  1. Hi there i am new here but have a possibly unique situation. i lost my job and fell into arrears with main mortgage and second mortgage. the first mortgage company have been great and most helpful i am back on track with a suspended money order and paying away. The second loan company are horrible and it took some strongly worded letters to stop them phoning me on the hour every hour. they have not chased me for money for about a year?? i have offered them a token payment recently and heard nothing back, i find it strange that a company who threatened to repossess over a year ago have done nothing since. i also have a case with the FCfs for PPI which should also reduce this debt. i am not trying to avoid the debt, but do not want to lose the house. why have they not enforced? it makes me think they do not have a charge on the house any advice appreciated

Hi all, Due to a change in job and pay date I found myself in the position where I couldn't afford to make any repayments with the above companies so I decided to break the endless cycle of payback, loan, payback loan. All 3 were due payments on the 15th Feb so all 3 were emailed on the 12th with my offering of payment plans that I could reasonably afford with out getting myself in any more financial trouble. After the initial rows about not wanting to discuss anything on the phone and only wanting to talk via e-mail this is where I stand with each one. Wonga - have been pretty useless so far, always seem to get standard responses telling me to log into my account and fill out the Financial Assesment form. This form doesn't exist on my account so have spent the last week in an endless cycle of telling them there is no form, them telling me to fill out a form etc etc. Had a letter and another email from them today telling me I need to pay so I emailed again stating my wish to set up a payment plan and that i do not want any more generic emails telling me to fill in a form that doesn't exist. My question is how long do I continue in this loop of getting nowhere before I try a different approach, and what should my next step be if I keep getting nowhere? QuickQuid - As I have only defaulted on the first initial payment they are refusing to set up a payment plan for the total amount until I default on that next month. I've told them im not happy about this but again I seem to be stuck in a loop of them telling me they cant do it and me insisting that they do set up a payment plan on the whole amount. Also they are insisting on bank details which I am refusing. Again, what should my next step be? Mr Lender - These guys have been the most fun so far. I missed a rollover payment of £90 on the 15th Feb, they are insisting on a "token" payment of £90 before they setup a payment plan. I've pointed out the stupidity of this to 4 different people now (if i had £90 surely I would have just paid the rollover???) today I get an email saying that they will accept £45 token payment. Again I tell them i have no money until payday and that the practise of asking for a payment to set up a payment plan seems highly dubious. I offered a £1 token payment in jest which was politely ignored, this led to an email form them saying "they have offered me a payment plan on numerous occasions which I have refused to accept, if I am not willing to make a payment then interest and charges will continue to acrue on my account until I do make a token payment and set up a payment plan. If there is no payment to my account after 8 weeks they will pass the debt on" I politely pointed out that they have not offered me any payment plan whatsoever and it is them who seem to be refusing my offer of making payment. I also mentioned that I find there methods highly dubious and that if they do not allow me to set up a plan I will be making a formal complaint to the OFT, Trading Standards and the Ombudsman. During the complaint process I will not make any payments to them until the issue is resolved. Again my question is.. What next? I've cancelled my card and informed my bank not to allow any payments by these companies, i've also emailed all 3 explicitly refusing them permission to take any money from my account. These debts used to keep me awake at night but I am actually quite enjoying the email exchanges now knowing that I am trying to do something about it and these idiots are the ones making it difficult for themselves to get there money back. Any advice would be much appreciated, as much as I am enjoying it I would like to get these plans set up so I can clear the debt off
  4. Hi All, I had recently taken out various loans with Mr Lender and paid them off all in good faith, now I have issues paying one back and they are being obtuse. I have changed my debit card and cancelled all direct debits with them, as such they cant take payments. I am speaking to them about a payment arrangement but they are unwilling to write off any interest etc, even though I could have already paid 50% of the loan off in rollovers. Any advice? J
  5. Hi, I'm having issues with Mr Lender who seem determined to cost me my job! I'm working hard and a lot of hours to get enough cash to pay these idiots, but they are continuously contacting my office and speaking with my boss directly. They have sent emails direct to him too, identifying themselves and the debt I owe them, to the penny. I think the final straw is with them accusing my boss of lying when I was out of the office and demanding to know what meeting I was in (confidential). My boss has told them it is a company phone and they must cease contacting it, but they haven't. And now if they don't stop I could be let go! I found a template letter I am sending today (below), but I'm not sure how effective it would be against these people? Dear Sirs I am writing in relation to the quantity and frequency of telephone callsicon that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary) I now require all further correspondence from your company to be made in writing only. You are reminded of the following under The Administration of Justice Act 1970. Section 40 of the act provides that a person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under contract, he or she: (a) harasses the other with demands for payment which by their frequency, or the manner or occasion of their making, or any accompanying threat or publicity are calculated to subject him or his family or household to alarm, distress or humiliation; (b) falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it; © falsely represent themselves to be authorized in some official capacity to claim or enforce payment; (d) utters a document falsely represented by him to have some official character or purporting to have some official character which he knows it has not. I am of the view that your harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997. If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Further to this all calls from your doorstep collectorsicon must also cease unconditionally and with immediate effect. I note that there is only an implied license under English Common Law for certain people to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Take note, I revoke license under English Common Law for you, or any of your representatives to visit me at my property and if you do so without my permission, you will then be liable to damages for a tort of trespass. You would also be conspiring in a trespass if you sent someone to visit me nevertheless. Any trespassers you attempt to send therefore will be dealt with accordingly. Be further advised that any further telephone callsicon from your company will be recorded. Yours faithfully, Does anyone have any advice on how to stop them contacting my office? Hi Guys My hubby stupidly took out a 200 pound loan from these jokers in august this year we have paid 2 60 pound roll over fees and they are due to take 260 the end of this month to end it however 4 weeks before xmas and 4 kids i could do with not paying this any suggestions for me please? I've been looking through my credit file today and see that an account with Barclaycard has not been defaulted:???: I received the last communications from them in late 2008, though I made my last payment to them in late 2007. They didn't have a properly executed CCA, and I made them aware of such with help from this site. I got the usual letters from Mercers, with what were supposed to be Default Notices, but eventually it all went quiet. How long can a lender leave an account before placing a default notice on it? Could they pop up a month short of six years from last acknowleding the debt on put one on my credit file? Anyone?
  8. Hi all My lender has been persuing me for a debt I can prove I don't owe. They recently agreed this though only verbally! . Have letters etc. for 2 years asking for this - which was incorrect accounting on their part Also , the lende agreed to terms I thought we had initially agreed too. For about 3years they denied these terms though transcripts of phone calls and recording prove otherwise though they never formally agreed to the terms. Because of the supposed belief in these terms we permitted a short sale of a property ; weeks before completion of the sale the lender changed the terms completely ! - is this blackmail ? They led us down a path and then changed the rules at the last minute ; now ; but only verbally they agree with the initial terms after 5 years of torture I assume they are playing nice simply because they realise they are in a tight spot. I cannot go to the FSA as it is outside their jurisdiction My question is harassment for a debt I never owed is easily provable , but blackmail is more tricky ? What legal stance should I take - they certainly aren't now playing ball for fun so assume they realise they are in the smelly stuff Any advice welcome

  12. I have applied for a secured loan with Welcome (I know, I know but i'm desperate and my credit score is pretty awful!) I have received my final pack but there is a form in there for Authority to Contact Employer. Now i'm really not comfortable with Welcome contacting my boss, will they decline my application if I do not complete this form?
