    • If you have not kept the original PCN you can always send an SAR to Excel and they have to send you all the info they have on you within a month. failure to do so can lead to you being able to sue them for their failure.......................................nice irony.
    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................
    • Hi,   I am not sure if I posted this already here but I don't think I did. I attach a judgement that raises very interesting points IMO. Essentially EVRi did their usual non attendance that we normally see, however the judge (for the first time I've seen in these threads) dismissed the notice and awarded me judgement by default because their notice misses the "confirmation of compliance" paragraph. in and out in 3 minutes (aside from the chat at the end with the judge about his problems with evri) Redacted - evri CPR loss.pdf

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just a couple of quickies:

 

1. where can I get a machine that I can attach to my landline telephone to record conversations? and for that matter can it be done on a mobile?

 

2. I have to stop posting here - will not go into why - but I will continue to use the site as a resource - although not being able to ask questions is going to be a bit limiting.

 

3. Please do not take offence if I only respond to site helpers and moderators who pm me now, I have really appreciated all the help and goodwishes.

I am assuming that you read what I found in our local Sunday newspaper this morning - explains a thing or two as to the way we have been treated everytime that I and my daughter have tried to report what was clearly criminal, cant win can we, murders they investigate, their website seems to reckon the most important crimes that they have specialist teams for are race crimes and homophobic crimes, I think they put some priority to crimes against children, but if your disabled, or it is vaguely "domestic" forget about it. And in this town they do try and catch drug pushers, a big problem round where I live. What has happened to my daughter is clearly criminal, even if she did trust and gave her cards for safekeeping, she took advantage of a person who was ill and at the time very likely to die. Its a criminal offence to take advantage and fleece people if they are old, so why is it not so if a person happens to young and very sick?

 

Sorry I am mad and still tired and off to my bed very soon, telephones all switched off, went and bought myself a pay as you go SIM card this afternoon and only two people have the number, mind you they had to unblock my mobile, didnt know that mobiles were blocked! So no disturbed night with telephone calls. They will soon get fed up with phoning no one. Been there, done that, got the t-shirt, so many number changes I have lost count, this no longer scares me, just disturbs my sleep, which I need.

I would seriously complain and l would not stop at the cheif constable i would also got to there superior end if l then dont get a satisfactory response l would go as far as l can that would include Jackie Smith at the home office. As well as the IPCC.

OK back to Virgin/MBNA They have had the SAR on the 9th January 2008, (same date as Barcalycard), they have also had the letter saying we will only deal with them in writing, they have told us that they are investingating our complaint one letter saying we will have a full response by the 4th February and the other saying within 5 working days, neither of those are up yet, so a text message has been received from them, saying ring us urgently on 01244675894 (I looked the number up on the web it purports to belong to a driving school in Chester) so rang it to give them a rollicking and it was MBNA at the other end, I hung up. Does text messaging constitute in writing? and why if they are investigating are they texting and wanting to discuss over the telpehone - we also received an interesintg pink and purple one from Dublin telling us they would substatnially reduce the owings on the card if we rang them straight away. At the moment all we want is the statements, so why are they unwilling to let us have them?, They start February 2007 and up to September 2007 will be more then sufficient, what is holding this up? Could it be that they can see that all the transactions on there could not have been made by my daughter? but they are unwilling for us to find out!

 

Not that any of this in the long run matters as my daughter will be petitioning for bankruptcy, waiting for the pack from the National Debtline and then we will be getting all the forms and filling them in, my daughters health is detiorating at the moment including her mental health - she is slipping in and out of being cognitally with us at an alarming rate, I suspect we should start thinking about a bit of paper that says that I can take care of her affairs (the name of which I will remember as soon as I post this)

If they haven't complied with S.A.R - (Subject Access Request) then you can report them to the Information Commissioners Office. If you go on to the Information Commissioners Office website there is a form you can complete and email. I did this with Morgan Stanley and MS actually referred to the Information Commissioners Office in their correspondence.

 

 

unfortuantely 40 days isnt up yet - but we will go there if they dont.

You need a lasting power of attorney, not an enduring power of attorney. unfortunatly, they can be quite expensive - although you can fill the form in yourself, it is complicated.

 

There are two types; your daughter needs to give you both types...

Yesterday I received a call from TS re my Barclaycard Complaint, got complimented on my very good letters (thank you CAG), got told that they have passed on all the pack to who ever they deal with at Barclaycard and have wrapped them over knuckles, becasue they should have stopped chasing the minute they got the letter saying we were disputing the account. I have also been told that even though we have unfortunately got to go down the Bankruptcy route to make as much noise as we can as these companies cause many people so much misery.

 

A question re bankruptcy, if we cannot get a grant from one of the uitlity companies for the Bankruptcy fee, what do we do then? Any answers? If you have nothing Bankruptcy is expensive in the short run, is it permissible to take the money from one of the accounts that will be named in the petition? I will go back to the National Debtline with this question, but thought that I would ask here. Bankruptcy sounds fine in theory but there is this upfront cost, the court costs are not a problem as they will be diseregarded on low income/benefit grounds ( more form filling). I suspect some people would not be able to take this route out because of the cost.

 

 

Oh and at what point does one tell the card companies that are chasing that you are going down that route?

I have been reading a thread on here by harvest and have had an idea regarding the bankruptcy route from that thread.

 

You main debt is credit cards. Just write to the companys and inform them that you are currently gathering together the paperwork to make your self bankrupt and as a result of this you may not get full settlement of the debt that your daughter owes.

 

The credit cards may then start to play ball and accept your offer on your terms. It worked for someone on that thread. I will post a link for you in a bit.

 

It sounds like bribery and yes in a way it is but it is also called taking control of your finances.

unfortunatley there is also a bank loan - which up until now has always been paid on time, the only reason my daughter has this problem is because of the fraud committed on her two credit cards (for which the police are unwilling to even investigate but we will be making a lot of noise over this as well), so as far as every one is concerned the best route is bankruptcy, and as my daughter lives on benefits and rents her home. However I may have an investigate of that route (writing to the credit card companies) while we are awaiting all the papers from the court and filling in the application form to British Gas. My daughters debts consist of:

 

1. Barclay card about 2,800

2. Virgin about 4,600

3. Bank Loan 6,020

4. her ex housemates Council Tax bill of 625

5. Egg card 120 (but this is being paid off and will be gone in 5 months)

 

There are no utility debts nor rent arrears, my daughter has always been in charge of making sure that they are paid.

 

She gets

DLA higher rate for both components

Long term Incapacity

Housing Benefit both for Council Tax and all the rent bar £50 per month

Have just applied for Income Support and believe she should get in the region of about 60 pw.

 

She no longer has any savings, it has been cleaned out there had been in the region of 600. Too long ago to make it worth investigating as all the CTV pictures will have been overwritten from then (August 2007).

 

The bank so far is unaware of wht we are considering as we have been concentrating on getting some justice for my daughter and getting her benefits sorted out. Seems a lifetime ago, but its only 2 weeks since her partner scarped back to NI, we have done a lot in that time:(
