  2. Good point, but we need a legal expert to give best advice on this. Is anyone out there qualified enough to know what the situation with this is? BF stated above that, @Job description is sufficiently formal for enforcing 22hours', but you have suggested a doubt over this.
  3. According to your figures, which span a three month period, you have worked and will be working, a total of 142.5 hours. However, you terms and conditions state clearly that you were being offered 22 hours per week. A month is about 4.3 weeks, so your number of hours per month should be 94.6, which over the quarter would be 283.8. This means, assuming that your terms and conditions are up holdable, which is what BF is suggesting, you should be paid for the balance, which is 141.3 hours. The minimum wage is 6.31 pounds currently, so you would be due 891.60 pounds in additional payments for this quarter, equivalent to 297.20 pounds per month. Going back to 2001, when you first got the contract, minimum wages are as follows: The National Minimum Wage rate per hour depends on your age and whether you’re an apprentice - you must be at least school leaving age to get it. Using figures for the present quarter, assuming your work hours were equal during the whole employment period, you would be due 128 x 297.20, which is 38,042 pounds. I have used the current national minimum wage for the whole calculation, obviously it was lower earlier during your employment. I have also used only this quarter's working hours. To get an exact figure you would need to calculate the exact working hours for the whole period from December 2001 and take into account the minimum wage changes during that period. Assuming that they have to honour their original terms and conditions, again, which BF suggests, you could be sitting on a small fortune. Well worth getting out your paperwork and getting a glass of beer, relax and work out the exact figure. Then report back here and we will tell you how to make a claim.   4. I would copy in Anne Mcshane, one of their "Managers". See my posts on other threads here relating to CapQuest. She accused me in writing of fraud, haha! I still have the letter. Shortly after I complained about CrapQuest to the FOS, Trading Standard, Blah Been their local MP, amongst many others, my account with them was cancelled. She broke every rule in the book. In fact her details were plastered all over the Internet and her direct dial number mysteriously removed after that.
  5. I have worked abroad for a few years years now. I always file an annual tax return just to remain "on the radar" in case I ever go back to the UK. It is easy. I do it online in just a few minutes. I have a small UK income of £120 a month, which is taxed. Then it is refunded to me each year.

So sorry to hear that a good service to the community, "Equidebt debt" is going bust after threatening and harassing so many people, most of all are in vulnerable situations I have a list of employees, or possibly ex employees, of Equidebt, who the seems losing their "good jobs" will find themselves in debt through employment. Could I be amongst the first to offer them their own facility of offering a doorstep collector for their debts? I have able and will people available to do this. Our see could consider county court action. what is it like to have the boot on the other foot?
  7. Perhaps I didn't explain fully; the card rate was taken into account, just like in the spreadsheet, then the 8% was added, just like the County Court, then £150 for compensation. The figures were agreed with the FOS and imposed on Abbey. The reason for the compensation is that Abbey had put in writing to me that I could not go to the FOS. When they paid me the money, they included a rather unapologetic letter saying "due to an oversight, etc."

  9. Well done! It just goes to show that persistence and tenacity pay off. I got all of my ppi refunded in full (you can see my threads on here). This included a pretty 2000 account with Scabby Abbey. They really sent me around the houses from Abbey, to MBNA (who took over Abbey credit cards), to Lowlife Lowells. Abbey even put in writing that it was too late to contact the FOS. FOS made them pay in full, with interest and compensation, and Abbey apologised for their "oversight". Yeah! So again, well done and let this be an inspiration to any forum readers being fleeced by their robing, lying back or DCA.
  10. Hi luluciou Welcome to this wonderful forum. We all came here at some time in the past, similar reasons to you..... Debt. First, try not to panic. Second, have a good read on here of how people have dealt with their debts. For example, you could read my own threads. Third, debt is not forever, there is always a way out. Fourth, as you will discover on here, there are ways of approaching your creditors, such as everything in writing, no phone calls, telling them what you can afford, rather than listening to what they "demand". Remember all debt collection agencies and back collections departments will life through they're back teeth to get more money from you. Stick to your guns. YOU are in control of the debt, not them. Whatever you do, make sure you are in the driving seat, not them. Spend a little time on here, listen to the advice, and soon the creditors so be eating out of your hand, not you from theirs.   11. Perhaps I should have clarified. I notified Egg many times over several years that I was working abroad. The address was a friend's house, my last address in the UK. So Egg knew I was abroad. But they went ahead with the CCJ in my absence, and I can assure you it was set aside and I eventually received a letter to my new address abroad, which I voluntarily gave them, saying that the account was permanently closed and written off. Sorry omitted the full details earlier, I was abbreviating.
  12. I also moved abroad. Everything is written off now. Just avoid any contact with them, even if they email, report as spam. Keep original records showing when you defaulted, etc. After 6 years they can kiss your RRRs. Even if they issue a CCJ at your old UK address, you can have it set aside on the basis that you no longer live there; it has to be served on your real address. It cannot be served to a foreign foreign address. See my threads on here to see how I wrote the whole lot off, then went on to claim all the PPI back. Don't be afraid to visit the UK for a holiday. They don't check your passport or wait at the airport for you, haha!
  13. Not in the context which you perhaps think. I was eluding to the fact that they had told the new job forum member on here, MadLoopy, that they are not a DCA, according to his words above. I was merely giving an example to him of how blatant a lie that is by referring him to a fairly high profile announcement made in the Financial Times. Moreover, I was explaining to this newcomer that what he has experienced from them is pretty standard practice from DCAs. To help you MadLoopy, if you get time, please take a look over my own threads on here, which show how I beat every single one of my creditors and had everything written off, then went on to get full PPI refunds from each one. Until I joined this forum, I didn't even know where to start, so after my success, apart from publishing details on here, I also made a donation to CAG. Good luck MadLoopy, there is plenty of experience and help here.

