  1. I got a final written warning. Thought I would lose my job. The post were reported as racist but after investigation this was not the case and was never intended to be. Still found to offend one of my work colleagues hence the warning. I've took it on the chin and learnt from it.

  3. I shared two Facebook posts on my timeline and these caused offence to one of my Facebook friends at work. He reported me and now I face a disciplinary. When I was informed of this I immediately removed the posts and offered to apologise to aggrieved person which he was willing to accept management refused this although in past disputes between work colleagues management have actively sort this form of action. I've never had a good relationship with my manager over the five and a half years I've worked there, even though my work record is excellent and feel some sort of victimisation. We have no union so am in this alone and wondering on a course of defence. Can anyone advise me please?
  4. Thanks. I'm more annoyed than worried. My first absence was for 9 days due to my elderly mum being very ill and no one to look after her only me. When I rang work they said " don't worry about work. Your mum comes first. If you need anything just ask". I went back even though my sick note was for a month. Second absence was a 24 hour sickness and diarrhoea episode. When I rang work to go back in I was told I have to be clear for 48 hrs because I work in the food industry so I was off for 3 days. Final sickness I was off for 8 days with a recent flu virus. I spoke to my doctor and her advice was to stay at home and avoid contact with people. 18 people were off at the same time with the same illness. I went back to work not being 100% fit because I don't like taking time off. We have people at work at the minute who are genuinely ill with this flu bug but are frightened of being off in case they are disciplined. This then spreads the bug around. Only time will tell.
  5. Thanks for the prompt reply. Unfortunately we don't have a union. My sickness is not down to work and I was off with 3 different ailments. I'll see what happens later this week.
  6. I work for a large national company and am facing a disciplinary due to absence. The company policy is if you are off 3 times or more or off for 3% or more of your total work days in a 12 month rolling period it triggers a disciplinary. I have been off on three separate occasions and a total of 20 days which equates to 9.85% of my total days. On each occasion I have gone through the correct reporting procedure and obtained the relevant doctors certificates where necessary. I have been informed this morning that I will be invited to attend a disciplinary hearing and it could result in a formal warning. I've no idea if this is allowed so I'm hoping someone more knowledgeable than me can give me advice. Thanks in advance for any replies.
  7. Great news thanks to you. Appeal allowed on the grounds of GPEOL. VCS claimed it costs them £166 to issue a parking charge. POPLA were having non of it. Thanks to everyone for your advice.

  10. Thanks for the replies so far. I appealed to VCS Ltd stating I am the owner of the vehicle but wasn't driving at the time and explained that the car had broken down. Has expected they have rejected this appeal and state "a helpline telephone number is situated at the bottom of some of our signs. By making a telephone call on the number provided you can inform us of any problems while within the site,and most probably prevent a Parking Charge Notice being issued to yourself." The driver never saw any signs,and if they had it would have taken longer to make the call than move the car !!! I've been issued a POPLA verification code and now wonder what my next course of action should be please ? Do I just fill in the online POPLA form ? Which box should I tick ? I was not improperly parked. The parking charge (ticket) exceeded the appropriate amount. The vehicle was stolen. I am not liable for the parking charge. Thanks once again in advance.
  11. We were near Robin Hood Airport when our car started misfiring. Turned off the main road onto the airport approach roads,to avoid the traffic, and pulled up on double yellow lines. Normal practice to clear the misfire was to turn off the engine, leave for a few seconds and then start up normally without problems. While parked on double yellows a white van pulled up behind us. Six days later I received a Parking Charge Notice from VCS Ltd. This was the first we knew about it. It shows pictures of the car and registration number with a time lapse of 13 seconds. I'm the registered keeper but wasn't driving at the time. I've read through the forum and the general advice I've seen is just to ignore all letters from this company. Is this the best course of action or should I write and tell them the car had broken down ? Thanks in advance.
  12. Thanks for the prompt replies. Tried to reason in branch today put not a chance. We had a refund 3 years ago so they won't do that. Will write to head office but there's no way I'm paying the £60. When I asked girl in branch why they pay the amount then bounce it she said they give a temporary overdraft then take it away. Easy way to make money if you ask me.
  13. I have a Nationwide Flex account which I hardly use but it is set up to pay my PayPal payments. Last week I bought 4 items off ebay totalling £2.97 but didn't realise I had a 0 balance at Nationwide. The payments bounced and the wonderful people at Nationwide have informed me I will be charged £60. I've printed form off to close account but I am wondering what will happen about the £60 charges? Been into my local branch and they were has much use has a chocolate teapot. Any advice please ? Thanks in advance.

  16. We have a static caravan holiday home and have had a bad water leak from the washer. Covered for accidental damage and the insurers have sent a loss adjuster round to take a look. I've got two independent repair assessments and they both agree that the van is worth £12000 but the cost of repairs will exceed this. Also the fitted furniture i.e. kitchen,wardrobes and corner units have got water ingress and they are no longer available due to the age of the van,it's a 2001. Both repairers have said the van is a total loss but they haven't given an itemised breakdown of repairs because they can't get the bits. I've searched through insurance documents and can't find anywhere that it says New for Old but this was specified when taking the policy out. It does state "Static Holiday Home Sum Insured: £ Unlimited" Also in the Summary of Cover it states "New for old- we will decide whether to repair or replace the static holiday home. We will replace the static holiday home,with a new one,of the same make and model or nearest equivalent.The most we will pay is the sum insured shown in your schedule or the limit shown in your policy." A new van of the same model is now £56000.Loss adjuster was very helpful but he seems to think the insurers will repair the van even though it's been classed as a write off.I'm waiting to hear from him. Approximately 2 weeks. Sorry for the drawn out post but back to my question. How do I stand with this insurance and does anyone have an idea of the outcome?   17. The company I worked for as a driver has just been bought out by a large national company. Just a quick question regarding pay and benefits. Drivers at my new employers are on approx. £5000 a year more than me and they get 4 days holiday extra and full pay for 6 months if they are off sick. Does the company have to bring us in to line with the others or will we carry on, on the terms of the old company? Thanks for any replies in advance.

Not heard anything about this debt for the last 12 months then this morning a bunch of muppets called Zinc Recoveries write to me telling me they "have been instructed in our capacity as professional credit managers,to contact you in relation to the above long outstanding account. After investigation we have established your residency at this property. Zinc Recoveries fully understands that in the current economic environment that you may be experiencing financial difficulties, and as such we would like to offer the following possible solutions to this situation. 1) Agreement to a financial repayment program to match your current situation. 2) A considerably reduced settlement of the account based on a one of payment. Please contact us to speak to one of our fully trained negotiators. This is a genuine opportunity to deal with this situation once and for all,however please be assured that further action may be considered should you choose not to accept this offer." Do I need to send off another CCA request to these plonkers or will the original one stand? Thanks in advance.
  19. Thanks guys for the input.Had an informal chat with my manager this morning and I stated employment law to him and I think it's an unlawful deduction. He is going to look into it and seemed to be coming down on my side. It's just his bosses we have to convince.

  21. Had a cold call today from a company called Motorway Direct offering me a warranty through their Car Protect scheme for the Sorento. Bearing in mind the old girl has done 121,000 miles and coming up to 8 years old I told the young lady I was interested. She gave me the usual sales spiel and the price given was £19.46 per month and it seemed to cover most things. This was for a 24 month warranty with no mileage restriction and multiple claims up to the value of the car. It covers parts and labour. I have to pay the first £75 and car has to be repaired in their designated workshop. It can be cancelled at any time without notice. I've gone for it but I have a 14 day cooling off period when I've read the small print. Has anyone ever had any dealings with this company?
  22. Thanks for the prompt reply. The issue has only been raised last week due to a driver having an accident. The annoying thing is this is the third identical accident with three different drivers and nothing is being done to sort the problem.
  23. I've now got a copy of the letter dated 7th March 2011. This letter was sent through the post to all drivers and was not signed for. I'll only copy the relevant paragraph regarding loss of bonus because most of it is a repeat of what I've already posted. "Loss of bonus. The value of any repairs made to a vehicle or trailer due to damage caused and attributed to a company driver will be deducted from the bonus pool until the costs are completely recovered. This will mean a loss of bonus for all qualifying drivers." It then just repeats list of reasons to lose bonus already posted. I'd be grateful if you can take a look and advise me on best course of action to take.
  24. Hi guys. Thanks for all the replies so far. Just got in from work.Been busy earning bonus for the company. I'll copy what is said in "Terms and conditions of employment" regarding bonus. "You agree that the Company may deduct from your wages payment and/or from any wages due to you on termination of this employment any sums that from time to time you owe to the company.Such sums would include but not be limited to any sums in respect of any overpayment,expenses float,loans,advances or compensation for loss of company equipment,damage to company property as a result of mistreatment,negligence or misconduct during the course of your employment. After the successful completion of the six month probationary period,the payment of any bonuses will be made weekly in arrears and in accordance with the bonus structure. No bonus payments will be made during periods of holiday,sickness or absence". This was dated 20th October 2010. I then received another letter on 8th November copied as follows. Customer service drivers bonus incentive scheme "May I firstly take this opportunity to apologise for the delay in announcing the initial terms of the bonus incentive scheme. The bonus incentive scheme is designed to encourage and reward productivity achieved by all customer service drivers and the criteria is outlined below. Only tonnage moved by our fleet and driven by our employees will count towards the scheme. There will be a pool of money each week and only those that have worked full shift quota will qualify,if you are on holiday or of ill for part or all of the week then no bonus will be payable.The number of employees that have qualified for the incentive in the week will receive an equal share of the group bonus,the value of which is dependant upon the tonnage moved in the week. After an initial period the bonus incentive scheme will be reviewed to incorporate an enhanced payment based upon the average payload achieved,and the revised figures will reflect the additional tonnage. The company reserve the right to amend or terminate the bonus incentive scheme with a guarantee of one months notice to all employees. Bonus will not be earned by any individual that is not fully compliant in the areas outlined below. Non completion of the full weeks shift Lost or defaced paperwork Any non compliance that incurs a standard performance deduction for the company from the client.These are mainly health and safety related. Any VOSA prohibition or Digi card non compliance. Any justified complaint investigated and proven. Any accident or damage incurred where the individual is at fault." The letter received regarding damage payments coming out of the bonus pot,which is probably the most important,was filed in the bin with disgust when I received it. I will be able to post the details tomorrow. Sorry for that and once again thanks for all the help so far.
