      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right, today we have received another couple of nuisance calls from these goons asking me to ring them back immediately quoting a case number.

 

I like it when people ring me with a military manner, it makes me feel like my life is totaly being controlled by someone else, not!

 

Anyway, I was expecting this as they`ll probably want to discuss the recent letter and want me to explain it in laymans terms.

Hi all,

 

Doesn`t look like these Richard Craniums can read, or if they can read they didn`t understand the letters.

 

Today we received another 2 calls.

 

It seems they have a pattern now, of ringing with a blocked number which shows up as `Out Of Area` on our phone, followed by a 0800 number with a stupid message asking for me to ring them back immediately.

 

I can`t beleive adults can be so numb in the head!

Evening all,

 

Right, these idiots have rang again today. They are simply thick as (you know what) as they obviously still think I`ll speak to them.

 

I think it`s now time to fire off a compliant to Trading Standards regarding Argos for asking these irritating, empty headed knob jockeys loose.

 

Fuzzybobble mentioned on his thread (sorry if I got the gender wrong) that Argos seem to take Application Forms in store, then fax them off to the Head Office, then shred the Applications some 6 weeks or so later in store.

 

Now, if that is the case, that could be why they only send me a dodgy scan of a single sided application form. Do they not an my permission to forward my details onto a third party? Could I not also complain to the Information Commisioner?

 

If anyone could help me with a letter to Trading Standards and the Information Commisioner then that would be much appreciated.

 

Does anyone know their address? Or could I send them a short email to see if they would be interested in looking into it for?

 

I look forward to hearing from you guys and gals on this.

Right, I`ve had another couple of calls today from these bell ends.

 

Does anyone have anything I can throw at Argos, asking who they think they are getting all these knob jockeys to hassle me, sending me junk mail and making themselves a nuisance on the phone, clogging up my answer machine with some Scottish ****? No offense to nice Scotts there though ;)

No, I haven`t sent anything to TS, not really sure what to write.

 

The balance is approximately £2600.

 

Yes, there are charges applied, BUT, there is also PPI, and on their Statement, but are added together and shown on the same line as one sum titled `Other`, not Missed Payment and Payment Protection Insurance, but `Other`. Dodgy eh?

 

Someone posted to me somewhere, not exactly sure where, that Argos had a habit of asking you to fill in the Application Form in store, then faxing the form off to Head Office, and keeping the Application Form in store for approximately 6 then shredding it.

 

Now, I wonder if that is the case, as this account is 5 years+ old now, and all Fredrikson International sent me was a dodgy photocopy/scan/faxsimile looking front page, only the one side and not both.

 

Any idea`s with this one?

 

What about a Laymans letter to these morons, Take Me To Court or F*** O**?

 

Just another thought. What about asking Argos what gives them the right to pass my details and information to third parties and ask them for a copy of whatever they have stating that? Could be worth a try to see exactly what they have.

It just seems N.P that you have written 20 million letters to this company and they are just ignoring you.

 

TS do have a thing about following a company's complaints procedure before they intervene.

 

Have you done that with regards to the lack of CCA? I would perhaps focus on that 1st so it's clear to TS what your issue is.

Yes that's what i mean! Complain about whoever's given you the most grief.

 

Boxclever with your complaint to TS. I found that a gentle, but clear approach worked for me. I laid out my case that i was endeavouring to establish the full details of the account and had asked for a copy of the agreement. Despite numerous letters, my request had not been satisfied. I also included the telephone harrassment - despite written requests to contact me in writing, this had been ignored. Include any log / record you have of calls. I quoted the relevant bits of the OFT debt collection guidelines for this.

 

TS wrote to the DCA and told them to confirm whether or not they held the CA and to contact me in writing only. They stopped contacting me for nearly a year and have only written 2 hopeful letters in the last 2 months ;) When i have dealt with my court case i shall deal with this :)

Thanks for that, I haven`t sent these bozo`s a telephone harrassment letter yet, I don`t think there`s any point as they can`t read.

 

The other half has been logging down when they ring most of the time, as they ALWAYS ring when I`m at work, and when they do they always use the same pattern, two calls, one with a number withheld and one with a number showing.

 

I`ll get a TH letter away to them sometime this week, and see what comes next, then I`ll start a complaint.

 

Do I need to ask BJ for their complaint procedure, and then if I don`t get any sense from them, then make a complaint to TS?

 

Would that be their local TS?

Hopeful is absolutely right about TS, use your local one and if needs be they will communicate with BJ's local TS. Chances are you've already abideded by BJ's complaint procedure but its worth asking for a copy to see what it says.

What about a letter directly to Argos complaing about the idiots they have been asking to chase me up? I can`t see of read any permission for them to give my details to third parties on the dodgy form they sent me.

 

Could be worth seeing exactly what they have on me?

 

Could anyone help with a suitable letter?

Not being legally entitled to collect a debt comes under the OFT debt collection guidelines - psychological harrassment section.

 

You could say to Argos something to the effect of: i am writing to inform you that a formal complaint is to be made against BJ for their non compliance with CA etc (quote your timescales, use quotes from CCA '74 / OFT Debt Collection Guidelines BJ have broken - look at unfair business practice bit). I will also be addressing the unreasonable number of 'phonecalls that company has made. Their actions contravened OFT DCC(quote relevant section.)

 

I felt it was only fair to warn you of this complaint as you are ultimately responsible for the actions of 3rd parties instructed by yourselves.

Obviously this is off the top of my head and not very legal. In such situations i do tend to keep things very simple and just give them enough to make them think i know what i'm talking about :p

Forgot to mention, they sent this 2nd Class in an envelope which had a hand written address on it, so it looks like they are scraping the bottom of the beer barrel with this time around :rolleyes: Not to mention it was from April 2007.

 

Think I`ll send it back with `IDIOTS` printed on it

As long as the return address is on the envelope it will if you write on it 'return to sender' then write junk on the statement.

 

Don't know what to say for the telephone, there are plenty of regs they should abide by including not ringing when you say, but do they ever listen?! Nope.
