Hi guys im new here so go easy on me. I apologise in advance if im posting in the wrong place.

 

I just dont know what to do.

I have a debt with capital credit management.

They asked me to make a token £1 payment over the phone with them which i did do last week.

I then agreed to set up a direct debit for £10 per month which they said was fine.

It has been set up now with my bank and details all posted to me.

 

I then go to my account this morning to find it is -£85.

I phoned the bank this morning who say that they see 3 payments - one for £50, one for £30 and one for £5 coming out to a Lasker International.

 

I told them i dont know who this is and i havnt authorised anything.

They say it seems to be a debt recovery agent and we can do nothing until they actually show as transactions on your account.

 

I asked to be put through to the fraud department who tell me the same thing.

I ask can i then report them as fraudulent transactions in a couple of days when they go through.

They asked had i any dealings with any dra.

I said yes capital credit management not lasker international as i have never heard of them.

I said i authorised them once to make a transaction and have set up a direct debit with them.

They say if they refund the money and this lasker international say i owe them then the bank will take the money from me again.

 

They asked me to contact the company they gave me the phone number.

I cannot get through to anyone there.

I phoned capital credit management and they say they would not take any other money from me other than that i authorised and they have never heard of Lasker International.

 

Does anyone know what i can do im going out of my mind with worry that they will continue to take payments from my card.

What can i do anyone please help.

Im living on nothing as it is now im also £85 down

It is the responsibilty of your bank to reject unathorised payments and to prevent you being subject to fraud. Insist that they return the payments unpaid. Also they may also want to look at whether to set up a new account for you, with a new debit card.

 

Report this also to Action Fraud.

Thank you for your help. Can the bank refund me the money as i will be making the case it is a fraudulent payment as in my eyes it is. I have never had any dealings with this company and have never authorised them or given them my details to take money. Should i now be cancelling my debit card and asking for a new one so that noone can access my money.

The reason for rejecting the payments is that they were unauthorised.

 

It only becomes actual fraud, if your bank lets them go through.

 

It is up to your bank to stop that happening.

 

Did you give your debit card number to these people ?

I called them and they said they have never heard of Lasker International and that they would not debit my account again without my authorisation

and that they would not pass my details to any third party.

 

They are the only people i gave details to and that was for a one off payment.

 

I found through google however that this Richard Howlett Solicitor for Capital Credit Management seems to have links with this Lasker International.

 

The bank more or less said if i gave my details to any company they can transfer to other third parties and it isnt up to the bank to refund.

 

I said i gave my details for a one off payment to one company.

 

I did not authorise use of my card to any other company nor to be used a second time.

 

I likened it to me using my details to call up and pay for flights over the phone.

 

I do it once as a one time transaction but this doesnt allow them to use it again.

 

I dont think my bank will refund anything.

 

Im distraught with worry

The FSA says - your bank cannot simply say that use of your password, card and PIN conclusively proves you authorised a payment

 

Ring your bank get the name of the person you speak to first - if they refuse to stop the payment/an immediate refund, tell them you will report this to the FSA then ring the FSA helpline and report it

The debt was for a payday loan taken 2 years ago. I had been dealing with payplan who were paying on my behalf but this crowd would not wait to deal with payplan and said they would commence proceedings immediately unless i paid a token payment and set up direct debit details.

Phone the bank and tell them that you have checked with the FSA. who have told you that the unauthorised payments must be rejected and a refund given if they had gone through. Make a complaint to a manager if they refuse.

 

Ask if they have a "Compliance manager"

I am almost in tears here and it seems to silly over £85 but at this minute in time thats like 85 million to me.

I said also i dont know how they got through as the bank never ever ever let me go overdrawn using the card for my own purposes so how can some other company take from it.

No but i certainly will do at lunchtime.

 

Im at work at present and cant even get out to make another call to them but will do on my lunchbreak.

 

I appreciate all your help so so much.

 

I take it i will now have to cancel my debit card to stop these people trying to debit my account again.

You can do this altough the bank will tell you that it doesn't always work (apparently- seen it before on this site somewhere). Also remind them that it was the banking industry who created this method of payment and that they must have known that there would be unscrupulous people who would abuse it by passing on your card and security details

Thanks so much. Hopefully i get somewhere with them today but i wouldnt be too confident. Although if i have different debit card details surely they wouldnt be able to use them.

 

Unfortunately, they could still use the old card, if it links to the same account. Your bank may be reluctant to stop all payments from the original card number. So you may have to keep an eye on your account regularly.

If it is cancelled though for fraudulent transactions surely the bank will stop any payment going out of it from now on in?

 

If they have stopped all payments from that card number then great. Don't trust this. Keep an eye on your account.

Just thought i would update you all.

 

I telephoned Lasker International who when i enquired why they had taken payments from my account i was told to F**k off and that is the exact words then they hung up.

 

I then called my bank and explained this to them so they have immediately flagged these payments up as fraud.

 

Apparently they also tried to take a further £200 and a further £100 from my account as well as what they did take.

 

The bank declined this though.

 

My bank have now cancelled my card completely and will provide me with new debit card with new numbers etc

that noone will have access to and have said that any payments trying to come out of the old card will be immediately declined.

 

He did say that they will refund me once the transactions show up.

 

He said though that if the fraud team think they are not fraudulent and i have used them before then they will let them stand.

 

I said this couldnt be correct as i have never used lasker international for anything and that capital cm said they are not linked to them nor are they a sister company.

 

i called lasker again absolutely fuming.

 

They say they have had several calls about this this morning that apparently a merchant made a mistake

and the payments should be going to capital credit management who are a completely seperate company to themselves.

 

I phoned capital cm again and they say they took nothing from my account and it must be a mistake etc etc etc.

 

I am absolutely infuriorated in case the bank decide to let these stand and dont refund them if lasker say it was down to capital and capital say i owe them.

 

Anyone any ideas?

 

Should i be ok now that my card is cancelled so they cannot take any more payments?
