Some of these coud be "virtual offices" i.e. they don't really exist.

Have just been digging around Cayman Islands and offshore stuff. The islands have been in trouble due to allowing drug dealing and money laundering on their teritory.

It seems it is cvirtually impossible to sue any of these Cayman businesses and the reason HFO will have set up their to accept receivables (debts) is there is no tax to be paid at all..ever.

So OCs sell to HFO Cayman and don't pay any VAT to the UK. What happens next? I doubt they are properly assigned to UK they just use the Lavender Hill mob and Turnbul eejits to collect. This is the big question is their action lawful? Do they pay taxes in what they receive or is it simply any debt collected in the UK go straight back to the Cayman Islands and no tax again.

P.S. Just a thought but if they can't be sued in the CI then no-one in the CI can sue here. I know they need an address for service of papers so they're covered from that point of view.

No HFO Services there. I notice that it states they have no right to canvass off trade premises therefore if they pay a visit to anyone or threaten to do so they are in breach of their licence. My understanding is that they are already breaking the law by not advising the office of fair trading of the new directorship and business address.

 

Had to chuckle about the debt counselling.......what a joke. Will let the OFT know their licence needs updating

Have no credit info on HFO Capital

I think it actually means they can't cold call on businesses or visit businesses without an appointment, but they should still be able to make personal home visits legally - unless you put a nice brass plaque next to your front door with Registered Office of ABC Limited on it :wink::grin:

Unincorporated associations

 

Unincorporated association status is usually chosen when a number of individuals agree or "contract" to come together for a common purpose - which may be of a social nature.

How unincorporated associations operate

 

Unincorporated associations are run informally. They are relatively straightforward and cost nothing to set up. They make their own rules for running the organisation and set these down in a democratic constitution. A management committee is elected to run the organisation on behalf of the members.

Unincorporated associations do not need to register with or be regulated by either Companies Registry or the Financial Services Authority. They enjoy greater freedom of operation than a company. For example, they don't have to submit annual returns.

If an unincorporated association has charitable objects (or aims), it can apply to the Charity Commission for charitable status. Upon approval it will have to comply with the Commission 's regulations. Unincorporated associations may also have trading or business objectives or carry on commercial activities.

Personal risk

 

Unincorporated associations have no separate legal identity. This means that their members will have to sign loans and contracts as individuals and carry the risk of personal liability.

This form is unlikely to offer a long-term solution if you intend to sign contracts or expand the enterprise. You should consider incorporation if you intend to:

  • take on employees
  • raise finance, apply for grants or open bank accounts
  • issue shares
  • enter into large contracts
  • take on a lease or buy freehold property

This should help you to gain access to a wide range of financing sources that will not put your personal assets at risk.

so their you have it they are personally liable,so if they have debts already in there name they can now be sued under their own name and then be struck off from holding a directorship or having any associations with either ......i think sawer has a debt enforcement order against the company HFO not sure on that until we see SAWER come back to this thread

i posted this in january 10/2008...so every one should make there complaints head on about the whole organisation HFO and turnbull and rachet

perhaps then we may at last get a judgement against them... just not enough people complaining about hfo as this letter i got today explains

Thank you for your email received on 17 December 2007, regarding the problems you have been experiencing with the above trader.

 

We are always interested to receive complaints such as yours as they are a vital source of information in helping us to investigate the behaviour of traders that hold consumer credit licences. The trader you have complained about does hold a consumer credit licence.

 

If a business wishes to be involved in activities relating to consumer credit or hire, including debt collection, they must have a consumer credit licence. The Office of Fair Trading (OFT) has a duty to monitor the fitness of all traders that hold a consumer credit licence. In considering fitness, we take into account whether a business has engaged in unfair business practices. This includes any evidence that traders have not complied with any guidance issued by the OFT. The OFT has, for example, issued guidance to consumer credit licence holders engaged in the debt collection industry. The guidance sets out minimum standards that we expect of debt collection traders, consistent with fitness to hold a consumer credit licence. The guidance is intended to ensure that debt collectors treat debtors fairly. Non-compliance with this guidance will call into question the fitness of licence holders and applicants.

 

We investigate all complaints received about consumer credit licence holders and, where we have the necessary evidence, we do take appropriate action. In our initial investigation of all complaints we consider how many complaints we have received overall and how strong the evidence is to support any action. It is unlikely that a licence would be revoked on the strength of one complaint. Where we have strong evidence that unfair business practices have occurred, we may take steps to revoke or refuse the licence of the business in question. However, if we are to do this we need to take account of factors such as the number of complaints received how recent they are and how well evidenced. In cases where evidence is less strong we may issue a warning letter to the business putting it on notice that its behaviour, if repeated, will call their fitness to hold a licence into question. Any action we do take has to be proportionate. If an approach from the OFT makes a trader change its behaviour and treat consumers fairly in future, this is preferable to putting a trader out of business.

 

If we do take any licensing action against this trader it is likely that we would need to disclose your identity to this trader along with details of your complaint. I should therefore be grateful if you would provide me with written authorisation to disclose these details to the trader. I have enclosed a disclosure consent form for you to sign and return to me.

 

We have noted the details of your complaint, to consider alongside any other complaints we have received with a view to any licensing action we may decide to take. We may therefore contact you again if we require further information. Meanwhile, given that the sanction of licence refusal or revocation is such a significant one there are constraints built into the process for taking such action. For example, because of restrictions in Part 9 of the Enterprise Act 2002 relating to disclosure of information, we cannot disclose specific details about any action we may take, nor comment on any adverse information we hold on individual licence holders.

Having just checked with the OFT, the failure to notify the OFT of the change in directors to HFO company no 05120067 renders their CCL invalid and they are trading illegally.

 

If the company report is still valid (graydons 05/08/08) the OFT have had no notification of a change in officers.

 

The OFT consider this to be a serious breach to the regulations and as such they stated that it is illegal for a company to trade under its credit license (0555914) whilst this continues.

 

Hmm me thinks a world of hurt is on the way.
