    • If you have not kept the original PCN you can always send an SAR to Excel and they have to send you all the info they have on you within a month. failure to do so can lead to you being able to sue them for their failure.......................................nice irony.
    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................
    • Hi,   I am not sure if I posted this already here but I don't think I did. I attach a judgement that raises very interesting points IMO. Essentially EVRi did their usual non attendance that we normally see, however the judge (for the first time I've seen in these threads) dismissed the notice and awarded me judgement by default because their notice misses the "confirmation of compliance" paragraph. in and out in 3 minutes (aside from the chat at the end with the judge about his problems with evri) Redacted - evri CPR loss.pdf

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sorry ive not replied but im at work and im sooo busy!

 

Ok, the courts have been really really busy and I know in some courts the paperwork hasnt been going on the system for up to 3 weeks later. Its not the courts fault (even though 3 weeks is a long time!!).

 

The banks are playing a game with us but we just have to keep calm and play with them - we are all going to win anyway so you just have to take each day as it comes. You will get your money back!

 

I never received anything from my court for ages. I waited for about 6 weeks from when the bank acknowledged my claim for a court date so i know exacly what you are going through. All banks are applying for Stays anyway so its more than likely that your case (as well as mine!) will be stayed until after the OFT case. If we are lucky we might get paid out before then so fingers crossed!!

signature only works after a minimum of words - 100 i think or maybe 50.

anyway short posts don't do it.

 

it's really a frustrating thing - but the courts have always tended to give them more time anyway - but for them not to know it was there all along isn't very good workmanship, i'd agree.

 

now, you just have to hope you don't get a stay - because with the oft thingy all cases are getting stayed - then the best shot you have is to ask for it to be removed - just check a couple of the other threads around - you'll see the letter and the N244 instructions to get the stay lifted if it is applied. we keep hoping a few more will slip passed the solicitors - so good luck ---- not complaining but why are you on hsbc forum if you are halifax? you've most welcome here - we like everybody! just curious.

so has anyone actually got their stay lifted then?, im doing a hsbc (mine) and halifax (partner in crime) so double the work load.!!

 

i thought that pontefract were really efficient because id recieved my notice of aknowledgement for my hsbc claim but no word about the halifax one, so i thought, and even got it confirmed that they hadnt aknowledged!!!,

ive been reading that most claims are being stopped after the defence has been filed i will just have to keep my fingers crossed. but i seriousley think it has a lot to do with the amount of pressure (work) the courts are having to do, and banks.

 

is there anyword on how long we should expect to wait for the oft's decision?

 

im so hard up for cash at the mo its untrue, i want mi monnies.

so i take the recent claims that are not being stayed will be in the sucsses stories then.

 

court are actually confusing me a bit regarding timescales, after they put in a defence, i wait to hear from the court about aq dont i? then (fingers crossed) i get a date and start nudging solicitors??

 

i really cant believe all this staying business, after all our hard work,

i ahd offers too, shocking , but offers none the less, is the general consensus being to take offer at mo?

"Following a request from the OFT and the banks to put a stay on all Bank Charges cases (i.e. to halt them until the test case is finished); the Master of the Rolls decided not to issue an order staying all outstanding cases.

Instead he asked the Deputy Head of Civil Justice to write to all Designated Civil Judges, (which he has done) inviting them to consider staying outstanding claims on a case by case basis as appropriate.

Designated Civil Judges are the senior circuit judge responsible for a group of courts. (S)he may agree arrangements with the district judges sitting at each individual court. Therefore whether as case is stayed or not is a matter for the Judge in the individual case."

just read on martin lewis site (hoping to get more info), that an offer of settlement from the bank lasts 2 months. is this true????????:-?

If you have an offer direct from hsbc then you have a time limmit to accept. If you don't accept within that time limmit they will consider it as a refusal of the offer.

i have seen 14 days and 7 days but not 2 months. If you have had an offer it should say on the letter how much time you have to accept.

do you know if banks are offering? or refusing to pay out at all pending the oft thing?

