  1. Actually, this is a very interesting question. You may see from my threads on here that I successfully wrote off all my debts. But when I asked banks for SRA printouts and paid them their fees to do so, they would often use these abbreviations on their printouts and reports. What this amounted to was that the information was sometimes not understandable and designed to confuse as much as possible ie. to slow down and to frustrate you as much as possible. You are suffering from exactly that. So the question is, when you SAR them, and they pay this game, are they entitled to do so in law, or, in the other hand, is it possible to demand, again in law, an explanation of their abbreviations. So my question is, how much, if any, of this misleading language are they showed to use?
  2. To cut a long story short, there was a credit card, also two loans. They took me to the Councty Court for one of them, knowing that i was out of the country (that was the reason they stopped the card in the first place!). So I just complained, had the CCJ set aside, dragged out the whole thing for ages and everything was written off. You can see my own thread here by using my username and searching, if you want to read the whole thing.
  3. I had the same situation with Egg. They cancelled my credit card due to the fact that I lived abroad, but kept sending letters to my old UK address. Their online system would allow a change of address to a foreign country. To cut a long story short, they eventually wrote off the debt as it became statute barred.
  4. See this thread post 4, which explains that their is no reciprocal arrangement between the USA and UK : http://www.consumeractiongroup.co.uk/forum/showthread.php?291506-HELP!-Living-in-US-being-chased-by-UK-debt-collectors.
  5. To give you a taste of below–the–belt tactics of some of these low life's, here is an example of one of my threads on here dating back to 2009. Please note it is not what "they should do". It's what they ACTUALLY do: Re: A friend in need vs Capquest Well, I never took CapQuest too seriously when they contacted me. They are notorious liars and cheats. They purchased an old Egg loan, which had previously been set aside by the county court. Actually, a previously disputed account cannot be sold to a DCA, but Egg pulled a fast one on CapQuest and duped them into buying the account. Nice one, Egg, you C**pped on CrapQuest. I played along with CapQuest, a lady by the name of Anne McShane was assigned to "help" me, as she put it. For over 12 months she kept sending ridiculous emails, asking for payments. I played along with her, even doing a CCA on them. They fought tooth and nail not to send it, citing the DPA, etc. Eventually, they sent it. However, the CCA was non-compliant and I sent a dispute letter to them, which halts all collections activity, interest and reporting to third parties. My "helper", Anne McShane, still keptsending emails asking for payments. on one day she sent several emails. One simply said "please respond", and she sent it less than 20 minutes after sending the previous one. (Harassment springs to mind). I took great pleasure in finally sending them a copy of the county court set-aside letter that I had received back in 2005, explaining to those morons that it was illegal for them to even have purchased the debt, let alone for Anne McShane to have emailed me so many times trying to make a collection. Having realised that they had been rumbled, CapQuest closed the account and said that they had made a mistake. I called my "helper" Anne to ask for a refund of payments made to them and was greated with a torrent of abuse. I explained to her that it was a collection call-I made several such calls-and explained to her that if she preferred, I could call her out of office hours on her mobile or home numbers, or alternatively arrange for a "doorstep" collector to call. I can't understand why she became so angry? It now transpires that her direct telephone line is no longer in use. However, she did upset a lot of people and her details were publicized widely on the internet. It appears that she got multiple calls and emails from all sorts of people: debt collectors, insurance quotes, car hire quotes, double glazing quotes, etc. Perhaps this is a classic case of someone who is happy giving out s**t but not taking it?
  6. It was Egg who did the CCJ, not a DCA. They knew I was abroad, as they cancelled my Egg card, saying I was not entitled to it as I was outside the UK. So they deliberately went to the County Court when they knew I could not defend. Again, to reiterate my earlier comments, banks and DCAs will do anything dirty to try and get their hands on your money. I have a superlative track record in writing off all debts and getting refunds on ALL my PPI payments and I strongly recommend that you read my threads to the techniques that I deployed to do this.
  7. What they should, and what they actually do are two different things. I have documented here in my own threads how I won against several banks and DCAs, c and every single one behaved disgracefully and unlawfully. You have to expect dirty tricks from them. I won against "a Question, Egg, Lowels, Abbey National and Coopbank. This includes writing of credit card and loan debt and reclaiming ALL of my PPI claims! Take a look on my threads.
  8. You have to be careful; I told Egg I was abroad and they sneakily went to the County Court (Northampton Bulk centre). They won by default. However, I found out and the CCJ was set aside. Egg kindly sold the debt to CapQuest, and I had great pleasure in stringing them along for several months, until I eventually told them off the prior OC dispute, so that they couldn't collect. Their collections lady AnneMcShane even accused me in writing of being in the UK, and pretending to be abroad! The account was closed as CapQuest had been sold a dud account. Is funny how Eggcup on their own DCAs
  9. Living in a other country, with a few exceptions means they cannot touch you. For example, I moved to Taiwan and there is no legal recourse here to recover UK debts. Which country are you in, so we can check it out for you?
