  1. With a real parking ticket (council or police issued) you ALWAYS have the right to appeal under all circumstances (and may well win). With this type of scrap paper unenforceable invoice there is NO APPEAL. Whether you are right or wrong in the parking situation, the appeal is just a ruse to get you to admit you were driving and were indeed there. Then they simply write back to say the 'appeal' was unsuccessful and pile on the pressure until you cave in. 100% ignore all their scare-o-grams
  2. You misunderstand me. I do not in any way condone uninsured drivers. Quite the opposite. My comment meant that many people are not aware that are doing something wrong, as in the local postie. People do use their car to do errunds for work, unaware that by doing so they are uninsured in the event of a collision or traffic stop. You can probably tell my former occupation by now, I have had to break this news to many drivers over the years.
  3. IGNORE. You have already done too much by even thinking about their nonsense invoice. YOU OWE THEM NOTHING.
  4. As long as it says 'parking' charge notice and NOT 'penalty' charge notice, you can safely and completely ignore it. DO NOT make the mistake of entering into any dialogue at all with them, they WILL write several times, they WILL give up. You owe them nothing at all.
  5. Depends on what the evidence of the collision scene and damage suggests happened. They need to be confident of the bikers speed to ascertain whather you should have had time to see them or not. it seems that they are satisfied that the speed was not so great (possibly less than speed limit) that you could not see them and avoid crossing their path. Hence the allegation against you and the court case. Assuming you are found guilty sentance will depend on a number of factors. If you plead guilty it makes the sentance lighter. Punishment will depend on your attitude, remorse, respect for the magistrates/court procedure, previous driving record etc etc. Quite possible to leave court wityh 3 points and a £60 fine, also possible to be banned for 56 days etc, but not likely to be custodial unless you have a terrible driving record, show no respect to the victim or court, were drunk or on drugs at the time etc.
  6. A lot of people fall into this trap. local postman uses his car to drive to his delievry area with a boot full of sacks of post. Problem is that IF the car is being used for business purposes at the time of a stop, it MUST have business insurance cover at that time. If not, in the eyes of the law it is uninsured for the use it was being used for. It doesn't matter if the driver has SDP cover if the car was being used for business purposes.
  7. How about if the police were doing a stake out outside a well known duvet manufacturers. on a cold night so using a blanket, under a marquee? Maybe they were also hungry and decided to get a takeaway beef roll. Would that cositute an under cover, under cover, under cover, steak out, stake out?

  10. DO NOT send any acknowledgement, letter, explanation, appeal, questions, queries, denials or anything else whatsoever. The second you repsond at all they will up the ante and bombard you with 'solicitors' threats until you cave in. They WILL NOT take you to court if you ignore them.

  12. A home purchased outright is a personal equity. The OR will sieze the home to be sold and the proceeds used to pay any creditors. DRO is not an option as my debts are excess of £15k
  13. I think what the OP has written constitues libel! It is only an opinion, but it suggests that I will also encounter the exact same problem if I buy, so as a result I may not purchase and thus is damaging to that company.
  14. You MUST inform HMRC within 3 months of commecing self employment. BUT I have always found HMRC very helpful if you approach them. Tell them you wish to file a self employment return, but didn't realise you should have registered first. It is unlikely they will impose any fine to be honest. HMRC are really after people who dodge tax, not those who are ineffcient with small matters.
  15. Thanks again. Got all my 'late payment' charges back from all bar one card. Bank been very reasonable really. Have been making token payments on all bar one until this month. Will make token payment again today to keep the wolves at bay. The one I haven't been paying have been a real pain in the posterior, however to THEIR detrement. In a nutshell, when I moved they did something odd with the account and when they wrote to my new address I called them and they claimed that there was no such account - the account number I had been paying into for months. Obviously being human I took full advantage of that as I do not wish to pay the wrong account so I stopped paying them. I wrote, but they have not repliued so end of them for now. I think the advise above has been most helpful and I am very, very grateful for those who responded so quickly. Nice to know their are people out there who take their time to help others still. Great forum!
  16. Thanks coniff Bank is a well known high street one ('big 4' type). Of the original £17k, £12k remains The irony is I was about to file for banruptcy in 2010 literally a week away from going to court to start the process when a cheque arrived as I said literally out of the blue. Good job I didn't because that would have gone to the OR! What I would ideally like is for them all to just write the debts off and leave me in my flat without the burden/worry of all this, which is frankly making me ill - although not my actual illness if that makes sense. I am disabled, so my chances of finding work are (wrongly) restricted. What I do not want is to ask them to write it off and the next thing i find them with claws into my home. I would like to legally leave this debt behind, hence asking them to write it off and then I can just get on with life with one less worry so to speak. I know it is daft to worry and I am far from afraid of anyone, but it does worry you all the same. I am sure you all understand that.
  17. Thank you both very much. What is the liklihood of the bank going for a charging order? AFAIK they do not know I own the flat, but they probably have ways to find out. Do banks ever just write loans off and not try to bury their previously loyal customer in the process? Or is it literally just about the money as far as they are concerned? I should perhaps add that I am in a similar postion with several card companies, but the total there is about £6k spread between them.
  18. Hi guys I will try to explain. I took out a personal loan for £17k in 2008. I paid on time every month for the first year or so, but then lost my job and struggled to earn anything by trying to work self employed. I survive basically on WTC but have not been able to pay much towards my loan. I was served the usual default notice, wrecked credit rating blah blah. I wrote to the bank and explained, and for a while was paying a token amount (£20 a month) but as things got tighter, I found myself unable to pay even that without leaving myself short for gas or elec etc. By chance in 2010 I inherited some money completely out of the blue. Not a fortune, but enough to buy a small one bed flat outright and I wanted somewhere secure for me without having to worry about rent or moving again. So that is what I did. I could have paid off the loan, but I chose to buy the flat instead. Now, I have kept in communication with the bank (they do not know about my windfall or the flat) and money got even tighter recently when I was taken very ill. I have asked the bank to write off the loan as there is no realstic prospect of me paying it. They have asked for evidence of my medical condition, so I am asking my Dr for that. MY WORRY: Although this was an unsecured loan, I do own a flat outight. I obviously do not want to lose my home as I have never owned anywhere in my life. Can the bank change my loan (without my consent) into a secured loan? Can they make me bankrupt in which case I would lose my home? I cannot stress how worried I am that I could lose the only thing I own I the world. Is it possible they will write off the loan without making me bankrupt or anything? Would I know in advance if they intend to do that and if so, could I do anything to stop them? Thanks Alan
