Hi there,

My wife has a hp agreement with brighthouse for a sharp 46" tv, She purchased the tv in jun 2007 without the useless service cover;), and by the Christmas every other time you turned it on half the screen was black:-( .

So we arranged them to pick it up and replace which i assumed was as simple as taking the faulty one and giving us a new one as the TV was less than a year old, they finally took this tv months later 3rd April:eek:.

Next week it is 6 months since we have seen this tv, we have kept up to date with all the payments, after we recieved the usually bullying for money cause at one time we refused to pay until it was sorted out of frustration. They are now saying it couldnt be repaired and they disposed of it ...And my wall brackets that were still on it :-x:mad: £50 down the drain, Also they said they cant get us the same tv even though it was still within its maufacturers warranty when we gave it to them, but we can have a philips which is as far as i can tell nowhere near as good as the one we paid for, and they also say that to get it delivered my wife must sign a new agreement ?????

Is this right ...what about the original agreement????

what about the 12 month manufacturers warranty that was on the item still??

Surely they cant just change the item as they see fit and just write agreements out willy nilly???

any advice would be much appreciated as we dont know where we stand ... do we have to accept what they say and accept a lesser tv :(

ok quick update, have spoke to them in person today like hitting your head up a brickwall, we have refused the tv they offer as it is nowhere near as good as our sharp, so basically they have took our sharp tv decided they cant fix it and disposed of it even though it was only 6 months old and still within manufacturers warranty seems stupid if u ask me, they are also adamant that my wife signs a new agreement before we can get another tv delivered which will basically be one they decide is as good when it clearly isnt. soooo frustrating :mad: any help would be much appreciated ???????

 

think i'm gunna put this loan tv they gave us through the front of there shop......might make me feel better:-D:grin:

Hi

This strikes me as pretty simple! :)

Assuming everything you say is correct (and the instalments on your hire purchase agreement are up to date), BrightHouse are in breach of their agreement with you. They are also acting contrary to the SUPPLY OF GOODS (IMPLIED TERMS) ACT 1973 under which your hire purchase agreement is subject to.

It's good that you didn't take their optional service cover, because that can cloud issues such as this one.

Here's the bottom line:

If BrightHouse have taken back the goods - and are not prepared to return them - then THEY are in breach, and you should take them to the small claims court with an intention of receiving back ALL payments you have made to date.

It really is that simple. Stop messing around with these clowns, and SORT IT OUT!!! ;)
