My small claims case against BOS Visa Card had gone to court without them saying they would defend. The day after it was called in court they sent me out a payment for the charges £630, a small amount of interest (£1.05) and £39 court expenses. The letter they sent actually said they had contacted the court saying they intended to defend the case but decided to pay up anyway. The court had not heard this intention from them. However I have since received the 'Extract of Payment' from Dunfermline Sheriff Court and they have awarded 1. the amount of the charges. 2. Interest at 8% annually. -

Halifax Credit Card Advice Please

I have just had success of a kind with BOS credit card. I can't remember off hand but I think the charges have always been high about £25-30 for BOS. They did let mine go to the court stage and speaking to others on this forum that doesn't seem too unusual for a BOS/Halifax credit card claim. I am still waiting to actually receive the money, hopefully it is in the post today and they haven't paid the full interest on the charges but that is another story! -

Yesterday I received the following letter from BOS, Legal Services in Halifax which I will extract from "I have received and have been dealing with the proceedings which you have issued against The Governor and Company of the Bank of Scotland in the Dunfermline Sheriff Court." Then follows the usual about you knew the T & Cs which you accepted. Then "I have returned the form of Acknowledgment of Service to the Dunfermline Sheriff Court indicating that the Bank of Scotland intends to defend your claim." It took about 2-3 weeks for Dunfermline Sheriff Court to serve my small claim on BOS. Then the return date was about 6 weeks away. Hold on in there, it will be worth it.

Have just contacted Dunfermline Sheriff Court as return date was yesterday (April 10th) they have had no reply from BOS card services, they will not be defending the action. They said I should write a letter to the court rather than still having to appear. Has anyone else been at this stage and how long will they take to pay what is due? -
Has anyone had more than one claim settled on the same account?

Yes I have had two claims settled. I still had to raise a small claims action for the second one but they settled at the same stage, a few weeks before the return date. I am now awaiting a settlement of my BOS visa charges. I have raised a small claims action for this too! Good luck hope you don't have to wait too long! -

At what stage do BOS visa normally pay up. I have filed small claim at Dunfermline Sheriff Court and the return date is 14th April. I know BOS paid up well before the return date for my current account claim not sure what to expect from Visa account as they seem to be handling things differently. -

I just put plus 8% on the court paper but didn't actually work it out. Not sure what to do now might wait to see what any communication says. They are just chancing it really, aren't they. -

Checked my bank account today to find that BOS had paid in £717 claimed for charges but no interest or expenses added on. Court hearing date is two weeks away. What should I do? Have not received any communication from them as yet. I have about another £800 worth of charges to claim which I will pursue once this is concluded. -
I have just received settlement of my first small claim against A&L and I am ready to send Form 11 asking the court to dismiss the case. When can I start second action? Do I have to wait for something back from the court or the original hearing date?

My understanding of the small claims system is that you can only have one claim at a time. You have to wait until the first claim is concluded before you can raise a second claim. I am in the same boat and at first claim stage.

Will keep you posted. The staff at Edinburgh Sheriff Court have been very helpful so far.
