Could it be useful to be on my file that I have no assets, so that the DCA clearly see this when the debt is passed to them? Thanks again for any advice.

    • Dear lookinforinfo, I'm sorry if I seem stupid, but what exactly am I telling them? -what code/ law / standard have they broken that I will use as an argument in letter? I don't understand the premise of your argument.  I would appreciate it if you could explain it to me clearly and in simple terms so that I understand.  Thank you

    • Agreed, let them default. Keep everything in writing, if they ring to discuss the accounts over the phone, simply say 'everything in writing please', and hang up. They'll soon get the message. Get all of your paperwork in order too, if you haven't got any, or are missing relevant documents, then you can SAR the original creditor, which is free and they have 30 days to supply the info. Keep a diary of events too. sit back and relax, YOU'RE in control, not them.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I can't be bothered to read the thread again, which after all, has evolved, but, can I ask - have you been victim to noise pollution?

 

You don't seem to understand what Gyz is saying, and I know I'm bound to agree. Call it bias if you want.

 

I said something straight after your post this morning, but decided to delete it as it wasn't my thread...BUT you did take the use of the word 'creature' pathetically IMO. Funny thing is I use that word all the time, since we are all creatures, but more specifically that word was used correctly IMO, and I do not agree with any remarks (well meant or otherwise) that he should not have said it. Simply put, that was not aimed at the child. Though a unhappy baby does cause stress to more than the terrible parent (do we really need any more clues as to how shoddy this set of 'parents' are?) I don't.

 

I feel the 'creature' comment was correct and since the parents are obviously useless (yes, I said that out loud) it should be them that are to be held to blame. I think they are the problem obviously - what do you think... reorete?

 

Argue all you want, but people - good people, DO NOT do this to others and nor should they to their children.

Would Gyzmo say that to a child (or the parents of child) in the street, no, of course not.

 

Noise does funny things to people (and that is no negative). The people that make the noise should be dealt with by our laws (sorry, need a quick laugh) and be dealt with.

 

That's never going to happen is it? The people that run HA's etc just do their 'job' etc...like Bank justification...the honest person (who deserves peace) get's crapped on!

 

Being short of funds in this first world is better than 3rd, but tragic all the same. The people with money will try and shaft you....and mostly suceed...and they want it all! I'm digressing.

 

Get a grip....the child is not a 'creature' but the birther of the special child is obviously a right loser.

Kicking in the 'bias' and subjective again, I believe Gyzmo's neighbours are the **** of the earth - I well believe it. If he, or anybody feels reason to complain to SS then sobeit. Worse is the complaint would not be upheld, and whilst I see your point, I feel you are dead wrong. An innocent parent would be rightfully well offended, but this trash would just scream rubbish, IMV.

 

But then, the people I surround myself with would never play loud music and *stuff* around a child. Because that would be associating with ****, and I'm free to admit my feelings there.

Phew, you've clicked on, almost. Loud noise around a child is fine I suppose(!), but not in the terrible way you state it! Do you mean a child should learn to be loud (that is NOT sarcastic and I've seen that parent attitude realised)

 

Stop defending the indefensible, for gawds sake.

 

You'll learn.

 

What makes loud music bad around a child is based wholly on that situation, and sod all about the people who have to live with that decision.

I absolutely agree with you. It is an intolerable situation. I just can't understand these HAs.

I clicked on the link on my email and hadn't realized there had been so many other posts.

 

Fact: it is not good for babies to be exposed to very loud (deafening) music. It can impair their hearing (fact).

 

Fact: it is not good for babies to be exposed to cigarette smoke.

 

Fact: it is not good for babies to be inhaling marijuana smoke.

 

I agree with you Thailand. these people appear to be absolute **** - either that or they are mentally impaired, or drug-addled, and therefore cannot be responsible for their actions. Whatever way you look at it the baby should not be living there.

I believe that slander or defamation has to contain a remark that is untrue.

 

And just how am I being antisocial? If I come up to you and start blasting music at you, and you complain, are you then being antisocial?

 

I'm not a busybody, I have no choice in what I hear from these scumbags - they're shouting it all in the streets. It's not like I'm putting a glass to the wall and listening in - I don't need to.

 

As for being nuts, yeah I'm getting there thanks to the neighbours and everything else.

I agree with Thailand and Gyzmo. I am pleased for all those who don't seem to understand that they have never had to experience being in a position like Gyzmo, and I hope they never do experience it. It is horrible, it's anti social and above all it's wrong!! People like that should not be able to pollute other people's lives, be that their neighbours or their own children. I think one thing that I find very sad about my neighbours, who sound quite similar to Gyzmo's in some ways (noise, lack of respect, drugs, broken windows etc), is that her many children will grow up with her example of how to be a human being. It's this that I find most upsetting (apart from the fact that they continue to pollute my life, Obviously).

Unfortunately, Gyzmo, society has changed for the worse. When I was growing up people would not have dreamed of playing their music so loudly that it disturbed the neighbours. You played it a volume which meant you could hear it but not which disturbed the whole street. It is staggering that your HA isn't taking this matter more seriously.

 

I'm not surprised you're going crazy.

i live next door to a familly that has 5 kids and i love to hear them giggling and playing because it makes me smile :) i dont mind music if there havin a party etc infact i get on so well with my neighbours who are african by the way that they bring me hot food over lol it pays well to get along with neighbours i say

I am not being rude, believe me. (I have had what I have taken as a warning on here - and it has been heeded, to my benefit actually and noting to do with this thread)

 

I suggest that you mention your different cultures 'getting on' in a different thread..... you just aren't getting how wrong you are. I'm sure it is well-meant, but it has no relevance here.
