      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, flippin chilly thursday morning, absolutely weeing it down like its never weed it down before, dark, gloomy, greenish tinge to everything everywhere, and posties been with no cheque, Lol Lol Lol. Why am I not surprised. Lol Lol Lol xx

 

Tis only thursday though, and she did say I would have to wait till Friday at latest for a decision on settelement. So not in the bag yet I know, and letters going off tomorrow, i.e. abuse order to court, CPR 18 request from me to Cobblers tomorrow, and other bits. Im not worried, cos even if they pull the plug again, Im quite happy to wait for disclosure. COS WE KNOW THEY WONT DO IT. Lol lol xxxx So either way its either they pay me this week or by 26th when disclosure has been requested from em. Not worried..................... positively horizontal.............. Lol Lol Lol xxx

Well Hedge, nothings a sure thing, Im not that smug, but Im just betting they cant do the disclosure thingy, because think about it, to date they have never been able to give a breakdown of costs to court of how they arrive at their charging regime, so why should they change now. But as I say, nothings in the bag till it is, if you know what I mean. Talking in riddles now, Lol Lol..

Right fed up now. Just rung capital one. They should have responded to me by today with offer of full charges after my LBA on 31st May and guess what they havent, so off now to go file MCOL on both mine and hubbys Crapital Bum accounts. lol Lol Lol xxxxxx Fab. Another one in the bag. Fendy xxxxx

Well from what I hear Crap Bum are pretty quick at paying up. From filing MCOL or at court, you get 33 days, i.e. 5 to allow for actual service, then 28 for defence to be submitted once theyve acknowledge saying they will defend, which they always do apparently, so by my reckoning, I should get paid in full no later than 17th July. Ooooo b*gger. Thats the day after we fly off to sunny Caribbean. OMG, what if I miss the cheque, ooooooooooooo nooooooooooooooo. Well, cos theyre so big, if they pay them direct off the credit cards, it means hubby card is paid off in full with balance of 800 to spare in the form of a cheque and mine is............. wait for it, paid off in full with 1600 to spare in the form of a cheque, lol lol lol, so thats the holiday spends sorted without me having to raid meeee overdraft, lol lol lolxxxx

 

Ooooo must take me crapital bum card with me then on jollies. Yaaaaaaaaaaaaaaay for the lovely crapital bum. Theyre paying for meeee holiday spends, Yaaaaaaaaaaaaaaaay,, what lovely crapital bum they are for doing that, lol xxxx

Well setting off over sunny Manchester way at tea time Hedge. Leaving home at 5.30 to get to Manchester Apollo Theatre to see the amazing INXS, doors open 6.30, The Beat are support band, so yaaaaaaaaaaaaay uber giddy, gonna see the gorgeous JD Fortune, yaaaaaaaaaaaaaaay. Cant wait............am sooooooooooo giddy. xxx

OMG, OMG, OMG, OMG, what an uber banging night. Mr. J D Fortune. phwooaaarrrr, I am in total and utter lust with that guy. What stage persona he has. Wow. Danced my FMB's off till late. Bought fabby INXS skinny t shirt, wow, hubby treat me to duffo burger on way out,, lol only cos me stomach thought my throat had been cut, and the kids, well they never sat in their seats they just boogied the whole time. Wow, Wow, Wow, what a performance.................... THEY WERE AMAZING.

 

INXS STILL ROCK, AND THE NEW LEAD SINGER, WOW, THEY PICKED WELL. Hes fab and even the new stuff was just fantastic.

Enaid, I just had the most fantastic time. Saw the turn off for Salford on the motorway, and thought, um, shall I pop into hedgeys for a quick beer before the Apollo, but hubby said, No you stupid woman, we dont have time, cant you see we are late, lol lol lol. Men..............
