    • I don't think they even deserve a reply...    We do have a solid case don't we?? Even though mum corgot the pop that time??
    • To start, my address both on my logbook and with the DVLA are correct.  The first I knew of the bus lane fine was when a woman on another floor in my building posted a photo of a letter addressed to me but with her address on it, on the building's facebook group. I obviously recognised my name so contacted her. She said she'd been receiving these letters for me for months but only asked in the group if anyone knew me when the bailiffs were at her door.  I contacted the debt collection agency and Manchester Council and was told to appeal. So I did and explained what happened said I was more than willing to pay the original fine but its now at over £400 and I would have paid straight away if the letters had gone to the correct address. Months have passed and I have just been told (with no reason) that my appeal was unsuccessful and I need to pay the full amount.  Any help would be appreciated! It just seems so unfair!
    • Exactly right Bank!  I had an email this morning from HM Courts and Tribunals Service Civil Money Claims: Dear Mr xxxx Claim number: 527MCxxx Parcel2Go.com has been given an extra 14 days to respond to your claim. They need to respond to your claim before 4pm on 4 June 2024.  Anyone would think you've been through this before!
    • OK, understood. The second decision to make, given PE are wobbling, would be whether to reply to them (well after 8 May to show you're not scared of them), ridicule their offer which is no offer at all, and ask them to make a serious attempt to settle.  You never know, they might offer a few quid as an out-of.court settlement and it might save your mum having to do court. Just an idea.  Something to consider.
    • If we are sure we have a valid case, she's ready to go to court. Her sister is going with to help with her hearing difficulties,  so we might as well see it through!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all .

i've been getting advice on one of the other pages about debt with cabot and robinson way

and was advised to ask someone dealing with cabot about the credit agreement i've receieved after sending a cca and statement of account .

 

my thread is under the name dazza3956 and titled robinson way.

 

i am starting a thread in here as my debt has been passed from kings hill to robinson way then to cabot .

 

as i've explained on the other pages that this debt has been paid off in full

but they keep adding extra on as it gets passed from dca to dca.

 

i've tried to put the letter on here that i've receieved but can't seem to get it done for some reason.

 

please could someone have a look at my thread and avise me on the next step.

 

i sent a cca to cabot on the 20/8/07

 

they have sent my £1 back saying they dont accept this but will get the relevant info from monument.

now they have sent me a supposedly original credit agreement but having read about them on here i think it is just an application for credit.

ok thanx .

the thing is i am not disputing the debt i did owe and obviously i had an agreement with providian credit card.what i am disputing is the fact that this debt was paid off in full but they still say i owe them money.every time it gets passed from ROBINSON WAY,KINGS HILL and CABOT the amount gets more and more.

what angle can i take next to get it through to them that it has been paid off or does it take going to court to stop it?

i have asked for a statement of account but just been ignored.

OK, you've been more than reasonable with these clowns. Now is the time to send them a letter of complaint. In it, you should tell them that as they are not prepared to be reasonable, you are offering them this final chance to resolve the mater amicably, and address your concerns. If they do not, you are entitled to take your complaint to the Financial Services Ombudsman (who may hit them with a £400 penalty).

You can also take this further, and issue a statutory notice to stop processing your data, for which they have 21 days to comply, after which you may report that to the ICO.

 

You might also like to consider court action to ask a judge to tell them to feck off. If that is not for you, you can simply save up all their nastly little letters in case THEY try taking YOU to court. In which case you simply defend on the basis of no CCA? Right, p1ss off then. It really is as simple a defence as that. Folks here will help you if it comes to that.

 

From the way you have described their "agreement", they really are stuffed. It's not an agreement at all.

hi

received a letter from Robinson Way yesterday (after sending the letter provided by Priority One.Thank you Priority.)saying that they won't be pursuing me for the debt but has been passed back to their client .(cabot i assume).

will pm one of the above today for a letter to send to cabot.

post the "agreement" so we can double check. as long as you have proof it's paid in full tell to take long walk off a short pier or invite them to take legal action against you, it seems to be the in thing now, take cabot to court lol (and yes it looks like i will be doing it aswell

hi

i got a credit report recently and it has this debt on there which obviously is having an effect on my credit rating.

could i write to equifax,experian etc to explain this debt and that i am disputing it or wouldn't it make any difference?

You can but most people wont take any notice of your dispute unfortunately and as some mebers have found out contacting CRAs can open up a new can of worms:o

although i've received what looks like an application form on which my sinature appears and they quote the consumer credit act 1974,can i go as far to say that the cca request i posted well over 12 days ago to Cabot is in default?

i have pm'd all three above for a letter to send next but as yet no reply.

i have tried several times but doesn't seem to work..can you give me any pointers on what to do.i've scanned the image but can't import to cag thread.

 

Sign up for an account at Photobucket, upload the scan, and when you can see its thumbnail click the 4th box which says IMG CODE, an icon will show saying "copied", paste that link into a blank line on your post and it'll show up!

 

And as previously stated it's time to stop mucking about now, a complaint to Trading Standards and a complaint using their complaints procedure is in order so that the FOS can be complained to.

application form it is. there no interest rate and there no credit limt so your safe.

 

only thing i will say now is to check your CRA files. OC default vanished and new 1 appeared and guess what it's in Cabot's name.

 

they are soooooooooooooooooo screwed.
