    • a CCJ does not 'expire' thus does not need any application to a court to 'extend it'. if a CCJ has not been enforced within 6yrs, then it is very unlikely any court would grant such should the claimant return to court, of which the defendant would be advised -( unless they have moved and not informed the court & the claimant such) .
    • I contacted them when it happened. The caretaker came over, looked at it, and walked off with the tree chunks of mortar. Next morning, they had a roofer come over and enter our garden to inspect it. Friday they were supposed to speak with a scaffolding company. I had to bring up liability and potentially calling the council to report 'an unsafe structure' before they even got moving. They know all about the wedding, the preparations, our patio contractors etc. but their attitude doesn't instill me with confidence. My fear is it will end up being a legal matter which is why I posted here to hopefully receive some advice. As far as I can see, the roof is in a state of disrepair, even if it's just the mortar breaking lose due to the size and weight of the chunks - and even from ground level it's visibly clear that multiple pieces have fallen over time (though never this size so we haven't been able to identify the issue till now - we thought it was rubble left in the garden by the previous owner). Currently, we can't use 25% of our garden due to the risk of more falling mortar which is more than just an inconvenience, we can't proceed with our contractors, and at worst, it will run up in several thousand of extra expenses for us, if we have to find a wedding venue. Even if they do have it fixed in time, and we have to settle for renting a marquee and floor for the marquee and furniture and whatnot it will be additional costs only due to the neighbour's roof.
    • It will be years before Banks would sell to a debt buyer.  Sometimes Banks will use external debt collectors to try to collect, but generally Banks don't take Court action.  So you could be looking at 3 to 6 years, before any dca owning debt looks to take any Court action. And it is not definite that this would happen. So no need to feel pressured at this stage. In the event you found yourself unemployed, you have time to engage with Banks to advise of your situation and ask for time to deal with the situation, find new employment. As long as you inform the Banks they will offer assistance they can. E.g offer payment holiday or accept reduced payment for period. What you should not do, is not contact the Banks and simply default on payments.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

Aktiv Kapital are chasing a debt I know nothing about, I sent them a CCA request three weeks ago from this site including £1 postal order and got a standard letter back asking me to call them so they can sort the matter out quickly for me (yeah right)

I now have a second letter again asking me to call them to supply further information to get the matter sorted, which of course I won't do.

Would anybody have a letter template I could please use to try and get rid of them for good.

Any help most appreciated.

Send this to their Complaints Department at the address you have:

ere is the prove it letter. Use liberally!

Dear Sir/Madam

Account no:

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

I/we look forward to your reply.

Yours faithfully

Good luck on what you are doing. I CCA'd what I call DROSS KRAPITAL way back in January, and there hasn't been so much as morsel of proof from them just a letter saying they were going to send original docs soon - they are now time expired so don't loose any sleep over these Norwegian half-wits - have yourself a stress free weekend - all those call centre wallahs will be out clubbing it so don't wear yourself down - they won't be.

I am one of these "half-wits" but I had AK scurrying away after 2 letters (thankfully, I never had to speak to you because it may have dumbed me down):rolleyes:

Aktiv Kapital - an English company that can't spell in English - wonderful :D

funny how "half wits" seem to be capable of making legalised bullies like inaktiv krap chase their tails like a brain damaged dog

speaks volumes as to their own intellectual capacity

stick to counting the spots on your barely post-pubescent faces before they explode against the windscreeens of your vauxhall novas and citroen saxos on the way home after yet another particularly futile day at work chasing people who even if they had only 2 brain cells, would still rate at double the IQ of the likes of you

drop by anytime

we love a good chuckle

Oh dear, have I touched a raw nerve with Aktivkapitalallover, I certainly wasn't having a go at people on here - merely the debt collection agency who happen to be part of a Nowegian holding company - and I can assure you I am not a half-wit and neither are any of the other good folks on here. - GET A LIFE.

it's the people at AKTIV that are the halfwits, especially the one called krayten. I offered them a full & final settlement , they accepted and then tried to screw me over by not including full & final settlement in the letter and then threatening to hike up how much i owed if i didn't pay up.

if it wasn't for that phonecall, where i was trying to act in good faith and yet they still tried to screw me over i would never have put "AKTIV KAPITAL" into google, found this site, found out what **** they are and the fact i will probably get away without paying them a penny again.

well done, krayten! you have saved me £1,000's and cost your own company the same amout. I wonder how many people end up finding this site because the AKTIV halfwits have gotten to greedy! i was already paying you lot in installements, was about to pay the debt off and yet you tried to squeeze a bit more, now you get nothing!! ha-ha!!:p

thanks krayten, i owe you a drink :D

Aktivkapitallover,

Now that you have formed a tentative relationship with some of the caggers "half wits". Why do you not attempt to appease the situation as in your trolling exercise:p and become a gamekeeper, as opposed to the seedy side of life you find yourself on at the moment.

You could become the caggers star whistle-blower instead of a low life parasitic poacher, scratching a living by sending ill conceived threatogrammes etc.to anyone and everyone who has not yet teamed up with the "half wits" of Consumer Action Group:D:D

Perhaps the next time you "troll by" you might actually think before you place your tiny insignificant trolls snout into the CAGGERS affairs. Foxtrot Oscar (IMHO) Aktivkapitallover:p
