    • Ive just checked the tracking again and its actually out for delivery today! Anyway,  I refunded the buyer on Ebay off my own back on the 2nd of June they havent opened a case or anything like that so surely i cant take action against either the buyer or P2G/ Evri can i ? Id hope the buyer would see fit and pay but you know what people are like these days ... Once its delivered I'll send him a polite message asking for payment but i suspect there'll be no reply      
    • Thanks for this update. Let's not if you have any more difficulty – in particular if you have difficulty getting paid back from the purchaser. We can help you either against the parcel delivery courier or against the purchaser
    • I'm still waiting for them to kick out sunak and bring Johnson truss and farage in late as it is - as an act of desperation. Tossuss and some others as well as those who were (alleged) brokering a farage ennoblement deal are promoting it aren't they?

So after a 14 day investigation with p2g i had a live chat with them yesterday ( 8th June) who said they didnt know where the parcel was but closed the case as i didnt take out their protectiove insurance.  So now at 07.33 on the 9th of june i was repling to this thread with all the relivent information to start a claim and i check the tracking of the 'Lost' parcel for specific dates to find the tracking has updated and the parcel is now at the recipients local depot  ? which is annoying because ive already refunded the buyer as i didnt want any negative feedback as it was an ebay listing and id want a refund if i was in his postion. So i posted the parcel with Evri on the 20/5/24  The delivery date was missed due to it being sent to the wrong depot and a case was opened on the 25/5/24 14 Investigation failed to locate the item in Evri's system and case closed on the 8/6/24 and now the tracking has updated on the 8th saying its at the recipients depot so is likey to receive it in the next few days .... Typical.  Oh well nevermind , thanks everyone

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm absolutely fuming today!! Things have been a bit tight over the last few months, and I've only just been staying within my overdraft [and the £25 buffer] limit. I received a letter today from internet banking to say that there wasn't enough in my account to pay a £20 s/o [this was due on Weds], so I phoned the company I owed it to and paid by switch today [payday]. I also had a couple of other dd's due on wed. These went out, but it must have took me beyond my buffer zone. I only realised when I've checked my internet banking today.

 

What's got me really angry though is the fact that they've slapped a £25 'unauthorised o/d fee' on yesterday. The following points are what's really got me annoyed:

a] According to my statements unauthorised o/d fees are £8 per day, and £25 just shows as charges.

b] I can't find the terms and conditions, but I'm sure I've seen it somewhere in the bumph I've had that they write and give you advance notice when a charge [other than the daily charge] is going to be slapped on!

 

Any advice on this? And, how do I go about adding this to my claim now that my AQ's been submitted with my schedule of charges?

Thanks for that Blueskies - they've obviously changed it since I last had charges! Am I able to add it to my claim now that my AQ has gone in, or would it be simpler to keep a note of it in case I occur more charges and claim again in future?

Id personally wait until they offer you an out of court settlement and then when they do, tell them you want these charges as well.

 

If it goes to court and you win, which we know you will, then tell them if they dont pay these you will take them to court again

 

(And I still havent had my bin emptied)

Righteo, YB have sent me a copy of their AQ today. They've said that they wish further action to be postponed for a month so that we can attempt to settle - I take it I just sit back and wait to see if they contact me know to pay me my dosh?? They've also said that are intending to call 2 witnesses to give evidence at the hearing - who on earth could they possibly be??

 

Have any other banks called witnesses? and if so, in what capacity?

 

Any thoughts appreciated

They put exactly the same on my Mums AQ, so we are just waiting now, especially since we received the stay from the Judge.

 

We were wondering on the 2 witnesses and came up with shortlist;

 

Laurel & Hardy

Delboy & Rodders

Batman & Robin

2 random people pulled in off the street (in a last minute wedding stylee!)

 

We could go on and on and on, but honestly we have no clue who they could be. I guess if it all goes our way it will remain one of lifes little mysteries..............

As you say PJ, wait for them to come to you. Do we really think they will go to court? No we don't. Therefore do we care about witnesses? No we don't. Is this more intimidation? No I can't be libelous so I hadn't better suggest that.:rolleyes:;)

 

Just sit tight PJ and let us know what they do. You know where to find us if you need help and support. Sit tight and wait for the offer, and don't settle for anything less than your full claim. Finally some movement but they can still drag it out another month.

That actually sounds like good news to me. They may be dragging it out a bit longer but the end is nearly in sight. I think an offer will be coming soon :)

That's my opinion too Rob. Am I right in assuming that if the judge agrees the stay, then after that one month it's a case of waiting for a court date and the end is nigh? [i really really don't think it will get that far now - I can't believe I even felt remotely worried the other week Caro!] If they don't contact me to resolve this, I can't imagine the judge would be too impressed would he? And would it be too cheeky of me to ask them to throw the £25 they charged me last week in? or shall I just save that for if I have to claim again?

 

I know, I know, too many questions - my head's running away with me now and I might be getting a bit too giddy a bit too soon lol

If you haven't come to a settlement after the months stay then yes, I assume you will be allocated a court date. I think it may be too late to add the new charges on now, if they offer the full amount you put in your claim you can't turn it down just because you've incurred charges since.

They do it because they can.

For them, it's all about control.

This is the basis of how they operate, how they treat their customers, banks are not run on a mutual basis, they are in it for the money and nothing else.

Of course they haven't yet worked out that the longer they stall, the more interest they owe.

You'd think that a bank would know that? Maybe they really do think they can win? :confused:

Playground? That's the basis of their whole credit scoring system.

 

"Miss, Miss, he went overdrawn so I'm going to tell on him so he can't get any credit anywhere. So Ner"!

 

It's quite pathetic. Whatever happened to having bank staff you could really talk to? They've replaced them with automatons who are unable to make a decision for themselves, and who supplement their wages by selling you an insurance policy you don't need..

I've been with YB since 1975 and it counts for nothing.

PJ - I genuinly check your's, Caro's & Trundlecat's threads every day, JUST so that I don't miss the point when you finally get to say "I'VE WON!!!!" against this despisable, horrid bunch of people.

 

I hate them so much it gives me goosepimples just picturing that refund hitting my account, and I can quite imagine that it's a similar story for everyone else that's been unfortunate to have been involved with this lot.

 

So, for what it's worth - I, along with many others here, am firmly right behind you!!!

Ooooo, now then. Just opened my mail (bit late but been out all day today) & I have a copy of YB's AQ. They've asked for the 1 month to try & settle but no indication of witnesses on mine. That says to me they are just using the witnesses thing as an intimidation tac-tic (like with my "not in joint names" saga).

 

Make that lasses PJ cos they're really rubbing me up the wrong way now!

I like the three muskateers analogy - or is it muskateerettes? lol You lot are an absolutely fantastic bunch to have behind me, and I've got to admit that without all your support I'd have probably jacked this in at the first hurdle.

 

And Trunny, they're not playing fair with you - I'm sure you'd have loved to see Laurel n Hardy, or whoever, in court as much as I would :D
