They can fight for the full 40 days, but most people get them at this point. The non compliance letter normally does the trick if not...

Don't forget to add up the cost to charge them for postage if it goes to court.

But I know they received it because they signed for the SAR on 7th March. I didn't receive any reply at all from them. I've seen the electronic proof of delivery. So this morning I posted them two copies of the same letter, both recorded delivery.

 

In it I stated the dates involved and gave them the tracking code to check themselves and proceeded to tell them they had 7 days to give me my statements or off to court we go.

they also lost mine and kept saying they had not recieved it i kept ringing twice a week they had two days left to reply and in the end a nice lady has it happens sent them out for me got them next day so keep ringing it does work the number i rang was 01422 326398 keep redialing you will get a human in the end ask for louise she sorted mine out good luck

So you know they recieved it on the 7th March, so count your 40 days from then, regardless of whether they said they got it or not.

 

So the 40 days were up on the 15th April.

So now send the non complience to give them 7 days before court action.

Also some times a phone call telling them you are prepaired to go to court to get them can make them suddenly remember to send them!

You count it from the day after you post it. And on the 14th day you send the next.

thanks for that .the bank are still applying bank charges which is making me overdrawn rang them to see if they would make an arrangment to pay them said have got to go into my branch and they will sort something out will this affect my claim

Well any charge you recieve keep adding them to you spread sheet. You can do this up till you file at court.

 

Im not sure what they will do at the branch, they might be able to put a hold on them. But unless they give you your full amount of charges back, you just carry on as you are.

print out confirmation of the receipt, and carry on the process of LBA's, remember the 40 days start from the point of receipt.

Yeah, I know it's their fault they lost it. I tracked the letter on http://www.royalmail.com and sent them the tracking code along with the LBA so they can see the electronic proof of delivery themselves.;)

 

Sent two copies in seperate envelopes both recorded delivery, just incase they loose one.:rolleyes:
