HI all

 

First of all many thanks to those that run this site, it's been invaluable over the last few months and has brought me to the situation I find myself in today.

Having downloaded completed and sent off the approriate letters to Nat West I received my first response from Nat West bank this morning offering me full settlement of £2,366.00 for all the charges I have accrued over the last 6 years.

Now I know I should be celebrating the fact that I havent had to threaten them with court action and their first response has been a favourable one but my question is this:

Should I hold out, add the 8% interest and claim back the total amount which comes to over £3,000.00 or be gracious and accept their offer?

Am I just getting carried away and being greedy?

I'd say accept - the courts don't favour folks who just go after the interest.

If the offer from Natwest is for the full amount ENJOY:D

Congratulations too!!!

If you decide to send back your acceptance letter (even though a pre-paid envelope is provided send it recorded delivery so it doesn't slow down the money being put into your account) It's always good to have proof.

Natwest : Witholding my statements & adding defaults etc , S.A.R sent Jan/08

Natwest for my partner : £2,101.00 won! Feb/07

Studio Cards : Refund for admin charges £108 Won! Dec/07

Complaint made to FOS for P.P.I Jan/08

Nationwide: S.A.R - (Subject Access Request) sent for statements Nov/07 ( waiting to see what happens in the OFT test case )

Littlewoods : defaulted on CCA request Feb/07

DCA's that crawled out from the woodwork and have crawled back : 28 so far!!

Just as a point of interest how long was it between you first claiming from Nat West and them offerring you full settlement?

I think your right I just saw pound signs flashing in front of my face....

I should take whats offered and enjoy.

PPman I requested my statements in December '06, and sent the PAR letter on Feb 26th so it's been a few weeks but not as long as I expected.

I cant believe I didnt have to threaten them with court action, what a way to start a Bank Holiday weekend.

Thats not bad-I have been going at tyhem since November and have now lodged a claim via MCOL.

 

Anyway enjoy the money and dont spend it all at once!!!!

I agree a great start to the Bank Holiday weekend:D

I sent my SAR off in December and my LBA on 7th March and had a full offer on 20th March PPMAN if that helps!

I'm still waiting for the money to go in my account though...lol thats a whole new saga they forgot to put me on their internal spreadsheet but it seems to be sorted now:D

Brunette21, NatWest bank have settled on the charges and a court can only award interest so not to take the settlement means you have no case.

dont accept the offer, you want the full amount..... they will pay up

i read on a thread that if u get offered the full amount b4 court action u have to accept this offer as the bank has given u what u asked 4.I might be wrong soif any one advise on this with a definate answer it would be helpful to others with a similar dilemma

The definitive answer seems to be that if you're offered the full amount before going to court (e.g., minus the 8% interest) accept it. Only the courts can award the 8% anyway........... so the best advice is to take the charges!!! Makes sense to me :D

this site is like a dan brown novel once you start reading you can't stop, im turning into a bank charges info sponge,just keep on soaking up the info,ive got 6 friends going through the process (all at lba) and they find it to complicated so they just ring me and i print letters and advise where i can if i dont know the answer i come back here and read and read and read so i dont want to make silly mistakes.

Hedgey I don't think we have to worry about Tony Blair, look at what Gordon Brown has not dun for us, especially on he pensions front. and they reckon he will take over, NOT, if I have anything to say about it with my vote. LOL

The Tories are no better and Cameron just seems to jump on any old bandwagon that comes his way.

 

I agree that we do not need Gordon Brown but maybe it is a case of better the devil you know.

Hmmm....

 

Now i have had the same kinda thing and am debating whether to write to natwest to say I will only accept their offer if they include the overdraft interest they have charged me NOT the 8% or contractual rate. My reasoning behind this is they have earned interest out of the money they have removed from my account in this time. my offer was £1151 which is the total of the charges ONLY with O.D interest the total is £1229.74...... only £80 (ish) difference, but that money means alot to me!!!!
