Hi all, I have a car on finance, which two days ago caught fire and is a write off, can I terminate my contract with the finance company under 'frustration of contract' as the finance company can now no longer supply the use of the vehicle to me under our contract? Just wondered what people's thoughts are on this. Many thanks for all and any replys Moonlandings
  2. Ever since I moved to Northampton at the end of August I have had nothing but problems with NPower. I am the account holder and since mid-late October have called them about every 2 weeks, spending on average over 45 to 60 minutes on the phone with them. During these phone calls, I have either given them meter readings or discussed when they are coming to check our gas meter (as the landlord just had a non-card meter put in and they never collected the details when it was switched on). On numerous occasions, reps have told me there has been no record or notes of my previous phone calls or given meter readings. The times an engineer was booked to come in, no one had showed up. Then one day a rep told me they never book appointments on the Saturdays (which were the days originally given to me), hence why they never showed up. Just recently I felt we had the meter sorted out and was sent a reasonable gas bill for September to March of £133 based on the reading I gave NPower. We paid the electric near Christmas for £122, so this seemed about right. However, when I called in to pay the gas bill I was told by the company not to pay it as there was an outstanding complaint on the gas meter. Until that was resolved they told me not to pay anything until a new reading was given. Well the complaint was resolved miraculously on April 16 (in a letter stating they had tried to call me, which they didn't as my mobile log would have picked it up), and then, I noticed I received an estimated bill of over £500. When I called to enquire on April 22, the rep asked me to give her the meter readings, which I did and told me a bill would come in a couple days. Well I waited and no bill. I called this morning (two weeks post call again) and the rep told me that my previous conversation was not in the system, nor was the meter readings I gave (which is a common thing I have heard from NPower in our biweekly conversations - I even have my call logs to prove). I went into our basement read the meters and told them to the lady. When I asked her how much our bill would be, she told me it would be over £967-!!!! I told her that was absolutely ridiculous. She clearly stated to me is that a unit (yes she used that word) of gas is charge at 4.53p and we only used 1024 units (according to the meter) but when I told her based on that, there is no way the bill could be so high, she challenged me stating it was based on my current reading. Well I can do math and it cannot add to over £600, unless I am missing something?! £967- for both gas and electricity between September to beginning May is too steep!!! This obviously does not include the £122 I paid at Christmas. We only have a fridge, gas/stove, washer (which we use on ECO), a gas boiler (which only heats the house btw 530am-830am and 4pm-11pm Nov to April), and, some laptops we charge when we need. We don’t have any televisions or large electrical otherwise. We are also barely home throughout the day as we are students. Plus I have wasted over 8 hours of my precious life (and mobile money) on the phone with this company, have been late for work or school 3x because of them, trying to deal with their 'crap' since October, that is not including the over 15 hours I have wasted waiting for an engineer to show when they booked days engineers aren't available. I are returning to Canada soon, and, I have raised a formal complaint about this issue with the company but I have a feeling it will not be dealt with for another 6 months (like the last complaint). I have also written a report from the Telegraph who has written several reports on this company. Please I need advice on how to deal with this as they have been nothing but a nightmare to me!!!
  3. Quick History, Wife has had DLA Mobility high rate for over 10 years (Osteoporosis, IBS, + other ailments) 2 Years ago we needed to replace our own car so used DLAMob to get one via Motability. I have been on JSA for a long time and had been on WPS and was on PWPS. My personal advisor (or whatever they are called now) kept on going on and on about me applying for DLA Care practically everytime we meet. I kept saying we had looked into it but did not want to run the risk of losing the DLAMob we already had. My advisor seemed like she turned "hard" when I told her we would not be putting in for it and I found she was looking for any excuse to make it difficult for me to meet the JSA requirements concerning looking for work etc..... In the end we decided that we should try for DLACare (Now PIP) because of the extra pressure that was being put on me vis the advisor. So on 18th December 2013 we contacted DWP to ask for the PIP papers. We were not aware or told at the time that just by asking for the papers we were in fact making a claim for PIP. Anyway 31st December is when the PIP papers showed up and as it was New Year and the Doctors were closed we did not look at the papers until about 5th January 2014. Having looked at the questions it was our opinion that we would not get the entitlement for the PIP Care so we choose to leave it. End of January 2014 we get a letter saying that my wife's Life DLAMob was now cancelled because we had not proceeded with the PIP claim. Of course I get on the phone to DWP and ask them why and it turns out it's because simply by asking for the papers and not returning them within a set period (one month) it is automatically taken that you no longer need the DLAMob that we had. Anyway I said that that's unfair because we were not aware we would lose the DLAMob just by asking for the PIP papers and after some further discussions we were told to get the papers in quick and that the DLAMob would be reinstated. So by February 3rd they had the PIP papers and we were in contact with Motability over the situation as well and they said it was all good. Fast forward 3.5 months and we receive a letter form Motability saying they were coming to take the car we had due to the DLAMob not being paid since February 18th. We of course contacted the Mota people and ask why they have not been receiving payments as they had been reinstated and they said they had no idea or that they had had any information