    • Hi, I have found this group very helpful hence I am here seeking help and advice.   I got myself into a situation where I have now more than £50k in unsecured debts (personal loans & credit cards) and things are now getting out of control as I am struggling to make payments. This is purely my own created situation and I am taking 100% responsibility for it. I am keen to get out of this situation as soon as possible hence I would appreciate any help and advice in this process. I am employed at the moment and don’t want to risk going into IVA or bankruptcy as this would risk losing my job. Being sole bread earner of my family, I cannot afford to lose my job. I have been trying to keep up with the payments so far and had few missed payments instances until 3/4 months ago but got caught up with missed payments somehow using my savings. All my debts are still with original lenders. However I know I am getting into same situation again shortly and won’t be able to get out of it again. I have started exploring Debt Management Plan (DMP) option through StepChange but haven’t submitted it yet. Based on budgeting, I have around £820 available to make payments to all lenders after taking care of all other essential expenses. This is definitely lot more affordable than what I am currently paying to different lenders. 1. Is DMP right option for me in current situation? 2. what are the negative consequences of availing DMP? 3. is there something else that I can do to get out of this situation? I’m determined to clear out all my debts but need bit of breathing space and time. Let me know please if you need any additional information. Thanks in advance for all your help and guidance. MM

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Enaid, fancy dress............ what sort of holiday is this............... do you mean posh frocks, or genuinely FANCY DRESS............. Lol. Sounds like a fantastic holiday coming up if you ask me........... can I come too.......?????

 

Caz, right thats it, Decision made, Im gonna have the tortoise. I will ring said naughty little bored sister of daughters friend and tell her we will have him. My son is gonna be over the moon......... and I like the idea of it not dying young, and me having to console blubbing child about tortoise heaven being a better place and all that................ so decision made Caz. Crikey you are a hive of useful information dear. Really. What a fab little encyclopedia you are................... other question. Do they smell, i.e. when in their boxes or igloos at night. If they squib in there, does it pong..........???? Cant do with pongy animals.............. outdoors fine, indoors, nope, hence why I wont have cats, cos the litter trays in houses when you walk in, you can smell em a mile off.................. poopy pongs belong outdoors, farms, and good old fresh air smells are fine, but strictly not in the house. Hubby would go nuts........... Im having trouble convincing him at the mo that the tortoise is a good idea. Although I really think it is...................... I like the idea of having a tortoise plodding around the garden. Might make me think Im the Seychelles or something............ Lol Lol Lol. But Calcium, dont they need calcium tablets or something to help them. Im not sure what kind of tortoise it is, but I will be sure to ask........... Im sure he said something like Galapago tortoise or something............... never heard of it, but I will double check, I might have misheard that..????

 

Thanks Caz. RIGHT THATS IT, Im getting the little tortoise for my boy. The torty will love my garden in the summer Im sure, and we will bring him in for the nights of course, and the whole of winter.......... wont leave him freezing his little shell of................. Yaaaaaaaaaaaaaaaay Fendys getting a torty............. Yaaaaaaaaaaaaaaaaay, my daughter says she or brother will have him when we peg it.................... or they can pass down to their kids etc. when they peg it............... so tortys future is secured................. Morning Enaid...... I grew up on a farm so if the neighbours would allow it I'd keep a donkey called Mildred and a pig called Arthur too in my garden but allas they stay at my parents LOL!

We just have the cats x 2 (Muffin and Bubbles) 3 kittens which Muffin suprisingly popped out last week - all black and look like Sylvester the cat!

And the two stones with legs!! Ooooooo but we have 4 visiting baby hedgehogs at the moment who have taken up residence under the apple tree.

EEeeeek Fendy I have 2 cats but have never had litter trays they're discusting and whoever invented them are too!!

The secret to having a smell free zone with any animal is to make sure the minute any poop appears is to clean it out.

Baby's old and set in her ways and as never poops in the igloo (they don't like to poop were they sleep or rather she doesn't)

But if elvis is young he's obviously been kept in his own little vivarium and he'll be used to it so it might be a good idea to beg for that too cos they can be pretty expensive bribe said elvis giver with food and drink!!

I recommend your siblings learn the art of cleaning his little home out at least twice a week this way it'll be impossible to smell and you'll have a happy house all round!

Babys a hermoin or some people call them herman (spelling it how its said)and she's no trouble at all unless she decides to hide!

Feel great now, thanks Caz. I suppose I will have to ring up work now and see when I am in next:( Your as bad as me with animals we have had rabbits , guinee pigs and even ducks in the past. Not much cance of having anymore though not with the little dog I have now, there are I believe two kinds of bitches, she is both, I love her to bits though and she loves me too.

Yep Fendy it is FANCY DRESS, night one is pink night, as alot of us don't know each other we all have to wear something pink. Think I'll just sit in the sun all day that will be cheaper:D

Second night Audrey Hepburn night, black frock pearls tiarra and pointed stiletto's OUCH.

