  1. Best person to deal with at CapQuest is Anne McShane, a complete [edit] who always gets it wrong. Sue if they want, but she put it in writing to me that I was having signatures forged on my letters and cheques! Hahaha. Can you imagine who would be so stupid to do that? Get her to administer your case and you will win. They are a bunch of cancers who make mistakes all the way along the line. Get out all the paperwork and regulations, post on here if necessary. I bet they will have made plenty of mistakes.
  2. Thanks for your request to supply details of the SD from CapQuest. Actually, I did not get an SD. I just got a letter saying that they are now the owners of the account. Similarly Egg wrote to me and said that they have transferred their rights and your Egg Loan account to CapQuest Investments Ltd. It went on to say that , "Your loan is now the sole responsibility of the above company." Not sure if this helps you. However, I note that I did pay CapQuest. It still did not stop me paying 907 pounds in installments before I realized that I should not be paying them due to a prior dispute with the OC, in that the county court had set the account aside. Getting the money back is impossible, it's like getting blood out of a stone.

  5. It stands for Prescribed Terms. These are explained fully in other threads if you want to have a quick look. In simple terms they are terms and conditions that have to be part of the agreement, but others on here may give you a more technical explanation.
  6. Interesting post. Pleas keep us informed of the barristers and lawyers end up managing to achieve! Personally, I live abroad and Egg cannot touch me. They only managed to send a very dodgey reconstituted CCA and as mentioned above, if they are so cock sure of themselves about these sorts of documents, why aren't they taking people left, right and centre to the County Courts? More likely a few people not in the know get frightened and pay up.
  7. Excellent point, Williewonker. If Egg are so sure of their position, then all they have to do is go t the County Courts to get a judgement against people who dispute unusually worded CCAs. As you say, after almost three years of procrastination, they have not done so and are now being sold. Some observers say that "toxic" debt will be hived off in the process of the sale e.g. written off or sold at pennies in the pounds to DCAs.
  8. Yes, I have had exactly that experience. You can see my thread on here, just do a quick search and you can read the whole story. In a nutshell, I had around 10 thousand pounds owing on an old Abbey card-Abbey was taken over by MBNA. It inflated to 10500 with late fees, etc. It was sold outright to the lovely people at Lowells who kept demanding payment in full, etc. (illegal activity don't you think?) I did the SAR and CCA thing and it was a bit strange. I kept getting letters apologizing for the time taken to respond, as their client (MBNA/Abbey) were trying to locate the paperwork, which dated back to around 1999. In the end they wrote back saying that there were no records going back that far and they closed the account writing off the money. That was before reconstituted CCAs were allowed. However, I guess if they don't have the original paperwork they can't reconstitute a copy because they won't have essential information, such as the credit limit offered, etc. Maybe others on here can advise you better than me on the technicalities of the reconstituted CCAs if they go down that route. Not only did they write of 10 thousand quid, I also then claimed back the PPI. Abbey wrote to me directly telling me a pack of lies, which included saying that it was not mis sold (they had no records so how did they know? Hahahaha) and they also said it as too old for the FOS complaint system to be used. Nevertheless, I complained via the FOS and although it took over 6 months, i got a full PPI refund with compensation and interest. I therefore made a huge profit on the whole exercise. I am sure that MBNA Abbey and Lowells hate me and I am truly proud of that. Take a look at my thread and see how I did it and how I never listen to what the banks tell me! Good luck with your claim.
  9. Hi, same result as i got last year. Well done! Interestingly, they did not go down the reconstructed CCA route, although I believe that they are allowed to do so if they want. However, if the OC did not keep any records, it may be that the original T+C, etc. were not recorded.
  10. I think a "very well done" to you, as many have been assuming that reconstructions mean the end of challenging the agreements, but you have proved otherwise so far. Keep us updated after the 28 days have passed!
  11. Egg routinely do not send out all the requested information. They just try and wear the borrower down and keep sending demands for money. Unethical, yes, but they seem to get away with it. On to the PPI issue. I had a similar case with Abbey, who could not supply me with any paperwork. They also said that they would not refund any PPI payments and that the payments were so old, the FOS would not be able to take up my complain anyway. Nevertheless, with nothing to lose, I complained to the FOS. Not only did they tell Abbey to cough up, they added interest and compensation. They were also forced to send me a letter apologizing for their "oversight" in telling me that the FOS could not help. If Egg mess you around, I suggest the FOS route. It took about 7 or 8 months but I received a cheque for 840 quid, so well worth the wait. The FOS are also reliable to deal with, no messing around like with Egg.
  12. It's really interesting. in my case, they terminated my card in 2005 (was that when Citibank took over?). I had always paid in full, on time. However, because I used their special offer at that time, to spend interest free for 6 months, I did so and apparently they did not like it. They cancelled the facility and expected me to pay the balance., which to this day I have never done! I guess this meets the criteria that you are discussing. So bye-bye Egg.
  13. Basa, I am not sure if I fully understand. I have an egg credit card that was stopped by them because I always paid off the card in full or at the end of various interest periods, and so they saw me as an unprofitable customer. I never paid anything further on the card since 2005, although i get the occasional letter asking for payment. are you saying that because they cancelled without a default, the Contract is null and void and nothing has to be paid by me?
  14. That is truly typical of Egg, getting the whole thing so mixed up. I was never sure whether they do this deliberately, to try and confuse and bully the customer into paying up,or whether they were genuinely mixed up themselves. Upon reflection, I think it is a combination of both. The saving grace is that if you ever end up in court, you can refer to lots of conflicting information from them, such as the "active"and "inactive" accounts that you refer to in your post. Just keep all of the stuff filed and indexed read for use!
  15. I certainly agree with this statement. Egg got themselves into really hot water by setting up their organisation on the cheap and cutting corners. Worst amongst the errors was that they drafted up badly worded CCAs for years. What on earth possessed them to do that, God only knows. They were also caught red handed mis selling PPI and landed a big fine from the regulatory bodies. Rather than accept that everything is their fault, they are trying to limit their losses by hitting out at their own customers, trying each and every devious way to trick people into paying up, trying to avoid paying out PPI settlements, etc. "Dirty tricks" and "Egg" have become synonymous and in my opinion they have rapidly become one of the worst banks to deal with, especially since they were taken over by Citi bank.
  16. Fully agreed about knowingly sneaking court papers to old addresses. Egg did that to me when i moved abroad. in fact, their "reason" for terminating my Egg card was that I was abroad for more than 6 months a year. After some time, they also sent county court papers to my old address without my knowledge and won the case by default. Fortunately, I got hold of my correspondence and had the judgement set aside. Egg then played a double dirty by selling the debt to CapQuest (DCA) who tried to chase for the money. I played them along for a while, much to the distress of one of their collection team, before sending the prior dispute with an OC template letter. They had to close the case and I saved about 5000 pounds!

    I never found Egg good at accepting reduced payments. They have certainly changed since they were taken over by sh*ti bank in 2005
  18. It is designed to appear as different levels of severity or threat in an ascending order, if you are stupid enough to fall for that! I got all three also and told them all to sod off when they could not produce a CCA and the debt was written off.

    Well, at least you can quote this to CrapQuest, saying that you will not budge until the "consultation" by the OFT is completed. Could be years the speed at which they work.
