just received last 6 years of statements about to do schedule of charges not exactly 100% sure on what to put in them have no overdraft with them as they refused to give us one which meant our refferal charges each week spiraled out of control aand returned d/d charges please help anyone................

Dear Mean,

You just add in the referral charges and unpaid?returned charges.

First Trust are also arguing that you cant include letter fees, but these are advertised in their terms and conditions as a penalty , so I would include them.

(strange they don't charge my father for his Christmas card)

If ye need any more help just give us a shout

Hi Mean , no the 8% is the statutory interest that you will be able to reclaim on charges once they have been made.

You cannot claimm this until you go to court.

They would not be able to demand back a loan since this is a regulated product under the Consumer Credit Act.

They may demand back any outstanding overdraft balance (which they were entitled to do anyway), but must listen to you under The Banking Code etc if this going to cause you a particular hardship!!!!!

Just follow the steps in this forum aNDYOU WILL GET YOUR MONEY BACK!!!!

I would advise that you read as much on here as possible, before taking any action.

thanks bally another silly question but i understand that i dont claim the 8% until it goes to court but when i fill in the spreadsheet with the schedule of charges to send off to bank with preliminary letter do i delete that column also charges are for £2600 and small clai court in N I is only for £2000 or less . do i keep my total below the £2000 to be on th safe side

Hey you havent got to court yet.

In the first case, include all your charges with your prelim letter to your bank (the recorded delivery postal systm in Norn Iron is sh.***)so you may want to consider handing it in at your local branch and getting receipt for it.I Also fax everything as well and print a report (am very cynical).

Dont include the 8% at this stage, as you can only claim it at court.

Some people have decided to abandon theportion of claim opver £2000 and this advice comes from The Small Court as subsequent claims are considered an abuse of process.

However that is a personal decision and I would hang around this forum and see what others are up to in Northern Ireland Paddym and Lickthewallfatboy are particularly helpful for N.I Banks.

Just started against 1st trust. could you e-mail me a copy of the terms & conditions advertising "penalty". this would be a great help.