Third night school girls thta self explanitary, but I won't be a saucy one;)

My Great grandad won baby back in 1961 at a local summer fete.....lol beats a goldfish I suppose!

AM DEFFO GETTING TORTY. YAAAAAAAAAAAAAAY FOR ELVIS............ HES MINE. COMING TOMORROW. LITTLE BOY WILL WET HIMSELF WITH EXCITMENT I THINK. . LOL XXXXX. Will need to pick your brain Caz on foods etc. Lol xxxx He comes with vivarium and heat pad, yaaaaaaay all thrown in for nothing. They just want a good home for him. So home he has got now....................but they are volunteering to look after him whilst we go away on holiday (his old owners that is).

I said those pooter men can find anything LOL!!

The best thing to do regarding Elvis's diet is to ask his previous owners what they've been feeding him because each breed is different they do need calcium supplements if they're fed on the dried food from the pet shop but take for example my two one is an outside plodder and one is an inside swimmer ( neither of them eat the same things)!

Baby who get's lots of sunshine doesn't need any calcium supplements because believe it or not her shell soaks this up from the suns rays - Herbert on the other hand get's his shell wet none stop and refuses to bask under his heat lamp therefore he needs supplements to keep his shell hard! Herbert eats shrimps,prawns,live fish (that he loves swimming about to catch),bloodworms and dried food whereas Baby is strictly an herbivore and eats only vegetable trimmings apart from brussels and cauliflower and carrots give her wind LoL! Best thing to do is get Elvis's exact breed and read up on his specific diet Ooooooo I'm so excited for you:)

Lol, we wondered where ya was last night Hedge. Although I was only on for 10 mins cos I was knackered yesterday. Dunno why, too much on my plate at the mo I think, but never phased, just needed an early night.

Hmmm........... you and me both Fend! We've stocked up on the old flavoured fizzy water - which must be doing my poor liver some good compared to what the ribena was doing!!!!

Bedding down nicely hedge, bedding down. But trying to stop the dog from peeing on the newly planted date palms and castor oil plants. Um, not very good for em me thinks. So threw a doggy bone at him this morning when he decided to wee on them again. Humph............. me and naughty labby need words I think........ Know what ya mean about the breeze Hedge. Lovely in the sun, but still got a chilly wind out of the sun. Its only May 1st, I think we all tend to forget......... Lol xxx

I've just found a ribena coloured beverage. Tidying the cabinets in the kitchen... jar of summer fruits soaking in brandy from last year. SUMMER IN A GLASS!!!! mmmmm mmmmmmmm.

 

Seahorse is slightly newt-like.

 

And the fruit can go in a trifle after the brandy is all gone. How cool is that????? :p

Hahaha.......... can just see you chasing doggie off the palm trees and castor oil plants......... only for doggie to leg it asap and pee up something else!!! Mischievious little terror!!!

 

Hope this weather's boding well for the rest of the summer Fend......... can just imagine nice evenings and weekends chillin' in the garden!!! I'm such a total bore the older I get...........prefer being in my own garden than going out these days - don't have to get a cab home so much easier to stagger upstairs at the crucial point (e.g., when overdone it!!!) xxxxx:p

Bugger that seahorsey, get that fruit in a summer pudding. Is Mrs Seahorsey any good at summer pudding, wow, that would be great having been soaked in brandy................... wow. Like a fine mulled wine in the middle of a pud, or a fabbo rumtopf........... Yaaay for the ribena coloured beverage and fruits soaked in brandy. Wow, nice thought......... get ya mitts off and give em to Mrs Seahorsey to make fabbo summer pud. x Ive got a similar trick. Get bag of gorgeous sultanas and raisins and put em in a jar with extra old barbados mountgay rum, and leave em there for a couple of months and then a fabbo bread and butter pudding with em. Its like nothing on earth when theyve been soaked in rum for a month or two, they all swell up with rum. Its gorgeous........... with lashings of clotted cream, and brown sugar melted over the top. Wow............. mouths watering like hell now Im off the detox. Lol xx

Behave you two............ I'd kill for a lovely pudding right now. Had to stop the whole detox (cos nearly fainted a couple of times!!!) but still being good and scoffing fruit and veg. I'D KILL FOR ANYTHING LOVELY SOAKED IN BRANDY OR RUM............... NOWWWWWWWWWWWWWWWWWWW!!!! xxxx :p

Well, that's my good intentions of losing a coupla stone boogered then. Summer pudding tomorrow it is. I suppose that means I need to finish this off tonite.

 

Oh aye. And I'm listening to the new Evanescence album. A coupla nonsense tracks, but not bad at all in the main. This Amy woserface has got a gorgeous voice.

 

Mrs Seahorsesy is off out for coffee with her pals, so Mr Seahorsey is just chillin for a change.
