Hi Al.

I've not yet sent my LBA. I toyed with it a bit over the weekend after reading what Kevin did and have put a draft on my thread for comments. I will be sticking in the post and possibly emailing today. Let me know what you think.

So, Will Tommy have received your email? Let me know if you get a receipt/ reply.

Thanks

I am very confused about what interest rate to charge and what to charge it on. I have been reading threads and am even more confused!!

I sent the statement of charges including 'every' interest charge I had received and applied no cumulative interest?!?!

I now realise I can only claim overdraft interest of charge that took me overdrawn.

I have worked out how much of the charges have taken me overdrawn and have tried the spreadsheet but maybe I am just really daft!

Can anyone help me with this? I just want something simple (like me obviously) to use to work out what percentage of charge and what on I should use??:o

Any help would be appreciated

Did anyone see the discussion on GMTV this morning about unfair bank charges, it was brilliant!!!

GMTV - Are you the victim of unfair bank charges? Get advice from Martin Lewis of MoneySavingExpert.com

Martin Lewis really kicked their butts! There is also part of their website dedicated to claiming charges back, and CAG is their too! Well done CAG!

Reclaim unfair bank charges: don’t let them keep your cash! | MoneySavingExpert.com

I particularly liked the comment he made about how the banks think it is fair as they let you know they are going to charge you, his reply was, I could let you know I was going to punch you in the face before I did it, but it doesn't make it legal!!!!!

How great, keep it up!!!!!!!:D

Hi Alison.

Just to let you know I receiver my first offer on Saturday from Ross/ Tommy.

Just over 50%. Good to see the wheels of commerce are still moving, but to be honest, they must know that we will only settle for the full amount.

Oh well, its "partial settlement" letter time.

Can anyone help me to fill out a claim in the Scottish courts.

I found the website and it states the claim cannot be over £750.

Is it right I can make 4 seperate claims, and if so can I send them together??

Also what address did anyone use for the RBOS to claim against? I thought about the head office at Gogarburn, but wanted to check what everyone else did?

Thanks for your continued support, this website it the best!!

hi there, i tried to make my claim against rbs through money claim online but they said I cannot make a claim against someone or a company in scotland. they advised me to go to my local court which is what I did and got the ball rolling. I dont know if you can make more than one claim at the same time. I used the address of their head office in Edinburgh

Hi Alison,

Claims in Scotland can be between £750(small claims) and £1,500(summary cause) both forms are almost identical but I think If you loose using summary cause it could cost you up to £750 in fee's where as it will only cost you £39 if you were to loose using small claims. Nobody has lost yet so I'd use summary cause if I were you.

Only put 1 claim in at a time, I think this is quite important.

Have a look above your post for contact details for RBOS.

Hope this helps.

Scott.

Any advice I give is honest and in good faith.:)

If you're doing a number of smmall claims, don't do them all at once, or the bank will probably ask the court to do them all together, and then it won't be a small claim, but more expensive.

BoS:- D P A sent 09/06 Prelim. request 29/06 £1755 plus interest

1st claim Filed 5/10/06 SETTLED 19/10 £747.80 plus £534.31 interest

Faxed/ emailed my conditional acceptance today. They have offered full amount on the understanding that "all future charges stand etc....etc".

Cant agree to that. So we'll see how quickly money is credited to my account. Nothing in today so far.......

I got a reply from Mr McLean (what a guy!) on Friday offering £695, from a claim of £1060.

The wife was anxious about taking it further and got me to sign and send the acceptance sheet off and we are now waiting on the amount being paid into the account. Is it too late to still claim for the rest? I'm assuming yes as we've signed the acceptance but thought it worth asking.

Should never have backed down to the missus on Friday, it's been bugging me ever since that they're going to keep the rest of my money!

Also, what about charges that I have accrued since I began this process/in future - can I claim them back also, or is this part of their terms of settlement?
