    • Thanks London  if I’ve read correctly the questionaire wants me to post his actual name on a public forum… is that correct.  I’ve only had a quick read so far
    • Plenty of success stories, also bear in mind not everyone updates the forum.  Overdale's want you to roll over and pay, without using your enshrined legal right to defend. make you wet yourself in fear that a solicitor will Take you to court, so you will pay up without question. Most people do just that,  but you are lucky that you have found this place and can help you put together a good defence. You should get reading on some other Capital One and Overdale's cases on the forum to get an idea of how it works.  
    • In both versions the three references to "your clients" near the end need to be changed to "you" or "your" as Alliance are not using solicitors, they have sent the LoC themselves. Personally I'd change "Dear ALLIANCE PARKING Litigation Dept" to "Dear Kev".  It would show you'd done your homework, looked up the company, and seen it's a pathetic one-man band rather than having any departments.  The PPCs love to pretend they have some official power and so you should be scared of them - showing you've sussed their sordid games and you're confident about fighting them undermines all this.  In fact that's the whole point of a snotty letter - to show you'd be big trouble for them if they did do court so better to drop you like a hot potato and go and pursue mugs who just give in instead. In the very, very, very, very unlikely case of Kev doing court, it'd be better that he didn't know in advance all the legal arguments you'd be using, so I'd heavily reduce the number of cards being played.

So how successful are these methods or am I just buying time for him  and a ccj will be inevitable in the end. Thanks another question is, will he have to appear at court..? Apart from the serious GDPR breach you’ve made with the DVLA and your complete failure in identifying the driver, we’re dumbfounded that the PCN is still not compliant with the PoFA (2012 Schedule 4 Under Section 9.2.f) even after 12 years of pathetic trial and error. We also doubt a judge would be very impressed at your bone idleness and lack of due diligence regarding parking periods. We are more than ready to raise the above issues and more, with a fair minded judge, who will most likely laugh your clients out in less time than it takes to capture a couple of useless ANPR photos. If you insist on continuing this stupid, money grabbing quest, after having all of the above pointed out, we will of course show this letter to the Judge and request “an unreasonable costs order” under CPR 27.14.2.g and put it toward future taxis to Harlyn Bay instead.  We all look forward to your clients' deafening silence.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yey I now become a Cabot fan club member.

 

got letter other week saying they taken over debt and included a dodgey looking letter from OC.

 

sent CCA, they wrote back returnin cheque as they will do this for free and they be in contact soon.

lol. cover letter i got with that says statments to follow, so i'll wait for next contact plus few more threat letters so I can play wiv them a little. (only coz I luv DCA's) then i'll very politley (not) send letter to them for closure, i might even push to get default removed :)

I'm very concerned at the way that Cabot keeps on not using the rights vs duties bawlarks. They seem to have realised that not providing credit agreements = annoyed judge.

 

It's a pity. Cases have always been so easy the second they start using that one. They tend to get struck out before the hearing.

 

It seems they've learnt some law:(

left hand side ok, 3 declaration you can only pick up few words. it printed on a4 sheet but form itself only measures 6x3 inches

ok, I really do like Cabot now, not only sent the £1 CCA fee back saying we do this for free, they have now furneshed me with ALL statemnts, thats jolly nice as thats saved me payin £10 for S.A.R now.

and as a bouns I see some unlawful charges.

 

they done all this for me free of charge and they can't enforce it due to CCA only being an application form

ok peeps. as cabot sent relevant info app form not actual cca i'm just waiting for the call to "arrange payments" so lets start preparing a letter, i dont wanna use templates so i wanna do something different that

I'd start by deducting all the unlawful penalties that were ever applied to the account.

 

Then I'd deduct all the INTEREST that was ever applied to the account. Since there is clearly no interest rate mentioned in the so-called agreement, clearly there was never any agreement by you to pay any.

 

Then I'd start the negotiations with whatever figure is left, and perhaps offer that to them. Oh, dear. That might mean there is a negative balance, so the new owner of the account would perhaps owe YOU money. :D

PPI too ? Maybe room to look at reclaiming any PPI too - if there wasn't a relevant CCA in place and you'd paid into this PPI stuff there may be room to go after that too.

