You could get nasty and send them a version of the below (you know the local area so change what needs to be changed). Unfortunately the people who are replying are having to comply with the company policy which is being foisted on them - which is not to cancel tickets. But you might as well send the mail and try.   Dear Cissy, thank you for today's mail. Of course you are "able" to cancel the charge, you simply contact Excel and tell them to cancel the charge. I will wait for exactly 24 hours and then contact the local newspaper XXXXX and the local radio station XXXXX about Iceland's disgraceful disability discrimination.  Nothing much happens in Gravesend so I'm sure both will be happy to do a piece which will generate terrible publicity for your store and drive away customers, which is exactly what you deserve.     • You are absolutely right to be cautious. It would be helpful if you will be prepared to send me a private message containing details of the outlet and the address et cetera. It might help me to get things more into perspective. So I understand that you had a business selling your husband's photographs. You were unable to continue your direct involvement and so you made an arrangement with a manager who you trusted to carry on the business for you while you were recovering elsewhere in the country. Is this correct? This manager has possession of all the files of your husband's photographs. Is this correct? Do you have any copies of the files? You made a reference to having a Co-op. Does that mean that you are running a Co-op supermarket or groceries outlet? I don't quite understand here. In terms of the possibility of continuing the arrangement with this manager – my own view is that you need to bring the arrangement to an end and I don't see how you could trust them. As far as I can see you are asking about two issues. Making sure that the files in the manager's position are destroyed so that you regain control of the photographs. Obtaining some damages for the loss of revenue. How many photographs do you believe are in his possession? What you estimate is your loss of revenue so far – probably calculated on your average revenue over, say, the five years before you stop your involvement in the business? You are talking here not only about a breach of contract. You are talking also about breach of copyright and frankly you're also talking about theft. Additionally, if you begin the dispute with this person, I would say that they will probably leave immediately. Have you got somebody else to run the business or would that be the moment that the whole thing collapses? If it is the latter, then this is something else that you need to prepare – somebody to take over as seamlessly as possible   Also, do you know the address of this person – and do they own their own home or any other assets?  
    • Just as i thought (from above post) : i just hope this is not the normal customer service that say they cant do anything and that you have to appeal to excel parking 🙄 this is the response my friend has received today - totally ignoring the subject which was: 'victim of disability discrimination on the part of your agents' does anyone have any ideas to reply with please?     Thank you for your response.   I would like to apologise for the error in the previous email; our CEO, Tarsem Dhaliwal had received your email and tasked ourselves in the Executive Resolution Team with looking into this.   We have raised this with our internal property department who have more information on parking charges and any appeals, we can see that you had appealed the PCN with excel which was rejected, you then appealed the PCN with IAS which was also rejected.   Because of this, we would not be able to cancel or refund the charge.    I understand this may not be the outcome you had hoped for, I am sorry for any inconvenience caused.   Kind regards, Cissy

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

In my absence, receive a letter from the Information Commissioners Office informing me that my case has been passed onto their Regulatory Action Division for 'further consideration'

 

I had been wondering by this time whether the sudden and mysterious arrival of all my statements had been due to my Information Commissioners Office complaint, or my issuing court proceedings via an Application Notice (form N244) for a Pre Action Disclosure Hearing.

 

This seems to suggest that it is a combination of both, perhaps drizzled with a little cockiness, given the test case and OFT/FSA arrrangement, that they might not now have to cough up at all, so they may as well send the data? who knows?

Receive letter from Information Commissioners Office - case has now been passed to a Remedies Officer:

 

Dear Mr. Boy

 

Since Halifax Plc has still not provided you with a complete response to your subject access request the matter has been referred to the Information Commissioner's Regulatory Action Division.

 

As you are probably aware Halifax PLC is part of Halifax Bank Of Scotland (HBOS). I have today written to HBOS requiring them to provide the outstanding information or explain why this cannot be done.

 

I have asked HBOS to respond to my letter within 14 days.

 

You should be aware that Halifax may not have retained information that is over six years old as they are probably not obliged to do so (my emphasis).

 

I shall be in touch when I hear from HBS

Why are they pre-judging the law here? I know they are the regulators but surely it isn't their job to speculate on the law? Anyway in my case it's it's irrelevant as they appear have coughed up everything.

 

Although I now appear to have all my current account data, at this stage I am still missing a large swathe of my Credit Card information.

Receive a package from Halifax containing virtually all my credit card statements, barring approximately 3 months from account opening (August 1992). Am still going through them to check.

Receive a telephone call from the Halifax. Very pleasant and informative gentleman asking if I had received everything. I told him that I was still in the process of checking. He gave me a direct telephone number and told me I could call him anytime with any questions; and to report to him immediately should I be missing any information.

Now I am coming to terms with the fact that I have, through sheer persistence, cheek and bloody-mindedness (not to mention the support of everyone following my story on here), succeeded in getting past Ms. SixYears Thatisall, I'm wondering what I need to do with my Pre-Action Disclosure hearing, which is still scheduled for 23rd October

  • Do I cancel it?
  • Can I cancel it
  • Is there any way that I can still proceed with it in order to recover my costs?

from what i can gather halifax has the biggest data base more than most banks put together so i am sure they will have all the information you need
They may indeed - but it's taken six months of stress and pain on my part; with a huge dollop of misleading information, obfuscation and downright dishonesty on their part, to get it out of them.

I would be inclined to not discontinue the hearing until you have indeed verified that you have all the information requested, and until you receive the missing three months of your credit card statements. Not sure what the procedure is for discontinuance but will read up when I get home.

 

Amazing what the fear of disclosure can do to an organisation!

 

I have just sent a Letter Before Action to Citi Cards, as they have failed to comply with my DSAR in full. Hmmmm…………..

 

I’m pleased you're back now and so is Dusary. Los Tres Amigos are reunited and everything is right again in the world :p:D

well done macboy! they dont make it easy do they?! It took me 6mths to get all my data off halifax (back to 1988) it was unbelievably hard work. In the end I got it from the branch where I opened the account - can you believe it?! In the form of an investors report, so it takes some wading through. Haven't yet filed a claim tho' - have been seriously put off by the test case situation... Not sure whether to go for it! Will be watching your thread closely - all the best x

HM revenue & Customs; demand for WTC overpayment £632.12. Disputed, their error. Did not have to repay.

Would just like to say well done,Iam having some problems myself regarding old accounts but it's with Clydesdale Bank.

I received some statements dating back to 2001 6 different accounts i have been receiving duplicated copies of the same accounts and nothing from others, wrote and complained to Information commisioner and guess what they sent the same info again so far I have received

4 x 123 account

3 x 234 account

3 x 345 account

2 x 456 account

it's ridiculous.

If you don't mind can I borrow bits of some of your letters.

Fill your boots. And good luck - give me a shout if you get stuck. If you don't get what you want - write again to the Information Commissioners Office.

 

The duplicates are extremely frustrating I know, but once they realise that you're not going away and have the Information Commissioners Office on your side and/or a Court action to force disclosure (as with myself), you should find that you start getting meaningful data.
