    • when did they (who) inform you there was a 'police case' and when was this attained? i will guess the debt is now SB'd as it's UAE 15yrs. have you informed the bsnk ever by email/letter of your correct and current address? you can always ignore anyone else accept the bank,  Block and bounce back all emails. Block any text messages  Ignore any letters unless it's: - a Statutory Demand - a Letter Of Claim - a Court Claimform via Northants bulk.  
    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You can claim all charges relating to unauthorised o/d, bounced cheques, returned DD's, notified fees ect. That link that Jo has given you is up to date and will tell you what you can claim for.

Just shout if you need more help!:) .

I sent of my SAR last week and recieved separate letters today for each account.

They give me a list of charges split into two groups.

 

1. Overdraft related charges and adjustments.

 

This lists various fees from £20 to £100 for overdraft fees.

In total the charges are £465.

 

2. Other related charges and adjustments.

 

This lists charges for recalled S/O - D/D total £430

 

My question is can I claim for the overdraft related charges or do I need a further breakdown of charges obtainable from my statements.

Hi Tom. If your claim is for a business account then yes you will need a breakdown of the "total charges" figures. If it is for just a personal account then no you do not need a breakdown.

Looked at the "charges description thread" but am still unclear if overdraft fees are reclaimable. These are spread over a period of 18 months and vary from £20 to £100.

Can you advise me further.

If you were charged for going over your overdraft limit eg"Total charges" then these are claimable. HSBC charged £25 per day for being over a limit. If you are really stuck, just post up the description of the charges you have and we can say yes or no as to whether they are claimable (but as this is a personal account, they are all pretty much claimable)

Thanks for that. Have not had statements sent to me only a list of charges.

I will stick all charges on my claim.

 

Just make sure that you have not got any arrangement fees for things like when you rang them and increased your overdarft facility. This charge also used to be £25. The ones that you can claim for usually appear once a month around the same time every month (except for the bouncy items of which they were charged for on the actual day)

Think I've dropped a clanger. Sent my prelim letter with schedule of charges. Got a standard reply.

Just doing a LBA and can't find my schedule of charges. Done another spreadsheet but the interest on penalties is different to my original claim by £4.59.

Please tell me I'm just being thick and it's an easy fix.

Hi tom. If the interest that is on your schedule is the 8% interest, then this is not claimable just yet. You go for that interest when you file your claim at court.

 

If this is the 8% interest, I would hide the interest column on your spreadsheet so you can then just print off the schedule of charges.

guessing its the interest building up to todays date rather than 14 days ago. The CAG spreadsheet is live to todays date so even if you found the last one you did it would be more than you asked for 14 days ago :).

 

If you want to check click on your computers date in the far bottom right corner of the screen, alter it to the date of your prelim letter and then open the spreadsheet, is that the same figure you asked for?

 

(alter your computers date back after :D)

To change the date on our computer.

 

Right click on the time at the bottom right of your screen. Then click on adjust date/time. Adjust the date to the date of your prelim letter and then press ok. Don't have the spreadsheet of your charges open when you do this though. Once you have changed the date of your computer, open the spreadsheet and it should agree to your prelim letter.
