    • sorry but that letter needs to be much much better. you need to express that it was a stilly youthful mistake trying to be the big man and jumping the turnstile to look big infront of your peers. TfL prosecutors are on the email address on their first letter. get the court form sent back to the court , (but copy it first) stating you plead guilty and wish to attend to address the judge in person face to face to show your genuine remorse for your stupid youthful exuberance.

I hope that I could teach the lovely students again, which may not be allowed with a criminal record. I would please ask that you would please provide me a single opportunity to settle all outstanding sums owed outside of court without the need for legal proceedings which would have a determinantal impact on my teaching career.  I sincerely apologise again for my crime.     • Utter Rubbish!! lowell dont write and beg for deals once they start court. as for your attitude, we'll thats nothing new for you.😎 you wont be quizzed, it's not like TV, simply refer to your defence/WS when answering anything the judge may ever ask. well it involves chickens. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm a bit dubious about the efficiency of these newspaper message boards- I've contributed to other articles a lot less contentious and things haven't appeared so it may be just a server prob they have rather than censorship.

 

That said posts supporting the articles do seem to get on there quickly before any cut off point arrives and in this case the contributors 'supporting' the debt collection process are obviously DCA employee drones. A tip-off to First Credit from the venerable Times, anyone? lol

 

As to whether anyone reads these post-article comments and takes them seriously anymore, I dunno. I stopped years ago. Nothing lost trying to plug the CAG message on them tho...

I remember a whille ago in one of the papers that Dispatches on Channel 4 were asking for people who had been affected by a DCA to e mail them, now this was a while ago, and I know a few people had suggested contacting Watchdog.

 

It was before I joined CAG

These ridiculous conferences are just debt-porn for the DCAs, aren't they?

 

Lots of grubby men in cheap suits masturbating furiously at the torrent of bullsh1t flowing from their speakers' lips. I bet Nathoo's feeble attempt at humour gave them a little extra frisson...

 

The reality, of course, is that all this grandiose posturing is part of the turd-polishing way the debt industry seeks to delude itself and the outside world that their fantasy world (the one where they're all compliant) is reality. I think some of them have convinced themselves - vide the delusion that they act in a 'lawful, justified and necessary' way, rather than a parasitic industry that exists to exploit the misfortunes of others. Who do these cretins think they are - Crusaders trying to stem the hordes of evil debtors?

 

'Sumptuous Gala Dinner' - a festival of ready-made bow ties and hideous dresses worn by people who look as if they'd be more comfortable at a 'restaurant' where they ask if you'd like fries with that, judging by the images of previous events. No doubt the finest cook-and-chill food and vats of Lambrini were served. Some of the attendees look as if they found cutlery a novelty. Still, let's look on the bright side - the money spent on these absurd celebrations didn't get sent to the DCAs offshore investors.

That's what I like to see. The more of us who try to get these parasites exposed for what they really are, the better.

 

In the current climate where DCA's and struggling peeps are what the media are looking for, as we are now suddenly fashionable, then we have to strike, and give them a good kick while the media wants stories from people getting the crap from DCA's, banks, and the government.

 

We have the ammo and lots of stories and experiences to give them.

 

If we don't get a DCA shut down in 2009, then we're not really trying. Once we get the first victory, then it will inspire a lot more to join in. Then at last, ordinary people can make a big difference. Not just with DCA's but in a lot of unjust situations in life.

Wouldn't that sort of action get the site dangerously close to needing a consumer credit licence?

 

I wouldn't have thought so, we don't provide credit. We're a club who have an interest in consumer rights.

Dunno about censorship but I think cost might be the issue here (anyone know what scc stands for ?).

perhaps an approach where an ad was placed in papers with local circulation might be more suitable when it comes to cost?

 

I know I would have no problem placing an ad at my own expense in my local rag to raise the profile of CAG with people who wouldn't otherwise be aware,and who are really under the cosh of DCA's and don't know where to turn......

I find it amazing that 1st Credit fobbed off the Sunday Times with an almost identical feeble excuse to that which they used on Panorama.

It's one word, four letters:

DEBT. Stigma and preconceptions.

Economies have it, countries have it, banks have it, companies have it - and that's acceptable?

Yet old Mrs Jones down the road gets a bill she doesn't owe from a 'debt collector' for £50... now that's an entirely different thing.:mad::mad:

Another round of the same word game is that is credit when you take it out, it only becomes debt when you need to pay it back!

Maybe the solution (cheaper and less likely to invite licensing problems) would be letters to local papers, even try and get some editorial coverage.

 

Local papers are less likely to be dependent on financial advertisers (unless you count the property pages) and more likely to be community minded.

 

Not sure how this would best be done in practice but I throw it out for consideration.

Licences are needed for other things aside from providing credit; debt collection, debt counselling, credit information services, being a credit reference agency, debt administration (?). There is a leaflet on the oft website about it all.
