  2. Thank you PT2537 I hope someone can advise me. I made a big enough mistake burying my head in the sand and not defending this in court, I really do not want to have to pay more than i need to.

  4. Hi All Hope someone can help. I have a charging ouder against me on my house for over £8000. I have made an arrangement to pay £10 a month until my financial circumstances improve. I have just found out that they are putting £63 interest every month on this account. Are they allowed to do this????????? At this rate the will own the house soon
  5. Rockwell Debt Collection Agency. For sending all my personal details to someone else including name, address, date of birth and bank details. If it wasnt for the person contacting me to inform me of this i would be none the wiser. Luckly she was an honest person. How many more people has this happened to.

  7. Sent a non compliance letter to Link today as they defaulted on the 1st July.

  13. I cca'ed Thames Credit they wrote to say they had not got the agreement and would remove me from there list. So all is not lost Kezza and certainly not worth making yourself ill over. Hope all works out ok.

  16. Hi Rory the amount is £3380 Is it worth mentioning to them that I sent a CCA request to Fenton Cooper on the 18th May and they are now in default. The thing that worries me is that Rockwell sent my details to a stranger but when i request them they don't have them so where are they now as the lady who received them wrote to tell me she had returned them to Rockwell.
  17. I think it would be worth there while because I cca'ed fenton Cooper in June and have had no reply so it looks like they haven't got the agreement so they won't be getting the money anyway.

(2) An individual who suffers distress by reason of any contravention by a data controller of any of the requirements of this Act is entitled to compensation from the data controller for that distress if- (a) the individual also suffers damage by reason of the contravention, or (b) the contravention relates to the processing of personal data for the special purposes. (3) In proceedings brought against a person by virtue of this section it is a defence to prove that he had taken such care as in all the circumstances was reasonably required to comply with the requirement concerned.

  20. Ok here goes. Dear Sir/madam, I refer to your letter received on the 29th June 2007. Whilst I appriciate that you feel this is a a final responce to my complaint it is my intention to resolve this matter amiciably and without the need to resort to legal action or the making of a complaint about your company which would lead to an investigation and a fine, regardless of the outcome. Under s.13 of the Data Protection Act you are required to compansate me for the mistake you made by passing my personal details to another person. I therefore require you to write off my debt and mark it down to a £zero balance and for you to remove any default notices from my credit record. Although you feel this matter was a single incident I feel conciderable destressed and I have a total lack of confidence in your companies ability to handle confidential and financially sensitive material. Therefore unless all my data is removed from your files and the balance zeroed I have no other option than to report this matter to the Office of Fair Trading, The Financial Ombudsman Services, Trading Standards and The Financial Crime Branch of HM Treasurery.
