At six years from the last payment or acknowledgement of the debt, it becomes statute barred, (it is not written off and you will remain liable, but they can no longer enforce it unless it is already subject to a county court judgement).

 

Can I make a guess, you have had a letter out of the blue from Red saying you owe them?

Ah damn it. The only acknowledgement I've had to send are deferment forms every 6 months. If I don't return them they try to take the money out of my account.

 

So you have been in communication with the Student Loan firm every six months within the last six years - ie you admit that the loan exists because you ask to defer any payments probably because of low salary.

 

I do not think you can state this loan is unenforceable.

 

Student Loans are a different beast to the usual bank loans, as they are administered by HMRC.