 

i would have thought that they would use this situation to settle some claims as cheap as they could.

Hi Sarah. I hesitate to put my ten cents' worth in at this late stage, but isn't there something (fudged obviously, knowing this government) about 'hardship' cases getting precedence?

 

Just a couple of other points about your thread. I'm really surprised to hear about unhelpful court staff. They are usually extremely helpful even though they will not give legal advice. Maybe you should try again?

 

Secondly, you did know that limbo no longer officially exists?

you can look at skintcumbrian's case to see how that worked out - she tried the hardship thing and they brought in the big guns to shoot her down - presumably to nip this in the bud. anyone thinking of it should look at all her posts.

as for the offers - pre OFT announcement - offers were generally given for a 7, 10 or 14 day period - since the oft - hsbc has said they are giving 2 months for people to accept or reject the offer. anyone who had an offer before the oft ann. and rejected it and now wants to accept - i think they will be looked on favourably as it is one less case to deal with if they loose and as it is generally about 85% of your charges and no interest - they are usually happy for people to accept that and go away.

whatever floats you boats - if you'd be happy with the offer then i'd say write - as pete and freaky say - nothing to loose by asking.

vander...i dont think i would win due to hardship im on wftc wich are not from the benefits agy, but dwp.

 

i have looked at skintcumbrians thread and to be honnest it frightens me a little, and i think i would get back to the stage of an offer at 85% no interest.

 

rang and spoke to hsbc and they are sending me the offer out again, still not sure what to do and i know only i can decide, but i feel like ive done half a job, on the other hand 85% is 100% more than i would have got if i hadnt started this journey. so i suppose it is a small victory.

 

i will tell all how i got the offer, after i have the money in bank.

 

but then i suppose offers may not be so hard to come by thease days.

 

ive been really thinking about it, and i see the oft test thing going all the way to house of lords, and so on, and i just cant wait im sorry.

 

meanwhile somewhere deep deep underground.........

 

im thinking of starting the ball rolling with welcome finance and gmac, does anyone on this thred know if (like banks) a morgage (spelling?) company would close ur account if u tried to claim back ur charges whilst still with them?

 

cos if they do then cant possibly bleed money out of them can i?!

Sarah, if you get a payment then you have won! Well done on pushing them and if you get 85% then so be it. Once the test case is over you may have received less anyway, depending on the amount the court deem as "a fair amount" for these charges!

Sarah on the hsbc website there is an announcement. yes any offer made prior to the july 27th Waiver will be honoured for 2 months............

 

you coudl also have a look at the corts own complaints procedure............ The Civil Procedure Rule, this clearly sets out their own timelines.......... Make a complaint via that way...........

 

Email your MP............comlain to the OFT, despite the "waiver" the more people who do complain about the abuse of the system still going on, the more pressure they will com eunder.......remember this waiver if in the first instance for 2 months.........

there have been that I know of on this thread alone in the past 7-10 that many cases settled............ the numbers have been posted.............

the more ppl who complain the better one of the conditions of the "waiver " is that ALL cases adn negotations are suspended..........

 

Erm if they are setteling cases then they are breaching those conditions...........:):):)

hello all,

 

have decided i will take the cheque when it arrives, the more i think about it the more logical it appears.

 

just wondering, what do i tell the court?

 

on the other hand, they have until today to file defence, if they havnt i will send the req for judgement, but court have advised me that a req for judgement is not high priority mail and they are taking about 15 days at the moment to get through the back log, therefore that gives hsbc more time to get their defence in.

worth a try.

 

with my patners claim i have today recd the aq. does anyone know where the guidance notes are? i do not have to pay the fee.

 

the courts also said at pontefract that when the aq's are returned they are transferring all cases to leeds, i think their still operating normally.

 

am going to ring court to see if a defence has been filed, i wonder if i handed the form in at the office they could open it and deal with it there and then.??
