    • If the purchaser denies having received it then sue P2G. If you simply don't hear anything more from the purchaser then you have the purchaser's name and address – and frankly for £48 I would go ahead and sue. As long as you have good proof of delivery then your chances of success are probably better than 95% and frankly the purchaser would probably put their hands up as they would effectively be being sued for the civil equivalent of theft. I wouldn't let it go if I were you. It would be a good exercise for you and gives you confidence the next time something comes up which is may be much more valuable

Not only did I do the work, but as a maths tutor delivering financial literacy workshops under the Govt Multiply project, the college were paid £400 for each student I recruited, which makes it an even bigger kick in the teeth! I spoke to Citizens Advice Bureau on Friday who advised me to go back to ACAS for advice and assistance, as ACAS are the experts in employment matters. They did also mention small claims court, as being more straightforward and less complex, but surely their solicitor would just contest this and I would lose the £80 court fee? If I did submit a claim through the small claims court, would I just leave the employment tribunal running until the outcome? The deadline for me to submit my schedule of loss is tomorrow, so I will submit today so that they cannot hold me in breach.
    • Ive just checked the tracking again and its actually out for delivery today! Anyway,  I refunded the buyer on Ebay off my own back on the 2nd of June they havent opened a case or anything like that so surely i cant take action against either the buyer or P2G/ Evri can i ? Id hope the buyer would see fit and pay but you know what people are like these days ... Once its delivered I'll send him a polite message asking for payment but i suspect there'll be no reply

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I just my credit file yesterday and they weren't on there. Checked it today and now they have registered a default on my credit file. The default is dated 31st May 2006.

 

They have never written to me, I don't know what this debt is.. Yet without a care in the world they have registered a default on my file.

 

 

Well welcome Tessera, you have just joined Cabot on tbern123's S**t list. I am in the process of writing a cca letter now and I will be asking them under what right they have registered a default.

According to Tesseras Information Commissioners Office entry they have a few names-

They are also registered with the CSA. Can we expect their complaints received to increase by one?

I have had dealings with this crew, how are you getting on with them. So far they bounced my account to Robinson Way and I soon got them into line and they handed it back to BTMK. Nothing else since Jan07

Until a guy from Robinson Way, called me up and asked me if I would be paying by debit or credit card.

 

I explained that I would be paying by neither and that I do not acknowledge the debt. He got a bit shirty and said that they would send a Debt Collector to my house.

 

Red Flag to a Bull, so I sent an email to the bosses of Robinson Way and of Tessera.

 

This was their response

Who is BTMK ?

They are the group of solicitors who act for (are part of) Teserra.

 

It is them who were chasing me for Tessera stuff.

 

So my question should have been - have Tessera removed the credit file stuff they were reporting?

Hi,

I have a letter from Fenton Cooper(part of Tessera) and at bottom of letter quotes. Fenton Cooper is a trading name of Tessera Credit Services Limited. Registered office:- 30 City Road, London, EC1Y 2AB.

Sent a cca of to Tessera at the above address and surprise surprise the letter returned unopened and someone has written on the envelope " company moved away " and on the royal mail sticker which explains why the letter has not been delivered they have ticked the box that says "addressee has gone away".

 

We wish they would ......Go away.

Oh dear, that's the address they are registered with with the ICO. I can feel a complaint coming.

Just joining the Tessera Fan Club.... have recently been contacted by Fenton Cooper from the Southend address over an account that was CCA'd in January. All legal action was dropped shortly afterwards.... and now this crew have picked it up, having "been instructed" to blah-de-blah for their "clients"...

 

Bog off email sent outlining that their "clients" are in serious default of a CCA request, etc.... hard copy sent by rec. delivery. ;)

Tessera have put somehting on my file too!!! They say its from 2005 and just put it on for this month? I managed to find a number and call them and they said dont worry but the default is still there - i spoke to experian and they acknowledged the dispute but then told me that Tessera would not remove the defualt! I am so annoyed as i have no idea what they are talking about - what do i do???

Hi, I'm new to this - I have a letter here from 'Pace Forward' Trading name of Tessera Credit Services. I had a letter from Rockwell last week regarding a debt owed to the Clydesdale Bank for a credit card - I have never had a credit card from them and as far as I am aware I don't owe anyone any money. I have in the past and have struggled for years to pay it all off. My credit rating has soared in the last few months and I was feeling really quite proud of myself and then this !

 

This letter is asking m to contact them to discuss 'a personal matter.' I have read some stuff on this site today which is a great site! I then checked my credit file and low and behold - Tessera Credit have done a check on my credit file on the 10th December!

 

I have no idea what to do about this - should I call them? I called Rockwell after the last letter only to be told that they had the wrong person and that it wasn't my debt!

Hi JKG,

This smack's of a desperate DCA to me.

Is their anything on your credit file for them to warrant this anyway and if not I would just ignore it.

But should you wish to contact them whatever you do don't phone them communicate only by letter.