from DWP(DLA) concerning this. So getting on phone to DLA(PIP)(DWP) concerning this they told us it had not been reinstated and that they had no information concerning my calls to them on the matter. Now I log all my calls concerning matters like this and was able to tell them the exact time, day and person I spoke to which made them a little uneasy and they suggested I contacted the PIP dept directly even gave me the phone number. So onto PIP and it was much the same run around as with the other DWP dept's and basically I got nowhere other than they would put in a "urgent" request for a reassessment of the situation. (their idea regarding "URGENT" means anything up to 5 weeks apparently). They also arranged for a call back which should have taken 5 working days but ended up taking 8 and that probably only happened after I contacted them again after 7 working days had past. Net result was they would look into it. (still looking I think) Anyway we had a bit of family bad luck in that my wife's mother died about 2 weeks ago and the motability people were kind enough to change the deadline for the car going back so we could use for another 17 days to get through the Funeral etc. It goes back on Monday 14th July. This Friday (11th July 2014) I decided to chase up what was happening with the PIP claim. We had had a Home assessment done by Capita several weeks ago. Called DWP(PIP) and they told us that they had had the electronic part of the information concerning the assessment from Capita but not the hard-copy information. I call Capita and they told me that the Electronic part had been sent on the 4th June and the hard-copy would have been sent within 10 working days of the elec forms being sent. We worked it out that the DWP(PIP) would have had both parts by 25th June at the absolute latest. So back to DWP(PIP) and they confirmed they had had the electronic form part but had not received the hard-copy part (implying it was lost in the post). They suggested that I should get Captia to reissue the hard-copy again. So back to Capita and they said they would send the DWP(PIP) the hard-copy again but also told me that they cannot see how the DWP(PIP) had not received the hard-copy as they send all their important information via courier and in batches so could not see how the DWP(PIP) had not received the forms. Back to DWP(PIP) and I told them that Capita said that they cannot see how they had NOT got the hard-copy forms to which the DWP(PIP) person said that they are now going to find out just what has happened. Net result of this "lost in the post" is that the claim is now going to take around 5 more weeks and not be completed as it should of by now. So I am now totally frustrated by the fact that it looks like the DWP(PIP) are in fact giving out either false information or are in fact telling blatant lies just to get claimants so totally fed up with the situation that they will in fact give-up. We have already come to turns with the fact the car is going back to motability and will in fact give them praise for having been very professional and thoughtful throughout this whole situation. Also praise to Capita as it does appear they are getting to grips with their part in this PIP claim procedure. As for the DWP(PIP) ____________________ Just thought I would post this so that people could have some idea as to what the DWP(PIP) could be doing to make things worse for claimants.   4. My OH had a unsecured loan with A & L in 1995 in which she settled early but recalls that in order for her loan being successful ppi was added. It wasn't a large loan but nevertheless she paid monthly ppi premiums for about 3 years. The problem being is that she cannot locate the original agreement details but does have a couple of letters in relation to early settlement and rebate figures with loan account number and old address details. So she sent off the usual SAR letter to Santander and has now received the attached response. Has anyone received one of the same or is it the usual Santander reply letter ? Cheers
  5. I recently changed my business contract from 02 to Vodafone and I regret doing so. 1. Vodafone helped themselves to £198.88 via direct debit without any explanation as to why so I rang them up to ask why. To my astonishment Vodafone did not know what the £198.88 was for so I asked my bank to reclaim the £198.88. 2. .On 4th July 2013 I returned a handset to Vodafone under their 7 day returns policy. The handset was ordered online and I paid £199.00 up front viia debit card and Vodafone received the handset on 5th July 2013. As to-date I am still waiting for Vodafone to refund my debit card. 3. I have received my August bill and it's over £400 which is ridiculous as it should be no more than £130 for the 4 handsets. After looking at my August bill Vodafone are charging me for 6 handsets, when i only have 4 . On the bill there is also an equipment charge of £179.00 for a handset which I returned in June and have actually got a credit not for. I telephone Vodafone to try and sort it and was told "we haven't seen an account in such a mess and we need to send your account for re-calculation. Vodafone rang last Sunday to inform me that the re-calculation was still in process and that they would call me back on Tuesday 6th August (Still Waiting for the Phone-call) )

    Frustration

    Hi all Since September last year I have been suffering with a bad back, this has cost me a few weeks off work, at present I am on amended duties which hopefully is working quite well, have only had to have 2 days off since, Originally my GP sent me for an x ray at our local hospital which showed a damaged disc, I had Physio for a few weeks but it got worse especially the sciatic nerve. In March this year it was progressively worse so my GP sent me for an MRI scan which showed up a prolapsed disc plus some degeneration. She made an appointment for me to see a consultant, however the waiting list was 3 months. when I finally got my appointment, it took me longer to get out of the car after driving 50 miles than i actually spent in the consultants, he said the mri scan was next to useless as it was 3 months old! He told me to cut down on the Gabepentine over a period of 6 weeks to see if my leg still hurts, I feel absolutely devastated as I expect my expectations were probably too high, but after 10 months of pain I do not know what to do I am on at present Tramadol, diazepam, naproxen, gabepentine and omeprazole, plus Zapain as and when required. any advice please?
