Advise needed RE telephone harrassment

I have been contacted by a dca, who i have asked to stop calling, additionally i have sent the template letter on this site.

 

I have recently, told them , to stop calling and to write me a letter, they say, they will continue calling.

 

I have contacted ofcom, who say there is nothing they can do.

 

Is this correct?

 

anyone in similar position?

Dear Sirs

 

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

 

I have verbally requested that these stop, but I am still receiving calls.

 

I now require all further correspondence from your company to be made in writing only.

 

I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

 

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

 

Be advised that any further telephone calls from your company will be recorded.

Did you send this recorded ?

If so then make sure everything is logged and give trading standards a caal to strt with.

They'll help you out, or at least guide you in the right direction.

I'm in a similar position with NCO.

 

I've reported them to Ofcom - nothing they can do for an individual case but if enough people complain they may get the message.

 

I've also sent an LBA (for both Harassment and Data Protection Issues) so I will shortly have to submit a claim to the courts.

 

I am interested to know what evidence there is to support that this type of action is "harassment" within the legal definition of the term.

 

I have also reported these to Trading Standards who so far seem to be being helpful - they have the powers to enforce the 1970 Administration of Justice Act

Hmmmm NCO and their arm RMA are currently call my wife upto 5 times a day.

Of course we're not answering as they have been told that we will only deal with them in writing.

I've just LBA'd them and expect to start proceedings shortly for harressment.

 

I have made it clear to them that the whole "debt" is made up of charges, but they still have our number in their system.

 

Might consider the BT "choose to refuse" service.

I did look into changing my number as BT will do this as a one off, but then I'd have problems getting my broadband reconnected as it's not through BT.

Hello Curlyben,

 

I changed my BT number just before Christmas last year.

 

It didn't affect my broadband at all! But I would advise your Internet Service Provider of the change just in case.

 

Also, no more unwanted calls to date!!!:):):)

after a couple months of continious phone calls, they have eventually died down

Chose to refuse is an excellent service if you cant be bothered with them, It reall drives them mad. However if you want to build up a case against them then its better to log all their calls. You dont have to discuss the matter with them

Buy yourself a referee's whistle & keep it by the 'phone.

 

When they call again give them a good hard blast from it.

 

It'll deafen the buggers & they won't be able use a 'phone for weeks:)

 

The beauty of it is.......they can do sweet FA about it! :D :D
