      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I now realise I can only claim overdraft interest of charge that took me overdrawn.

I have worked out how much of the charges have taken me overdrawn and have tried the spreadsheet but maybe I am just really daft!

 

Can anyone help me with this? I just want something simple (like me obviously) to use to work out what percentage of charge and what on I should use??:o

Did anyone see the discussion on GMTV this morning about unfair bank charges, it was brilliant!!!

Martin Lewis really kicked their butts! There is also part of their website dedicated to claiming charges back, and CAG is their too! Well done CAG!

Just to let you know I receiver my first offer on Saturday from Ross/ Tommy.

 

Just over 50%. Good to see the wheels of commerce are still moving, but to be honest, they must know that we will only settle for the full amount.:grin:

 

Oh well, its "partial settlement" letter time.

Can anyone help me to fill out a claim in the Scottish courts.

I found the website and it states the claim cannot be over £750.

Is it right I can make 4 seperate claims, and if so can I send them together??

Also what address did anyone use for the RBOS to claim against? I thought about the head office at Gogarburn, but wanted to check what everyone else did?

hi there, i tried to make my claim against rbs through money claim online but they said I cannot make a claim against someone or a company in scotland. they advised me to go to my local court which is what I did and got the ball rolling. I dont know if you can make more than one claim at the same time. I used the address of their head office in Edinburgh

Hi Alison,

 

Claims in Scotland can be between £750(small claims) and £1,500(summary cause) both forms are almost identical but I think If you loose using summary cause it could cost you up to £750 in fee's where as it will only cost you £39 if you were to loose using small claims. Nobody has lost yet so I'd use summary cause if I were you.

Only put 1 claim in at a time, I think this is quite important.

If you're doing a number of smmall claims, don't do them all at once, or the bank will probably ask the court to do them all together, and then it won't be a small claim, but more expensive.

Guess what!!!! I WON!!!!!!!!!!!!!!!!!!

Good old Tommy boy came up trumphs!!!

After I received the first 'offer' I wrote back saying I wouldn't charge the 16% on top of claim if they paid the rest within 7 days!!!

I got the full charges amount!

Chin up guys!!! They are paying out a lot quicker now!!!!!!!!!!!!!!!!!!

Faxed/ emailed my conditional acceptance today. They have offered full amount on the understanding that "all future charges stand etc....etc".

 

Cant agree to that. So we'll see how quickly money is credited to my account. Nothing in today so far.......

I got a reply from Mr McLean (what a guy!) on Friday offering £695, from a claim of £1060.

 

The wife was anxious about taking it further and got me to sign and send the acceptance sheet off and we are now waiting on the amount being paid into the account. Is it too late to still claim for the rest? I'm assuming yes as we've signed the acceptance but thought it worth asking.

 

Should never have backed down to the missus on Friday, it's been bugging me ever since that they're going to keep the rest of my money!

 

Also, what about charges that I have accrued since I began this process/in future - can I claim them back also, or is this part of their terms of settlement?
