  1. I sent them the SB letter because i know for sure that the last payment made by me on this account was more than 6 years ago. I will do the CCA next week. But this Crapbot have replied back to me saying that ' It is not statute barred because a default notice was issued by Credit card company in March 2008 and the limitation period runs from that date'

  3. Hello everyone i need some help here.. i had this credit credit during my uni days which i could not pay back..and then i moved on and life moved on... I received a letter from cabot finanical about 5 weeks back asking for money back. I know for sure that the last payment made for this account was definitely more than 6 years ago. And i have never made any acknowledgment for this account since then. Therefore, it is technically statute barred. I had sent them a SB letter about 3 weeks back. They have written back to me saying that this account is Not SB because the default notice issued by the credit card company was on March 2008 and the limitation period runs from that date therefore they are claiming that this is not SB. Please suggest what should i do now? It is not a large amount and i can stretch a little bit to pay it off (may be not in full but at least 70% of it) but i want to make sure that i follow the right course of action here and they are definitely the right owners of the account. I am not sure how to proceed from here. Thanks Steady
  4. folks, following our previous discussion, i had sent them (Capquest) a SB letter. Since then, they have sent me two acknowledgement letters saying that they have requested more info from Original Credit card company and they will let me know when they get the data. But they seem to have increased the final figure by a small amount in their last letter from what they had told me in the first place. Is that just an intimidation tactic? I wonder why are they increasing the amount? Interest?

  6. yeah, thats indeed the case. They might have tried to reach me in the past. But as far as i know, i have never accepted (verbally or in writing) the debt or this account. Do i need to sign the the SB letter that i am going to send em tmrw ? ! @DX100UK : by your comment "look through those statements and find YOUR last transaction.", do you mean that the the date of last payment made by me to Credit card company or last time when i had used the credit card ?! Sorry for being thick....i am just trying to understand this process.
  7. thanks for merging the two threads 'dx100uk' Yes, it doesnt show on CRA file (i checked it last year and just today again) My last transaction was dec 2006. I am preparing the SB letter today; will keep you guys posted on this. Thanks
  8. I have another question here. Am i actually accepting the debt by sending the SB letter ? It doesnt appear on my credit records (just checked it again on Equifax).

  10. Letter is a mix of 'may' , could, will etc.
  11. Letter says that if i fail to contact them and initiate the settlement process, this account will be sent to solicitors for a claim to be issued in county court. Also that they will not issue any further warnings. And the claim will be issued in the name of Crapquest Investments Limited. Its Titled as " Letter of Claim under the Practice Direction - Pre Action Conduct" Crapquest say that they have purchased the account from original credit card company.
  12. Fellas Need some help here. I have rec'd a 'Pre Action Conduct' letter from Crapquest. Letter is basically saying that if i don't contact them to settle the amount, they will take the matter further into court. They have sent letters to me in the past but i have kept ignoring them. Type of debt - Credit card Last Payment made - Dec 2006 I have never made any payments nor accepted the debt (verbally / in writing) with any collection agency since i made the last payment. I did SAR August last year from original credit card company and they sent me a whole bunch of documents containing all the transactions etc. This crapquest even offered me a discount in their last letter which they sent me last year around Sep/Oct time. Last time i checked, this debt doesnt even appear on credit report. Please suggest me a company where i can re-check my credit status just for reassurance. Please suggest what should i do now ?   13. unfortunately, there is no way to check old bank accounts. Only credit card company can possibly give me the data of all the transactions.
  14. Thanks 'CitizenB' . Yes, the Postal order has been encashed by the credit card company. I have just rang up 08457 22 3344 (option 4, then option 5) and they confirmed it. So, shall i just hang on to it for a little while....i guess my first priority should be establishing whether the debt is SB or not!
  15. thanks for your replies everyone yes i have checked the RM website, my SAR letter was delivered to the credit card company. However, i have not checked whether they have encashed my Postal order or not yet. I will go to the post office this afternoon to see if i can check this. I do have all the receits with me. The credit card company has about another 20 days to comply with my SAR request. In the meantime, any suggestions on how should i deal with crapquest letters or not at all !
