    • If that was the reason then that is good news. The whole reason that being able to charge £100 for breaching private car park rules is because the law Lords decided in a celebrated case that the rogues had a legitimate interest in keeping their car park spaces available for all motorists . {parking Eye v Beavis]. However when the business is closed then there is no legitimate interest in keeping spaces free so to charge £100 is a penalty. As such any Court would automatically throw out the case when the penalty charge is accepted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, around 2 weeks ago I sent S.A.R. letters to Capital One and Vanquis with the view to claiming back my charges.

 

Capital One responded within a week, enclosing statements for the past 6 years. Vanquis first sent a letter saying they would be in touch soon. Then on Saturday, I received a letter from Vanquis saying:

 

"Please be advised that your account is a "No Hidden Charges" product and therefore no default charges would be applied to your account.

 

I also sent a cheque with my original request, of which there has been no mention.

 

Is this right do you think. They only mention default charges, where the S.A.R. also asks about overlimit fees etc.

 

In any case, surely as I was requesting copy statements/information, they should have sent them regardless - it is up to me to find out if there were any charges or not.

 

What are your opinions please?

Yes you sent them a legal request and they have to supply the information. They have 40 days after receipt of your request to supply this information. If they don't you can seek a court order which will force them to comply.

It will be very interesting to see what they turn up.

I am still collating info myself following my own DPA to them last year.

Rather than statements they are more in the form of screenshots....I could not make any sense of them but knew there was something wrong.

What I did do was reconcile my payments to them by using bank statements that showed them as paid.

When I added the payments I had made against the figures they showed on their screenshots there was a difference of 800 quid.

I wrote back asking for fuller info and got exactly the same things.

As any Vanquis customer will know,trying to get hold of anyone who is not an operator is almost impossible.

I called the ICO and was informed they had no listing for their data controller.

so back to square 1.

Now my account with them had been closed for about 3 years but within weeks of me threatening them with court action for non compliance of the dpa they sold my account on to a dca.

I have scoured for info on 5 other sites but f

drawn a blank as there seems nothing is known since no one has managed to crack these screenshots.

A thread of my own inviting other Vanquis claimants to give their progress also brought nothing.

It is my view that these are possibly the only ones from the bunch who have escaped attention by nature of their houdini methods.

Maybe time to make a concerted push to get a few Vanquis claimants together for sharing a plan of action.

Vanquis like City card and associates were primarily operating accounts for those with problems getting cards from the banks.Typically you were first advanced 100 quid and as time went on it was moved up to 250 and then 500.

The interest rates were high and late payment charges as well as overlimit charges were in force.

But no signs of them on the screenshots.

How they can say no hidden charges is beyond me....

They are hidden so well but with some work we can hopefully find them.

Martin, this lot are part of Provident the doorstep loan sharks, so I wonder if they are the data controller for the whole lot?

 

The interest rates are good though @ 39.9% :eek:

I know Sandra.I have just dug out my stickie I could not find for a long time....looks like there is some movements.Like you say prob the same controller but Provident have been in this game a long time...in fact I think since the 60s they know the tricks.So its a case of looking at all these guys threads and seeing whats going on.

Caz I have re-titled this thread for you and moved to the right place so hopefully other Vanquis claimants will help.

When you are ready start another for your Cap1 claim.

They are in the same group but have a dedicated forum.