 

I can't see a tick box relating to this on the "CCA" you show here - but if you paid it - it will sho on statements.

 

Try and keep your argument simple and take it a stage at a time and see what throws up - the LoP stuff really isn't relevant until Cabots prove the CCA exists - so make them prove that CCA first.

 

We are all watching this LoP argument cleverly disguise and leap ahead of the CCA stages. Don't let Cabots do this - plan you argument and take it stage by stage then you'll get the truth of what is going on rather than their bluffing their way through this the way it suits them.

 

If they do come up with a relevant CCA - that's fine really - just move onto the next stage and work through it with a strategy - then you won't get bogged down and drown in papers. Keep it simple. :D

yup i spotted that just now they call it "Repayment option plan" wat ever that is. i'm still waiting for them to phone (naturaly i wont speak to them)

this is too easy so gonna play it out a little and WAIT for any court letters and i'm watching my credit ref aswell

 

prob end up slam dunk, or hook line & sinker if i have my way, i want them to mention court and i'll give em some excuse to run with it, when I receive an LBA i go for the kill and not proper CCA form, tey aint got 1 I know, i only done app form which is up top of me post.

Maybe they are starting to worry about the latest OFT guidance document under consultation. It does very clearly state reasons for removal/refusal of license, one such reason being "failed to comply with credit or other consumer legislation" Looks like that is all DCA's stuffed(think I prefer a traditional turkey this christmas though as it leaves a much more pleasant taste:rolleyes:)

 

Yes, there is a whole lot more failings (consumer complaints - well lots of them already!). Pity OFT have given them the chance to suggest their own version (oops sorry their polite words are more on the lines of "if you disagree the interpretation").

I've just started a new thread in "General Debt" about CCA Vs Defaults. it a thing i am going to play with as I have a default on CRA and it "State" i have breached credit agreement. i only signed a Application form not a properly executed agreement, so I am trying to find out if they can legally enter info on CRA. plaes read new thread it does show I am not avoiding what i owe, this is an exercise I want to try for benefit of US ALL and i'm happy to chuck £30 down pan on court costs to see what the end result would be,

 

if it fails (as it should) then ok. if default get removed it will open a massive window for us all

This is exactly my aim with my hubbies claim!! Hopefully it will give Cabots some trouble!! (no less than they deserve?)

 

Make them prove it and then if they can't make them remove ALL data from CRA's and sue them for damages, defamation of character, misrepresentation (I am sure there is a bundle to go at with them) Judges at the Courts aren't at all impressed by these illegible application forms that companies keep coming up with.

They don't have the right to default anyone without a proper enforceable CCA agreement wuth all the prescribed terms and conditions in place.

 

Only having signed an application is your leverage for getting the default removed.

that why i started new post, this is a test (i'm happy to through court cost down pan) so everyone who has near enough directly involved in this to post in general debt thread with experiance they had of which could be some use to compile info, or bad, i'm going to weigh all posts up and take it from there, they way i see it if you only signed application form for a credit card they dont have the right to "modify" your credit file. i'm prepard to do this for CAGers benefit to help with what CAGers have helped me with (returned favor if you like)

just been readin djdave thread and looked into my notice of assignment a little more,

pont 1 there is a CAB number directly above my address CAB=cabot?

 

point 2 theres 4 lines on bottm left side of notice. letter from cabot have 3 of the 4 lines in exactly same place.

 

point 3 the date of the "notice of assignemnt" (supposedly from OC) is 24 July 2007. the date of the letter from cabot is 24 July 2007

 

point 4 both leeter are exactly the same font and size. I bet that if I S.A.R OC there will be no notice of assignemnt and they are using a different font (OC i know use heavier font)

 

u really recon you process and send letters out in the SAME day cabot? yeah i know u ugly lot read this. anybody would think you are trying to obtailn money by deception.

I picked these letters apart some time ago and can safely say the 2 letters I received were printed from the same laser printer.

Type and Typography