  15. Another trick I got up to with the rather dim "McShane", was that I realised the so called "debt" was an Egg loan. Egg knew that I was abroad but still decided to sneakily get a CCJ against me, knowing that I couldn't defend, because, eerrrm, I was working overseas. When I eventually got my post sent to me, I realised they had gone to court knowing I couldn't defend, so I had the CCJ set aside. Of course, this now meant I had a prior dispute with the OC, which means the debt cannot be collected by a third party DCA. But Egg and DCAs only understand one principle : sh** on people. So, this is so funny, Egg sh** on CrapQuest by selling the debt to them outright, knowing they could never collect. So when that moron, Anne Mcshane tried to collect from me, I had very great pleasure in wasting her time and stringing her along for a year, before I had the humility to tell her she could not collect on a set aside CCJ, that was subject to a prior dispute with the OC. During that time, she broke every rule in the book and if I was still in the UK, I would have sued her ar*e off. I really enjoyed getting her threat o gram emails and letters, as I even gave her my address abroad to test whether she stupid enough to write to Taiwan. Yes, she was that stupid! Haha. To this date Capquest have steadfastly refused to refund the token payments I made to them, which only goes to show what they are like. In conclusion, I treat DCAs the same way that they treated me, with utter contempt. See my threads on here ;I wrote of all debts and was refunded every single PPI payment. In short, lead DCAs on and they always drop themselves in it. Bye bye McShane.

Last time I got a doorstep letter, from those idiots at Capquest, I lived abroad and wrote to their "collections manager", called Anne Mcshane (i have to laugh every time I mention her name, she got everything wrong and they had to write the debt off), and I inquired how was she going to visit me in Taiwan, was she going to flying economy class or or business class to visit? Haha. So I called her on her direct dial number at the CrapQuest office to arrange a doorstep visit: her doorstep! Her details had been plastered all over the Internet, so I assume she had upset a few people. She went very quiet when I said that I was sending my collector that same evening. She even refused to say what time she would be home. Anyway, that night she never answered the door when my collector called. It's funny isn't it how the bullies go all silent when the tables are turned. Shortly afterwards, her direct dial number was removed, as she received multiple calls from insurance salesmen, double glazing sales people, debt collectors, etc. as a result of the presence of her details online. Poor thing!

  19. Very interesting. So, if a company is in another country, are they legally able to collect? What I mean is, they can ask for money, but if a person does not pay, are they to take court a on in the UK?

  23. Agreed, and like with banks themselves, ppi miselling, endowments miselling, etc., the reason that there is inaction from politicians is that the banks line their pockets. I mean, how many ex cabinet Ministers are hired in the City by big banks; how many politicians have their pockets lined by lobbyists? Vincent Cable spoke a long time ago about dealing with personal indebtedness. Then never really did anything significant about it. The remaining big debt firms will go down the same route of paying off politicians. However, the principle at stake should be people first, profit second. Personally, I managed to write off all my debts and recover every single ppi payment I had unlawfully been sold (all of them). This dates back to 2005.why has so little changed since them. I fought the banks, largely using the this site. I was tenacious. I did not give in to threat o grams. But many people are more vulnerable than me. Personally, I wish that all DCAs go bust, just like those parasites as Equithreat. But I don't think that is likely while politicians don't help protect people.

I'm absolutely delighted to hear this news and encourage their redundant employees to post on here two things: firstly, will they tell us the dirty tricks they used to bully vulnerable people into paying up; secondly, will they let us know which DCAs chase the ex employees of Equithreat for credit they can no longer pay their own credit because they have lost their jobs. For example, a person who used to harass people by threat o gram letters and calls as an employee of the DCA, will they now be chased by the good people at Capquest? As I say, I am absolutely delighted at this good news. If only I could get a list of the employee details, I could sell it to Capquest and say, here you go, rich pickings, these people have no jobs, dip your bread, they are all behind with their credit payments.
