Do I have to return item to seller before refund? (Ebay) Feedback indicates he will lie about recieving it back!

You will be able to get a refund of the price of the item plus the original postage cost, although as the postage was included in the item cost, all you will get is the price you paid. Same thing thing really.

 

If you want to make a small claim for the return cost, that would be something for you to consider. ;)

 

Or you could just make a small claim for the amount it cost you. plus court issue fee and interest.

Just btw, my earlier post does not apply to auctions or auction style sites. Whether it applies to "buy it now" items is a different matter.

 

For DSRs to apply it must be a BIN (so fixed price) and a business seller. They don't apply for private sellers or auctions.

Why is a SNAD being started against a seller who has already said he'll refund?:confused:

Capquest - No cca yet - OC sent what they think is a CCA - account on hold - no contact since

 

Lewis - Lost their tongue after cca request:roll: -

Now in default of my CCA request - still no contact since:D

 

Fredrickson - No cca yet - Now in default of my request - now stopped contact with me:rolleyes: **UPDATE** April - Sent back £1 p/o and gave up!!!!!!!!!!

Oh I'm sorry, but what is going on here?

 

The OP has clearly stated they have bought an item which does not conform to the contract, a breach of SoGA. We therefore have DSRs kicking in requiring full refund including postage.

 

What is all this fuss about opening disputes with ebay or who paypal whoever? Just send a letter or email to the seller telling him to refund within 30 days including postage, and to either collect the item, send a pre-paid envelope or provide details of how it is to be sent back, the cost of which is to be met by the seller. If there is an issue of ebay or paypal being the agent, then the same to them.

 

And can we please stop with these acronyms, initialism or whatever unless an explanation is first provided?

I only asked why the SNAD had been opened when the seller had already offered a refund?

 

People forget that as an ebay business seller a negative and dispute mean alot to future business. They push the sellers listings down and often cause a suspension. Why a buyer in this case has been advised to issue the seller with a negative I will never know. The seller has offered a refund, yet the buyer insists that a refund is issued before they send the goods back. Crazy.

I don't understand all this negative business stuff.

 

I bought an item off ebay, it was nowhere near the "mint" condition described, but was so cheap that I couldnt be bothered sending it back (as it still worked) so I rated according to what I got - I think it was a "neutral" comment.

 

then I got some sarky feedback on my (instant) payment asking why I had "trashed" his ratings when he would have given me a refund.

 

Well, to be honest, if the guy had not deliberately misdescribed something, I would not have given this feedback. Afetr a flurry of emails, it came down to this:

 

He thought it acceptable, having a "perfect" rating, to attract customers to buy his misdescribed stuff (he told me he had a number of complaints but gave refunds), and then to go through the hassle of contacting, sending the thing back and claiming the refund. Well, I didn't find that acceptable and told him so.

 

No. If you provide a 5 star service, then you get a 5 star rating. If you provide a crap service, then the rating will reflect that. I find any other system to be indefensible.

It's not crazy, it's the regulations for businesses. If you look back over the whole thread you'll see that in this case the buyer was concerned that he may not get a timely refund even if he returned the goods at his own expense - which he doesn't have to do under DSRs. He was therefore advised that the safest course would be to claim his money back through Paypal - which he's perfectly entitled to do.

 

As the buyer was sent an item of lesser spec than that which he ordered I doubt he'd consider it a positive experience.
