    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

When you select ‘Register’, you will be taken to a screen titled ‘Sign in using Government Gateway’.  Choose ‘Create sign in details’ to register for the first time.  You will be asked to provide your name, email address, set a password and a memorable recovery word.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have used your spreadsheet for calculation of penalty charges and interest but have noticed when I deleted the unnecessary rows of cells up to row 777 so as not to print them it altered the total of my interest on penalties figure?

It shouldn't do this. I'm not sure what's gone wrong here, but it's been fine for everyone else so far. Can you please try again.?

Hi there.

 

Ive used the basic spreadsheet to work out my interest. I gather i have to replace your figures and dates with mine. My problem is that when i get to the end of what you have written the totals dont move down so get replaced. Ive never used a spreadsheet before so what am i doing wrong.

BUT! got a problem. I get that I have to take the balance at the time the interest is taken out and if that balance is positive I take the worst overdrawn balance of that month, and I get if I've been charged more than once in a month I only put the interest in once, but I've noticed on my statements (although it dose not say it) that they charge interest in arreas i.e period of 9th april - 9th may I was charged interest in june!!?? I only noticed this because I was'nt charged any interest between 9th april - 9th may even though I was overdrawn, but I was charged interest in june but I was in credit. Dose this mean I have to start again and put in the interest that was charged in june and june's balance or do I just continue putting in the interest charged in the month the unlawful charge was applied?

 

This is getting so confusing, just as I think I've got it something else creeps up:confused: been at it 2 weeks now HELP!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Hi pettal - I got round this by using the highest overdrawn figure for the month in question.

Only put in an interest debited figure where it occurs - don't leave blank or zero rows - the interest side doesn't have to line up with the charges and will usually end up as a shorter list.

:???: Sorry but im a carpenter and not used to spreadsheets i am trying to do a sheet for a credit card i have read through previous posts and listed charges in correct cells (left hand side/date order/oldest first) then i open a new s/s in a new window copy and paste just the blue boxes into charges side and start entering interest, thing is most of mine are late charges and a lot of the time i was not over my limit with the card i was just late and i may have had up to £500/600 left on credit,so when i enter the balance the interest does not change i.e. £0.00 at the start and the end thats after 26 entries.

 

I suppose i am asking because its a credit card do i enter the balance as a debit i.e. credit limit £2000................balance £1450.00 ..........amount available.......£550.

 

therefore my balance on the spreadsheet should read -£1450 in the interest collum.

The balance on a credit card would (almost) always be negative, as you owe them money. It would be extremely rare for a card with charges to be in credit.

So sorry to post but for some reason when i download the spreadsheet, numerous times, i cant get it to work. God knows what im doing wrong. Im hoping that if i supply the info, someone can calculate the interest....

Hi,

 

Think I am probably just being thick. But if I am trying to get the bank to give me my money back which spread sheet am I using the one with the yellow and turquoise on or the other one.

 

Can anyone enlighten me?

You use the coloured one if you are going to reclaim the interest on the bank charges. This one can calculate the interest the bank has charged you on the proportion of the overdraft that is due to charges. It also does the 8% s69 interest that is ONLY claimed when the claim reaches the Moneyclaim stage. The other spreadsheet only does the 8% bit.

 

Both of them obviously add up your charges for you. ;)

Hello,

Sorry newbie here. I have read through the interest posts but am still unsure as to whether I ass the interest when requesting my charges cash back or if I only do so if they do not pay me them back within 14 days?

Thanks for all help, and I will be donating when I DO get my charges back! Looking at about 1500!

There are a number of elements that make up your claim: -

 

1. Unlawful bank charges.

2. Interest on the portion of the overdraft that is due to accumulated unlawful bank charges.

3. When you raise a court claim you are entitled to claim 8% 's69 Interest' on the value of the claim at this point only.

 

Some people don't bother with the second item as it can be complicated and might not be enough to bother about.

 

 

The coloured spreadsheet will work out all of this for you but you are advised to have a good read through this thread before using it.

Can anyone tell me how to calculate the 8% interest from the date I filed in Moneyclaim to the date the bank refunded me my charges and the 8% interest up to when I filed in Moneyclaim? If you try yo use the spreadsheet it will use todays date automatically.

The answer to you question Cola is you can claim the interest back that the bank has charged on any overdrawn balance caused by the charges but you can only charge the 8% interest on the total claim when you file your moneyclaim

Hello!Thanks very much for the prompt reply.Okay, for number 1, I have a list of all the charges made on my account that equal 1500 pounds.

2, I have a ‘free’ overdraft of 250 pounds. I have added up all the interest that has been debited from my account but guessing that will be for me being overdrawn etc as well. I’m guessing if I go through the coloured spreadsheet this will work out this particular interest. Is that correct? If so I can then send off my letter with the correct interest.

For number 3, got ya! That’s only if I go to court… or at least have to threaten to!Cheers, you loves! Told all my friends about this site. I’ve been a silent watcher for a while! ;)

 

.. Oh and cheers also to you Arthur! I see you got a fair whack of interest (good for you!) Was that as you had to file a claim and thus got the 8%too?

You multiply the total of your claim excluding court fees by 0.00022 which will give you a figure of for example 0.352 which is 35 pence. The amount in pence (or £ & p) is put in the claim as the daily rate. It is applicable to the period from the date the claim is filed until it is settled and should be paid to you on top of the basic amount of the claim and court costs.

Hi I am probably hijacking a thread here and will get told off but......

 

Vampiress and Seminole. I just wanted to thank you publicly for the time and effort that you both went to, to assist me in sorting out my spreadsheet problems. You are both very very very nice people:-)
