    • thread title updated moved to overseas debt forum. sadly as they are outside any UK jurisdiction upon DCA rules which state in the UK they must not call employers, there not alot you can do to stop these scammers. make sure you totally make private ALL social media twitter/facebook/linked in etc etc as there no-way for them to findout where you work otherwise so you must have a leak somewhere. find it. your employer details arent even legally available to UK DCA's so how have they found it out to date???  simply write to the BANK informing them of your correct and current address ALWAYS!!. if you want to arrange payment or not TO THE BANK ONLY thats upto you. never ever ignore a Statutory Demand a Letter Of Claim a Court Claimform. if if if any of those ever happen. till then ignore and rewash. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Muggins73 I disagree because from date of service the courts give the defendents 14 days to acknowledge the claim, not 14 working days!!! :p

Yes, that is once you actually commence court proceedings.

However, rosey-789 has only just begun on her journey, and I'm looking at the whole picture, that is if it ever did get to court.

The 14 days at this stage is all about being fair and reasonable, you do not have to send the LBA dead on the 15th day, it is your claim, your timescale and you chose to proceed however you wish, as long it is not dictated to by the banks!!!!!

This is my opinion and mine alone. I am on my third court claim, following two successful wins, with another against Lloyds pending funding, and my 'fair and reasonable' approach has done me no harm.

Shall we simply agree to disagree?

Thank you muggins . i know i sound a right nuisance lol but to be honest, i'm absolutely cacking myself but with the help from all you lovely people i'm certainly going all the way with it.

 

Should i still give the 14 days as i sent my first letter on the 2 aug by signed for recorded and have checked online each day but it's still not showing up whether it were delivered or not.

Hi

Give them 14 days from when they would have received the letter, don't take any notice of the Royal Mail online thing, Lloyds are having so much mail delivered they can't possibly sign for every letter. I'm with RR on this one (sorry Muggins:) ) I would give them 14 calender days.

Lloyds TSB have recently announced on their website that they are suspending dealing with or resolving claims for unauthorised overdraft charges whilst the test case is going on. They also say that they will contact customers as soon as possible once a decision has been reached on the test case and tell them how they will resolve the complaint, that they will apply the decision in court to all complaints they recieve.

Hi everyone.

 

Well i've received my first reply today from Lloyds and now don't know if i have to wait until the test case is sorted as they say they are asking the courts to suspend all cases until then. please advice on what i should do next please.

Hi Rosey-789,

 

I haven't looked at letter but guess it's pretty standard. The advice on site is to carry on with your court claim, as then you will be in the queue already when it comes to the OFT case being sorted. So if you haven't already, you need to send them the letter before action, and if you have done that, then start proceedings.

 

Still right in this aren't I? (anyone out there)

I'm rather worried now as i received a phone call from Lloyds asking me if i could take some time with them to answer some questions on regarding bank charge claims.

 

I told them i'd rather not do so , i'm now worried i've done the wrong thing.

Red - if you have a default notice issue as well - which has been caused by the charges. Otherwise to not include this part.

 

Blue - only include this if you intend to do it. Don't make empty threats

also dont forget to add in the list of yr charges!!

Hi.

 

I sent my 2nd letter by recorded delivery which they received and signed on the 22nd august

 

I'm sure the 14 days were up on the 5th September but i still having received a letter back from Lloyds TSB.

 

I'm stuck as to what i do now

stop panicing lovey, it just aint worth it you'll get nothing but wrinkles!!!!!

 

The 14 days are given as a guide, and is meerly as a goodwill jesture on your part so that the judge can see you are being fair and reasonable. It is your timescale after all, one that you can choose to stick to regimentally or not. There is nothing wrong in being a few days out and will not affect the outcome in the slightest.

 

You can chose to wait for Lloyds response, which given the way things are progressing with court claims these days will be when hell freezes over, or you can start court proceedigns as barty has so kindly advised you. It is entirely up to you.

Hi thanks barty/muggins :)

 

I've been to Newcastle Law Courts to see if i was entitled to legal aid and they said yes so gave me the forms to carry on my case against LloydsTSB .

 

May i add they were really helpful with me and told me not to worry :) (i'm very much a worrier lol)

 

They also told me that my case won't be heard until next October , they are finishing the ones they have now, so a bit disappointed with the wait but never mind.