  10. OK,then let's reduce statute barred from 6 years to 1 year so its a level playing field
  11. Glad to be of use. If you look through my threads, you will see that they can be challenged.
  12. The thing to realise about these people is that they lie. One of their people, a most despicable, lying, money grabbing person by the name of Ann McShane, talked me.into handing over 130 quid, then asked for more. Only after that dud I realise that there was no debt due to CapQuest, and she had lied. Come on McShane, sue me for libel. You will lose. They had to write off the alleged debt, details of which I reported fully on this site. She even put in writing that when I was out of the country, working abroad. I was getting somebody in the UK to sign my letters and cheques, which was untrue. Basically, don't trust them. They lost out to me. If you deal with them, ask for Anne McShane. She is as intelligent as a dead sparrow, and will lie.
  13. All the PPI policies I have ever seen state that they do not cover self-employed people, so unless this bank has an exceptional policy, they are just giving you the run around. You really have to get tough with these idiots. I did so and got every single PPI premium refunded with interest and you should do so also. Tell them in no uncertain terms that as a self-employed person, you were not eligible for the cover they apparently offered and that they must pay you back. Tell them that if they procrastinate further, you will report them to the regulatory authorities. Also tell them that you will tell your MP, trading standards, etc. so if they want to play stupid you will take them to the cleaners. Their attitude makes me sick. They think that selling inappropriate policies to people and then lying when you try to point out their error is good business; it is not, it is tantamount to robbery. You may as well hand over your wallet to them and say, "Help yourself".
  14. CapQuest buy SB and other debts cheaply, then inflate the amount due, and try and get people to pay high. They can even offer a "discount" to trick panicking debtors into paying. As the card does not appear on your CRA file, it suggests it is SB. Do you know when in 2006 it started? Was it before today's date. Whatever, don't respond to CrapQuest. They will write again anyway.
  15. I work abroad and that is why I was under the tax threshold.
  16. I got the tax deduction refunded by the Inland Revenue
  17. I paid one hundred and five pounds in instalments to CapQuest after they contacted me in 2005 about a lapsed loan account if two thousand five hundred pounds with Egg. However, there was a prior dispute with the OC, since Egg knowingly took me to the Northampton bulk county court. However, I had the judgement set aside. When I told CapQuest, they cancelled the collection account. However, they refuse to refund the one hundred and five pounds that I paid them. Is there any way that I can get it back?
  18. I was contacted by CapQuest by post in 2005. They were chasing a lapsed Egg loan account, about two thousand five hundred quid. I was working abroad , but agreed monthly payments. I paid one hundred and five pound s over several months until I found out that they had obtained the account despite it being subject to a prior dispute with the I OC. This was because Egg had taken me to the county court in Northampton, despite knowing I was abroad. I had the judgement set aside. I have asked CapQuest for a refund but they refuse. Is there anything I can do to get the cash back?
  19. My very last PPI reclaim was with Smile. I just received a letter today confirming full refund, refund of interest and 8% extra! They did not challenge my claim-it was all over in 16 weeks. Strange thing was, I had made a successful claim on the policy for an accident, so was somewhat surprised rherebwas no challenge from them. This completes all my refunds for PPI: I have a 100% sucess rate!
  20. A low settlement will affect your credit rating, if that is important to you. Personally, I have settled at 10% in the past, but after a long didpute. It depends what your situation is. If I were you, I wouldn't settle.for mote than 10%. There again, I wrote off quite a few thousand-see my threads on here!
  21. If you have no PPI to claim back and you have not defaulted on payments, then you don't have to pay 150 a month, you can repay the minimum Also, if you don't pay or settle it will adversely affect your CRA status. If this doesn't matter to you, you could always threaten not pay any more unless they will.settle try making an offer. Expect no at first
  22. Of course, don't forget to check if you are paying PPI premiums in your repayment as well.
  23. Please can you clarify the account status? Did you ever miss any payments or make any underpayments,or are you another person that Egg has unilaterally terminated? If the account limit is 3500 and you make minimum repayments of 3%, then this would be 105 monthly.
  24. When CapQuest tried to get a few thousand pounds out of me, I wrote to them and told them of a prior dispute with the OC, in this case Egg. CapQuest "investigated" my claim, but they had to close the account and write off the money. Egg had been very crafty and sold a disputed debt outright to CapQuest! Funny how these people will not only sh** on debtors, but also on themselves! The moral of the story is, if you have a prior dispute, and the easiest way to do this is to fire off an SAR to the OC, who will always drag their feet in complying, then the debt CANNOT be processed by a DCA and you can tell them to go and whistle. This saved me a bout three thousand five hundred pounds. Easy!
