    • Hi All, I've just had the inevitable N24 and other paperwork arrive. I've read other examples on here and I think I understand the steps to follow. I have until the 28th May to return the N180 Small Claims Direction Questionnaire, I also have an N244 Application notice copy. I read an update on a case you kindly put a link in for me to read. Turns out they lost in court and are now struggling. I really don't want to get to that stage and am thinking mediation may be the way forward? Thoughts please? Pretty sure I've missed the 7 days to have the order set aside.  For reference, this is what I received: Dated 8th May Before Deputy District Judge Baker sitting at the Civil National Business Centre, 4th Floor St Katharine's House, 21-27 St Katharine's Street, Northampton, NN1 2LH   The Court will deal with the application to lift the stay without hearing under CPR 23.8(c)   It is ordered that:   The Application to lift the stay and for direction questionnaires to be issued is granted.   Because this Order has been made without a hearing, the parties have the right to apply to have the Order set aside, varied or stayed. A party making such an application must send or deliver the application to the court (together with any appropriate fee) to arrive within seven days of service of this Order. If the application is one which requires a hearing, and   a) the party making the application is the Defendant; and b) the Defendant is an individual,   then upon the filing of the application the claim will be transferred to the Defendant's home court. In all other cases requiring a hearing the claim will be transferred to the preferred court.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Today's text tells us that Tills has been in touch with the court and they have not had an application for an eviction order, which I'd say is good. Gives Tilly more time to sort out a sale of the house herself.

I have just got off the phone to Tills, she is fine, but it looks like she will be off line until the 4th June, thanks to her broadband supplier. :mad:

 

She is going to try to use some one else's com over the next few days.

 

She has been in touch with her estate agent, which she has recently changed, (she now has 2).

They know the situation are are trying various things to help, including a company called Steps, who rent to buy. They work in conjunction with the estate agents. They will be getting back to her soon.

 

For those who don't know, Tills has been having other problems at home, which have not been helping, as of yesterday she separated from her husband. She is more mad at the fact he took the printer and scanner!

 

If she cant get on line with any updates, she will ask some of us to post for her.

Having met you though, I know you're a tough old bird :D Bo *waits for slap*

A little bit of info for you - probably not relevant now but good info for Caggers. I spoke to a friend who is a social worker last night. She advised that as your daughter is over 16, then technically she is classed as an adult. Had she been under 16, then they would have been able to help with housing etc.

 

When this is all over, I think you should have a celebration party. I will provide the funnels :eek:

The person at the estate agent who i should have seen today was off sick, so it will

monday now before i find out about the company that deals with the sell to rent,

as stone would say more sitting on thumbs :(

Hi Tilly, I have read quite a few of these T&Cs as I have been trying to find a reputable company to help some friends of mine out. One thing that strikes me about the one you have there is that they set up a 'buy back' agreement at the outset. And yet another set I read said that the company concerned did not offer that facility as it was against some rule or another. I have found it really hard to work out which companies were any good and as they are so new it is hard to find anyone who will recommend one. I guess if you get them out for a chat you don't have to commit yourself.....

My friends had one of the companies out and they would only give them I think 75% of the house value, which in their circumstances just wouldn't do. I would be wary - I just hope you find a proper buyer.

after a quick look at the letter Tills, at the bottom it suggests you ask for their "repossesion guide" might be worth asking them for that. cant do any harm at least
